The Tequesta Village Council held a workshop meeting at the Village Hall, 357 Tequesta Drive, Tequesta, Florida, on Thursday, October 8, 1992. The meeting was called to order at 11:03 A.M. by Mayor Earl L. Collings. A roll call was taken . by the Recording Secretary, Fran Bitters. Councilmembers present were: Mayor Earl L. Collings, Ron T. Mackail and Joseph N. Capretta. Also in attendance were: Village Manager Thomas Bradford, Village Clerk Joann Manganiello, Scott Ladd, Building Official, and Attorney Pam McNierney sitting in for Village Attorney John C. Randolph. II. APPROVAL OF AGENDA Councilmember Mackail moved to approve the Agenda as submitted. Councilmember Capretta seconded the motion. The vote on the motion was: Earl L. Collings - for Joseph N. Capretta - for Ron T. Mackail - for the motion was therefore passed and adopted and the Agenda was approved as submitted. REVIEW OF PROPOSED ORDINANCES EFFECTING CHANGES AND ADDITIONS TO THE COMPREHENSIVE ZONING ORDINANCE, ORDINANCE NO. 355, AS AMENDED. A) Staff Review of Proposed Ordinances 1. Section X, Supplemental Regulations: Amends Subsection (H) , Landscaping, at paragraph (2) (c) 2. , residential areas, by adding certain minimum requirements for single-family and duplex lots within the R-1, R-lA and R-2 zoning districts, which currently are exempt from Ordinance #377, the Landscape Code. This also amends the prohibitive landscaping section to track the latest Palm Beach County prohibited species list. Village Manager Bradford pointed out that the Florida State Statute compels every municipality, by October 1992, to consider a xeriscape Ordinance. Commercial properties have already been mandated. This applies only to new construction and major renovations. 2. Section XVI, Uniform Waterway Control: This proposed ordinance has been promulgated at the request of certain citizens and home owner association members residing in Country Club Point Subdivision. A review of the Zoning Code, Ordinance #319, as amended, in effect from March 1984 until August 1987 indicated that the subsections set forth in this proposed ordinance, were in fact, included in Ordinance 319 as amended. When the Village promulgated Ordinance 355 in August 1987, these subsections were inadvertently deleted. Scott Ladd explained this tracks State Law. 3. Section X, Supplemental Regulations, (amending Subsection (A) (1) (c) : This ordinance clarifies where fences and walls may be erected on a property (not to be forward of the forward-most structure of the house) . 4. Section X, Supplemental Regulations, (amending Subsection (H) , Landscaping, at paragraph (2) (c)9. Tree Protection, and Subsection (Q) , Utility Services, by adding a new paragraph (3) . These changes were done as a result of Comprehensive Plan policies the Village has been mandated to do. Section XV, Flood Hazard Areas, amends Subsection(J) , Coastal High Hazard Area, at paragraph (1) , and amends paragraph (2) by adding a new sub-paragraph (o) . • Village Council Workshop Meeting Minutes October 8, 1992 Page 3 The Village Council amended Section 4 (o) to reflect that rebuilding will be allowed, but only according to Department of Natural Resource regulations. 5. Section VII, Schedule and Application of Regulations, amending Subsection (D) , paragraphs (1) (d) , (2) (d) and (3) (d) , Special Exceptions, by adding three (3) new special exception uses that have already been included in Section IV, Definitions, but which have not been included within the residential districts per the Comprehensive Plan Housing Element Policy 1.4.2 . 6. Sections VII, X, XII and XIV, bringing Zoning Codes up to date result from changes, amendments, certain omissions, inconsistencies, duplications and conflicts within the Code that have taken place over the years. Sections VII and X, sets for the requirements for full-service fuel stations or gas stations in the special exception use sections of the C-2 and C-3 zoning districts and by deleting the requirements for full-service fuel stations or gas stations from Section X. Section X, Subsection (M) , Site Plan Review, needs to be amended in order to provide a more efficient and usable process and also by adding language regarding developers agreements. Mayor Collings pointed out that Section 4 (4) (e) needed to be amended striking one of the "grant approval" repetitions. Section XII, Subsection (J) , paragraph (2) of the Sign Code amended to add signage regulations for churches located within residential districts. Amend Section 5 (2) (f) : should be changed to read "Churches or synagogues located. . . ." Section XII, Subsection (K) , paragraph (2) , of the Sign Code amended in order to provide for shopping center identification free-standing signs in addition to the free- standing signs currently allowed within the commercial district. October 8, 1992 Page 4 Section XIV, Subsection (A) , paragraph (8) of the non-conforming use criteria of the Zoning Cod amended in order to further clarify that variances from the Board of Adjustment are not required for replacement screen enclosures under certain circumstances. V. ANY OTHER MATTERS There were no other matters before the Village Council. VI. ADJOURNMENT Councilmember Mackail moved that the meeting be adjourned. Councilmember Capretta seconded the motion. The vote on the motion was: Earl L. Collings - for Ron T. Mackail - for Joseph N. Capretta - for the motion was therefore passed and adopted and the meeting was adjourned at 12:00 P.M.
