MEMORANDUM

DATE: September 3, 1992
SUBJECT: Ordinance Amending User Charges and Fees for
Residential Curbside Solid Waste and Recycling
Collection Services; Agenda Item.
Nichols Sanitation has agreed to accept a 2.8% increase in their
rates based upon the CPI increase as of May 1, 1992. Nichols
Sanitation is entitled to the increase in the CPI per the
Franchise Agreement granted to them by the Village.
State Law requires that fees and charges for such services shall
be adopted by ordinance. The attached ordinance implements the
new rate schedule for refuse collection, 'recycling collection
and, for the first time, imposes the mandatory yard waste
collection fee of $1 per single family home per month.
It is recommended that the Village Council adopt this Ordinance
on first reading to provide sufficient revenues to meet Village
obligations in solid waste collection services for the fiscal
year commencing October 1, 1992.

ORDINANCE INO.
AN ORDINANCE OF THE VILLAGE COUNCIL OF THE
VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA,
AMENDING SECTION 18-28(C) PROVIDING FOR USER
CHARGES AND FEES FOR RESIDENTIAL CURBSIDE SOLID
WASTE AND RECYCLING .. COLLECTION SERVICES;
PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL
OF ORDINANCES AND CONFLICTS; PROVIDING FOR
CODIFICATION; PROVIDING AN EFFECTIVE DATE.
WHEREAS, the Village has executed a Franchise Agreement with
Nichols Sanitation, Inc., for curbside solid waste and recycling
collection services for a five (5) year period commencing
October, 1989, granting the franchisee the exclusive rights to
collect solid waste within the municipality's service area; and
WHEREAS, the Village is required to establish user charges and
fees for residential curbside solid waste and' recycling
collection services.
NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE
VILLAGE OF TEQUESTA, FLORIDA, as follows:
Section 1. The Code of Ordinances of the Village of Tequesta
is hereby amended at Section 18-28(c) which Section shall read
as follows:
"(c) The billing for residential curbside solid waste and
recycling collection service) for the Fiscal Year 1992/93
shall be as follows:
Refuse Service Collection:
Single-Family Homes $9.161per month
Multi-Family Homes $7.781per. unit per month
Recycling:
Single-Family Homes $1.96Iper month
Multi-Family Homes $1.81 per unit per month (optional)
Yard Waste:
Single-Family Homes ! $1.00 per month
Multi-Family Homes I Not Applicable "
Section 2. Severability. Ifjany provision of this Ordinance
or the application thereof is' held invalid, such invalidity
shall not affect the' other provisions or applications of this
Ordinance which can be given effect without the invalid
provisions or applications, and to this end, the provisions of
this Ordinance are hereby declared severable.
Section 3. Repeal of Ordiinances in Conflict. All other
ordinances of the Village of Tequesta, Florida, or parts thereof
which conflict with this or any part of this Ordinance are
hereby repealed.
Section 4. Codification. This Ordinance shall be codified
and made a part of the .Official Code of Ordinances of the
Village of Tequesta.
Section 5. Effective Date. This Ordinance shall take
effect immediately upon its passage and approval, as provided by
law.
