Review and consideration of a resolution to transmit to DCA
a proposed Comp Plan amendment.
Tom, a Public Hearing has been scheduled for the Council meeting of
August 13, 1992 in order that Council, sitting first as the Village of
Tequesta Local Planning Agency, can review and recommend approval of
Resolution No. 26-91/92 proposing to transmit to DCA an amendment to
the Comp Plan. The proposed amendment would effectuate a land use
change on a small, . 96 ± acre parcel of land located at the northwest G
corner of Tequesta Drive and Pine Tree Drive. The proposed land use
change - would be from residential low density, 0-5. 5 dwelling units per
acre to residential medium density, 5. 5-12 dwelling units per acre.
The owners of the parcel of land, Edward & Monica Armour, desire to
build ten ( 10) attached townhouse units in lieu of four ( 4) or .five
( 5) single-family dwellings that could be built with the current land
use and zoning category.
Attached are packets for the public hearing containing the following
items: "
1. Legal notice of land use change prepared by the Village Attorney.
2. Proposed Resolution No. 26-91/92 authorizing transmittal of the
Comp Plan amendment ( land use change) .
3. Location map taken from the future land use map indicating the
parcel of land being considered for a land use change.
4. Copy of the legend from the future land use map. L
5. Copy of a proposed site plan and building elevations for the
proposed ten ( 10) unit townhouse project.

NOTICE OF CHANGE OF LAND USE
TO ALL CITIZENS OF THE VILLAGE OF TEQUESTA
TO ALL PARTIES IN INTEREST AND TO ALL WHOM IT MAY CONCERN:
The Village of Tequesta proposes to change the use of land within
the area shown in the map in this advertisement by means of a
comprehensive plan amendment changing the land use for said area
from low density (maximum of 5.5 dwelling units per acre) to medium
density (5. 5 to 12 dwelling units per acre) .
A Public Hearing on the proposal will be held before the Village of
Tequesta Local Planning Agency and the Village Council on Thursday,
August 13, 1992, at 357 Tequesta Drive, Tequesta, Florida 33469.
The Local Planning Agency will consider the proposed plan amendment
and approve a recommendation to the Village Council commencing at
7: 00 p.m. The Village Council shall consider the recommendation of
the Local Planning Agency and approve or disapprove a Resolution
transmitting the proposed plan amendment to the Department of
Community Affairs at 7:30 p.m. or as soon thereafter as the matter
may be heard. Prior to the above referenced hearings, any
interested person may inspect a copy of the proposed plan amendment
and application at the office of the Village Clerk of the Village
of Tequesta, at 357 Tequesta Drive, Tequesta, Florida.
PLEASE TAKE NOTICE AND BE ADVISED, that if any interested person
desires to appeal any decisions made by the Village Council with
respect to any matters considered at this meeting, such interested
persons will need a record of the proceedings, and for such
purposes will need to ensure that a verbatim record of the
proceedings is made, which record includes the testimony and
evidence upon which the appeal is to be based.

A. RESOLUTION OF THE VILLAGE COUNCIL OF THE
VILLAGE OF TEQUESTA, FLORIDA, PURSUANT TO
CHAPTER 163.3161, ET SEQ. F.S. , PROPOSING TO
TRANSMIT TO THE STATE OF FLORIDA, DEPARTMENT
OF COMMUNITY AFFAIRS, AN AMENDMENT TO THE
COMPREHENSIVE PLAN ADOPTED OCTOBER 12, 1989,
AS AMENDED, AUTHORIZING THE VILLAGE MANAGER TO
TRANSMIT THE PLAN AMENDMENT TO THE DEPARTMENT
OF COMMUNITY AFFAIRS FOR REVIEW PURSUANT TO
CHAPTER 163, FLA. STAT. l�
WHEREAS, the Village of Tequesta adopted by Ordinance No. 39.1
its Comprehensive Plan pursuant to Florida Statues Chapter 163 on,
October 12, 1989; and �\
WHEREAS, the Village of Tequesta proposes to transmit a plan
amendment to its Comprehensive Plan pursuant to Section 'N
163.3184(15) , Florida Statutes; and
WHEREAS, pursuant to Section 163.3184(15) , Fla. Stat. , the
procedure for transmittal of a proposed plan amendment shall be by
an affirmative vote of not less than the majority of the total
membership of the governing body; and
WHEREAS, it has been determined by the Village Council of the
Village of Tequesta that transmittal of the proposed plan amendment
attached hereto and incorporated by reference as a part of this
resolution is in the best interests of the citizens of the Village
of Tequesta.
NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE
VILLAGE OF TEQUESTA, FLORIDA, as follows:
Section 1. By publication August 6, 1992, in the Palm
Beach Post, the citizens of the Village of Tequesta and all other
interested parties were notified that the Village of Tequesta
proposed to transmit a plan amendment to its Comprehensive Plan on
this date.
Section 2. The plan amendment proposed to be transmitted
is attached hereto and is hereby incorporated by reference as part
of this Resolution as if fully set forth herein.
Section 3. The Village Manager and Village officials as
required are hereby authorized to undertake the necessary measures
to transmit the plan amendment pursuant to Chapter 163, Fla. Stat.
Section 4_ This Resolution shall take effect immediately
upon its adoption.
Section 5. Ten (10) copies of the subject plan amendment
shall be transmitted to the State of Florida, \ Department of
Community Affairs.
`A THE FOREGOING RESOLUTION was offered by Councilmember
, who moved its adoption. The Resolution
was seconded by Councilmember and
upon being put to a vote, the vote was as follows:
FOR ADOPTION AGAINST ADOPTION
The Mayor thereupon declared the Resolution duly passed and
adopted this day of August, 1992.
