Bradford, Village Manager DATE: July 16, 1992 SUBJECT: Americans With Disabilities Act; Agenda Item Sub-Title A of Title II of the Americans With Disabilities Act (ADA) prohibits discrimination on the basis of disability by public entities and became effective on January 26, 1992. The Village is evaluating its current policies, services and practices to ensure compliance. The ADA' requires a grievance procedure to resolve grievances in a prompt and equitable manner for cities having 50 or more employees. Even though Tequesta has less than 50 employees, it is advisable to have a grievance procedure anyway. Such grievance procedure must be formally adopted and published. The grievance procedure, attached for Village Council approval, is adapted from the procedure published by the National League of Cities, Washington, D. C. The memorandum to all interested parties outlines the Village ' s commitment to comply with the ADA, and it requests input from the disabled community to determine what is still needed. This will also be published. The ADA requires that local governments give primary consideration to the request of individuals with disabilities. This memorandum also requests volunteers from the disabled community to assist the Village in this endeavor. Title I of the ADA, dealing with employment, will take effect on July 26, 1992. The attached Title I ( Self-Evaluation Checklist) indicates progress the Village has made in complying with this Section. The Transition Plan, prepared by Scott Ladd, our Building Official, is the outline for identifying and addressing structural changes to facilities that will be undertaken to achieve program accessibility. The deadline for completing the Transition Plan, not the structural changes, is July 26, 1992. It is recommended that the Village Council adopt the ADA actions referenced herein and on the Agenda. Further recommendations may be presented to the Village Council as we become more familiar with the ADA requirements and/or receive input from the disabled community. Submit all complaints regarding access or alleged discrimination in writing to Thomas G. Bradford, Village Manager, for resolution. A record of the complaint and action taken will be maintained. A decision by the Village Manager will be rendered within fifteen ( 15 ) working days. 2 . If the complaint cannot be resolved to the satisfaction of the complainant by the Village Manager, it will be forwarded to an ADA Compliance Committee, composed of the Village Council appointees to the Finance and Administration Committee. 3 . The complainant will be heard by the ADA Compliance Committee within thirty (30) days of written request for review. The Committee Hearing shall be informal and rules of evidence shall not apply. The Committee shall hear the complaints in public, after adequate public notice is given in an unbiased, objective manner. The Committee shall issue a written decision within thirty (30) days of the Hearing. The proceedings of the Committee shall be recorded and maintained. 4. If the complaint cannot be resolved to the complainant ' s satisfaction by the Committee, the complainant will be heard by the Village Council at a regularly scheduled Village Council Meeting. A determination by the Village Council must be made no later than the next regularly scheduled monthly . Meeting of . the Village Council . The decision of the Village Council is final . 5. A record of action taken on each request or complaint must be maintained as a part of the records or minutes at -each level of the grievance procedure. 6. The use of this grievance procedure is not a prerequisite to the pursuit of other remedies. An individual 's right to prompt an equitable resolution of the complaint will not be impaired by his/her pursuit of other remedies. Rer}rled raper
