Bradford, Village Manager DATE: June 10, 1992 SUBJECT: Northern Area Mutual Aid Consortium; Coordinating Council; Village Appointments As you know, at the last Village Council Meeting, the Village Council approved executing the attached NAMAC Agreement. Mayor Collings attended the signing ceremony on behalf of the Village in Juno Beach on June 3. . The NAMAC Agreement creates a Coordinating Council to which each member jurisdiction shall appoint one Representative and one Alternate Representative. These Representatives shall be elected officials or management personnel of the member jurisdiction. The purpose of the Coordinating Council is to oversee and facilitate the operation of the Consortium and from time to time inspect facilities and equipment to be used in the plan. I have three alternatives for the Village' Council to consider in this regard, as follows: Ipo,,t 0 Appoint the Chairman of the Public Safety Committee as the Representative and the Co-Chairman as the Alternate Representative. 2 ) Appoint the Mayor as the Representative and the Vice-Mayor as the Alternate Representative. - 3 ) Appoint the Mayor as the Representative and the Village Manager as the Alternate Representative. I believe there is merit to having the Public Safety Committee Members represent the Village on the Coordinating Council in that they would gain more insight into police operations and public safety planning concerns by attending these periodic meetings. TGB/krb Attachment Recycled Paper NORTHERN AREA MUTUAL AID CONSORTIUM N A M A C / POLICE Purpose: To provide an organized method of providing Police Services and/or Emergency Mutual Aid Service to member jurisdictions. Scope: To invite interested providers of Police and Emergency Services to meet and plan for the times when the resources of one jurisdiction cannot control an emergency/non emergency type situation. Definition: Mutual Aid Police Assistance given to a neighboring member jurisdiction at those times when police services and/or emergencies exceed the resources of one jurisdiction. This can relate to one large incident or multiple incidents occurring at one time. This mutual aid is to include, but not be limited to, emergencies listed under Florida State Statute 252.34(2) . Coordinating Council, Member jurisdictions shall appoint one representative and one alternate representative to the Coordinating Council. These representatives shall be elected officials or management personnel of the member jurisdiction. The Coordinating Council shall oversee and facilitate the operation of this consortium and from time to time inspect facilities and equipment to be used in this plan. The Coordinating Council shall elect a Chairman, Vice Chairman, and Secretary. The Coordinating Council shall meet no less than three times during the first twelve months of this agreement, and no less than once every six months thereafter, at a time and place designated by the Chairman. Special meetings may be called by any member with majority consent. Council of Chiefs: The Chief Law Enforcement Officer of each member jurisdiction shall sit as a member of the Council of Chiefs. A member jurisdiction may also appoint an alternate to the Council of Chiefs. The Council of Chiefs shall operate NAMAC/Police and conduct drills/training within the system as deemed necessary. Council of Chiefs will maintain and exchange a current inventory of pertinent equipment and personnel expertise. The members of the Council of Chiefs shall elect a Chairman, Vice Chairman and Secretary. The Council of Chiefs shall meet no less than two times during each year at a time and place designated by the Chairman. Special meetings of the Council of Chiefs may be called by any member of the Council of Chiefs with majority consent. NORTHERN AREA MUTUAL AID CONSORTIUM EMERGENCY-POLICE SERVICES MUTUAL AID AGREEMENT WHEREAS, the parties to this Agreement presently maintain a Police Department with police equipment, police personnel, and trained technical personnel; and WHEREAS, it is deemed mutually advantageous to enter into this Agreement providing for mutual aid in times of need for police services and/or emergencies where the need created may be too great for any one party to deal with unassisted. NOW, THEREFORE, it is agreed by and between the parties that each will render mutual aid assistance and service to the other under the following stipulations, provisions and conditions: 1. Mutual aid and assistance, including, but not limited to, police response, and stand-by coverage, will be given when properly requested, subject to limitations set forth below. 2. The person requesting the mutual aid and assistance shall give the following information at the time his request is made: a. The general nature, type and location of the police service and/or emergency. b. The type of personnel and/or equipment needed. 3. Only the following officials of the participating parties are authorized to request aid and assistance under this Agreement: The respective Police Chiefs, and those designated by these Police Chiefs through their respective Department Policies and Procedures. 4 . In the event of a law enforcement type situation or emergency occurrence, which requires mutual aid assistance, the Police Chief of the jurisdiction in which the incident is located, or in his absence, the Assistant Police Chief or the Shift Supervisor shall direct the activities at the scene where the emergency exists. As soon as practical, the agency requesting mutual aid assistance shall facilitate the relief of assisting personnel. Discipline of personnel and other matters incidental to performance of 'services and control of personnel shall remain within the respective control of their own agency. 5. Each participating party reserves the right to refuse a • mutual aid call in the event it does not have the required personnel/equipment available or if, in its judgement, compliance with the request for mutual aid assistance would jeopardize the protection of its own jurisdiction. 6 . No employee of any party to this Agreement shall be requested to perform any function or service which is not allowed within the scope of the duties of the person within his/her own department. 7. Persons employed by any party shall not, in connection with this Agreement or in the performance of services and functions pursuant hereto, claim any right to pension, worker's compensation, unemployment compensation, civil service, or other employee rights or privileges granted by operation' of law or • otherwise except through and against the entity by which they are employed at the time of the call and/or response. 8. The parties .to this Agreement and their respective personnel shall not be deemed to assume any liability for the act, omission, and negligence of the other party. Further, nothing herein shall be construed as a waiver of sovereign immunity, pursuant to Florida Statutes, Section 768.28. 9. All privileges and immunities from liability, exemptions from law, ordinance and rules and all pension and relief, disability, worker's compensation and other benefits which apply to the activity of the personnel of either party when performing their respective functions within the jurisdictional limits of their respective agencies shall apply to the same degree and extent to the performance of such functions and duties requested, pursuant to this Agreement. Liability for injury to personnel, and for loss or damage of equipment, shall be borne by the party employing such personnel and owning such equipment. 10. The cost of gasoline and other normal supplies used for mutual aid purposes shall be the responsibility of the party supplying such items, except that certain expendable supplies, such as flares, or other specialty products, will be replaced by the party requesting assistance. In addition, costs incurred for rescue and/or medical supplies used shall be billed to the respective beneficiaries (i.e. patients) of such supplies. Personnel working under the auspices of this Agreement shall be exempt from the definition of beneficiaries and/or patient and therefore, would not be billed for rescue and/or medical supplies . • 11. All compensation, except as otherwise stated in this Agreement, for personnel shall be borne by the entity by which they are employed at the time of the call and/or response. 12. This Agreement- shall continue in full force and effect for like terms as set up in the original term of this contract. Any party to this Agreement may, upon giving ninety (90) days written notice to the governing body of the other parties, terminate this Agreement and after the effective date of such • notice the parties will be relieved of any further obligations under this Agreement.
