Bradford, Village Manager /7 DATE: May 14, 1992 SUBJECT: Resolution No. 17-91/92 Northern Area Mutual Aid Consortium Emergency Police Services Mutual Aid Agreement; Agenda Item This matter was reviewed by the Public Safety Committee on May 13, which recommends its adoption by the Village Council . This will provide the Chief of Police and the Police Department with additional resources in the event of an emergency within the Village requiring outside assistance. Likewise, the Village can be called upon from time to time to aid other communities in similar types of s.Ltuations. This is an important matter of public safety for Tequesta citizens and is recommended .to be adopted by the Village Council . COUNCIL OF THE VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, APPROVING THE NORTHERN AREA MUTUAL AID CONSORTIUM EMERGENCY POLICE SERVICES MUTUAL AID AGREEMENT. WHEREAS, The Village of Tequesta currently maintains a quality police department with police equipment, police personnel, and trained technical personnel; and WHEREAS, it is envisioned where there may times of need for police services and/or emergencies where the need created may be tbo great for the Tequesta Police Department to deal with unassisted; and WHEREAS, in return for receipt of mutual aid in times of need, the Village of Tequesta recognizes the need to reciprocate by lending a hand when called upon and where feasible in the name of intergovernmental cooperation. NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, AS FOLLOWS: Section 1. The Village Council of the Village of Tequesta hereby approves the !Northern Area Mutual Aid Consortium Emergency Police Services Mutual Aid Agreement. Section 2. The Mayor is hereby authorized to execute the Agreement on behalf of the Village of Tequesta. THE FOREGOING RESOLUTION WAS OFFERED by Councilmember , who moved its adoption. On Tuesday, April 21 , 1992 , the final organizational meeting was held in Juno Beach by the involved chiefs of police , Palm Beach County School Board (Security) and some government officials . The attached draft copy of the contract was approved by vote and now needs to be adopted by resolution prior to May 29 , 1992 . A formal signing ceremony will be held June 3rd , 1992 at 2 : 00PM in the Juno Beach Town Hall by the mayors of each municipality. It was recommended that under definitions , COORDINATING COUNCIL, that someone be nominated to the position, prior to the signing on June 3rd , so the contract can take effect upon signing . I believe the members of the Public Safety Committee would be appropriate as the representative and alternate . ` f Revised 3/17/ • NORTHERN AREA MUTUAL AID CONSORTIUM N A M A C / POLICE Puipose : To provide an organized method of providing Police { Services and/or Emergency Mutual Aid Service to member jurisdictions. Scope: To invite . interested providers of Police and Emergency Services to meet and plan for the times when the resources of one jurisdiction cannot control an emergency/non emergency type situation. Definition: Mutual Aid/ Police - Assistance given to a neighboring me Eer jurisdiction at those times when police services and/or emergencies exceed the resources of one jurisdiction. This can relate to one large incident or multiple incidents occurrin at One time. This mutual aid, is to include, but not be limited to, emergencies listed under • Florida State Statute 252. 34( 2) . Coordinating Member jurisdictions shall appoint one Council ; representative and one alternate representative to the Coordinating Council. These representatives shall be elected officials or management personnel of the member jurisdiction. The Coordinating Council shall oversee and facilitate the operation of this consortium and from time to time inspect facilities and equipment to be used in this plan. The Coordinating Council shall elect a Chairman, Vice Chairman, and Secretary. The Coordinating Council shall meet no less than three times during • the first twelve months of this agreement, and no less than once every six months thereafter, at a time and place designated by the Chairman. Special meetings may be called by any member with majority consent. Council of The Chief Law Enforcement Officer of each . member Chiefs.: jurisdiction shall sit as a member of the Council of Chiefs. A member jurisdiction may also appoint an alternate to the Council of Chiefs. The Council of Chiefs shall operate NAMAC/Police and conduct drills/training within the system as deemed necessary. Council of Chiefs will maintain and exchange a current inventory of pertinent equipment and personnel expertise. The members of the Council of Chiefs shall elect a Chairman, Vice Chairman, and Secretary. The Council of Chiefs shall meet no less than two times during each year at a time and place designated by the Chairman. Special meetings of the Council of Chiefs may be called by any member of the Concil of Chiefs with majority consent. NORTHERN AREA MUTUAL AID CONSORTIUM EME. GENCY POLICE SERVICES MUTUAL AID AGREEMENT WHEREAS the parties to this Agreement presently maintain a Police Depa tment with police equipment, police personnel , and trained techtical personnel/ and WHEREAS it is deemed mutually advantageous to enter into this Agreem nt providing for mutual aid in times of need for police servi•es and/or emergencies where the need created may be too great fo any one party to deal with unassisted. NOW, TH REFORE, it is agreed by and between the parties that each will ender mutual aid assistance. And service to the other under the fo lowing stipulations, pzovlsions and conditions: 1 . Mutu. l aid and assistance, including, but not limited to, police resp4nse, and stand-by coverage, will be given when properly req•ested, subject to limitations set forth below. 2. The .erson requesting the mutual aid and assistance shall give the fol owing information at the time his request is made: a. The general nature, type and location of the police se -vice and/or emergency. b. The type of personnel and/or equipment needed. 3. Only the following officials of the participating parties are author zed to request aid and assistance under this Agreement: he respective Police Chiefs, and those designated by these Police Chiefs through their respective Department Policies and Procedure. 4. In the event of a law enforcement type situation or emergency o currence, which requires mutual aid assistance, the Police Chie of the jurisdiction in which the incident is located, or in his absence, the Assistant Police Chief or the Shift Super isor shall direct the activities at the scene where the emerge cy exists. As soon as practical , the agency requesting utual aid assistance shall facilitate the relief of assisting personnel. Discipline of personnel and other matters incidental o performance of services and control of personnel shall remai• within the respective control of their own agency. 5. Eac., participating party reserves the right to rofuse a mutual aid call in the event it does not have the required personnel/equipment available or if, in its judgement, compliance with the req est for mutual aid assistance would jeopardize the protection ••f its own jurisdiction. 6. No employee of any party to this Agreement shall be requested to perform any function or. service which is not allowed • within the .cope of the duties of the person within his/her own department. 7. Per .ona employed by any party shall not , in connection with this greement or in. the performance of services and functions p rauant hereto, claim any right to pension, worker' s compensation unemployment compensation, civil service, or other employee ri. hts or privileges granted by operation of law or • otherwise except through and against the entity by which they are employed at . he time of the call and/or response. 8. The parties to this Agreement and their respective personnel s all not be deemed to assume any liability for the act, omission, and negligence of the other party. Further, nothing her: in shall be construed as a waiver of sovereign immunity, pu .suant to Florida Statutes, Section 768: 28. 9. All •rivileges and immunities from liability, exemptions from law, ordinance , and rules and all pension and relief, disability, orker' s compensation and other benefits which apply to the activ ty of the personnel of either party when performing their respe.tive functions within the jurisdictional limits of their reape ive agencies shall apply . to the same degree and extent to he performance of such functions and duties requested , rsuant to this Agreement. Liability for injury to personnel , an for loss or damage of equipment, shall be borne by the party emp oying such personnel and owning such equipment. • 10. The oat of gasoline and other normal supplies used for mutual aid urposes shall be the responsibility of the party . supplying su •h items, except that certain expendable supplies, such as flare , or other specialty products, will be replaced by the party r questing assistance. 1n addition, costs incurred for rescue a d/or medical supplies used shall be billed to the respective b neficiaries ( i . e. patients) of such supplies. Personnel. wo king under the auspices of this Agreement shall be exempt from the definition of beneficiaries and/or patient and therefore, w. uld not be billed for rescue and/or medical supplies. • 11 . All compensation, except as otherwise stated in this Agreement, fnr personnel shall be borne by the entity by which they are employed at the time of the call and/or response. 12.. Thi. Agreement shall continue in full force and effect for like ter s as set up in the original term of this contract.
