Hall , Water System Manager " DATE: May 7 , 1992 SUBJECT: Bridge Crossings , Water Main Repair As you are aware , in this year ' s Water Department .Capital Improvement Program under Renewal and Replacement, funds have been allocated for the replacement of the water main piping on the Tequesta Drive Bridge and recoating of the water main on the AIA Bridge . The following amounts have been budgeted for these projects including $10 , 000 for associated engineering . On the Tequesta Drive Bridge Crossing, we have allocated $30 , 000 and for the AIA' Bridge Crossing, $45, 000 has been budgeted. Please find attached an engineering proposal from Reese , Macon & Associates for engineering services in connection with the above two projects in the amount of $8 , 900 . This proposal represents a figure which is $1 , 100 under our anticipated budget amount for engineering. To provide some additional background, the Tequesta Drive Water Main has been in service for over thirty (30) years and has deteriorated to a point where replacement is necessary due to severe corrosion. The steel pipe water main on the AIA Bridge is in much better condition due to the type of coatings and pipe construction. The AIA . line also has some areas of extensive corrosion which should have immediate attention. Further . investigation has revealed that the present coating on this pipe contains lead and will require special handling. I would like this to go before the Village Council for their approval at the next regularly scheduled Council Meeting in May. Once approved, we can move forward and make every attempt to have this work completed prior to October 1992 . Hall, Water System Manager ��E • RE: Tequesta Drive and Alternate AlA ` 5., ,�,.,;.o Pipeline Crossings Gentlemen:. We are pleased to submit this proposal for engineering services in connection with rehabilitation of the water pipeline crossing on Alternate AlA and Tequesta Drive. REESE, MACON and ASSOCIATES, INC., hereinafter referred to as the Engineer, shall perform the services as documented below for the Village of Tequesta, hereinafter • referred to as the Owner. SCOPE The following specific tasks will be performed by the Engineer: 1. Prepare specifications and plans (as necessary) for the surface preparation and recoating of the Alternate AlA water line crossing and the replacement and coating of the Tequesta Drive Crossing. For the Alternate AlA crossing, the procedure will include chemical stripping and capture of all lead based paints with subsequent sand blasting of primer coats and recoating with a zinc based product. The same coating system will be used for the new piping on the Tequesta Drive Crossing. 2. Secure DOT permit for performance of the work. 3. Provide an estimate of construction cost. 4. Assist the Owner in securing bids and review qualifications. Make a recommendation of award. 5. Administer the construction contract and make periodic site visits to confirm general progress. 6. It is assumed that the Owner will perform routine day-to-day inspection of the Contractor's work. If the Owner desires, the Engineer can provide this service. Alternately, if the Owner desires, the Engineer will share the duties with Owner's personnel in the interest of cost reduction. 3003 S. Hall Village of Tequesta April 13, 1992 The above scope is predicated on the assumption that the Client shall furnish, at no cost to the Engineer, all available pertinent information including previous reports, plans, specifications, permits and other data relevant to the performance of the above services for the project. • TIME OF PERFORMANCE The Engineer will commence work within 10 days of receipt of an executed authorization. FEES For Scope Items 1 - 5 the Engineer shall be paid a lump sum fee of eight thousand, nine hundred dollars ($8,900). For Scope Item 6 the Engineer shall be paid according to the following schedule on the basis of actual time spent plus any applicable sales tax and reimbursement for non-salary expenses including,but not limited to, automobile travel at $.30/mile, reproduction and long distance telephone. • Project Manager $65.00/HR. Senior Engineer $60.00/HR. Engineer/Sr. Technician $52.50/HR. Designer $45.00/HR. Draftsman $37.50/HR. Technician $35.00/HR. Secretary $25.00/HR. If services are required in the performance of the above scope, beyond those normally provided by the Engineer, which must be sublet, the Engineer shall order the work after obtaining the written authorization of the Client. The subcontractor shall bill the work directly to the Client. If the Engineer is requested to subcontract the work directly, a 10% handling charge will be added to the subcontractors invoice. Invoices for services rendered are issued on a monthly basis and are due within thirty._ (30) days of the invoice date. Interest at a compound rate of one and one-half percent per month shall be charged to any past due statements. Interest shall be computed on past due statements from the date of the invoice. ti PAGE 3 Thomas C. Hall Village of Tequesta April 13, 1992 INDEMNIFICATION In consideration of the unavailability of professional liability insurance,it is agreed that the Owner shall indemnify and hold harmless the Engineer, their consultants, agents, directors, officers and employees from and against all claims, damages, losses and expenses, direct and indirect, and consequential damages, including but not limited to fees and charges of attorneys and court and arbitration costs, arising out of or resulting from the performance of the work by the Engineer, or claims against the Engineer resulting from the work of others, involving pollution-related activities to the fullest extent permissible by; law, regardless of any action or omission (active, passive or comparative negligence included) on the part of the Engineer. The above indemnification provision extends to claims against the Engineer which arise out of, or related to, or based upon, the actual, alleged or threatened discharge, dispersal, release or escape of pollutants, and any directive to test for, monitor, cleanup, remove, contain, treat, detoxify or neutralize pollutants. "Pollutants" mean solid, liquid, gaseous or thermal irritant or contaminant, including smoke, vapor, soot, fumes, acids or alkalis, chemicals and waste. COST ESTIMATES Construction cost estimates are developed from knowledge of market conditions and based on the experience of the Engineer. However, the Engineer exercises no control over the competitive bidding process and, therefore, makes no guarantee of the accuracy of the estimate when compared to previous estimates or actual bids. TERMINATION This agreement may be terminated by either party by giving thirty (30) days written notice. The Engineer shall be paid for all services rendered prior to the termination date. PAGE 4 Thomas C. Flail Village of Tequesta April 13, 1992 ACCEPTANCE Acceptance of this proposal may be indicated by executing this document in the space provided below. This contract shall be considered void if not executed within thirty (30) days from the above date. Upon execution of this agreement the Client shall return one copy to the Engineer.
