Ladd, Building Official )U� DATE: December 12, 1991 SUBJECT: Application for Temporary Outdoor Event Circus at County Line Plaza Tom, per the requirements of the zoning regulations of the Village of Tequesta at Section X, Supplemental Regulations, Sub—section ( D> Outdoor Sales, copy of appropriate Section attached, it is my decision to submit this application for a two day circus within the parking lot at County Line Plaza to the Village Council for review and approval due to the possible sensitive nature of this request in the eves of Tequesta' s citizens and by virtue of the magnitude of such a request. • The applicants have assured us that they will provide whatever traffic and crowd control measures the Police Chief determines are necessary to meet public safety concerns; that they will obtain whatever Palm Beach County Public Health Unit approvals and permits may be required and that they will address any concerns or requirements that the Fire Marshals office may have. This type of request is not uncommon, and in fact the Gardens Mall recently allowed a circus of this nature to .occur at the west side of the Mall. As to the parking needs for this type of event, the applicant states that their maximum anticipated seating capacity per performance is 2000 therefore they require approximately 500 parking spaces per performance. County Line Plaza has 1127 parking spaces available. The Village Attorney could not be reached, regarding your question about insurance, in time for this memo, but should be able to address this concern prior to or at the Council meeting. [ • ( 1-) No garage sale, carport sale, yard sale, flea market, outdoor sale, or other similar activities shall be permitted in any t district without the issuance of a permit from the Building Official. There shall be no fee charged by the Village for the issuance of said permit, however, not more than two (2 ) permits shall be issued to any one ( 1 ) street address, property legal description, property owner,. or organization during any single calendar year. (2) Any person, organization, or corporation seeking a garage sale or outdoor sale permit shall first submit to the Building Official a sworn statement showing: (a) The name of the person, organization, or corporation sponsoring the sales activity. (b) What purpose the proceeds of said sale are to be used for. (c) The amount of commission, if any, that shall be paid by such persons, organization, or corporation to the person conducting said business, if applicable. ( d) Length of time which the sale shall extend. (e) The names of persons directing the sales activity. The Building Official may thereupon, at his discretion, grant or reject said application; withhold action on any application ` pending investigation; or submit the application to the Village Council for its approval. The Building Official shall ,be guided in the exercise of his discretion, and shall take into account that the issuance of a sales permit does not in rV any way sanction the creation of a nuisance. (3 ) Garage sales or yard sales in - residential districts are permitted only on Saturdays between the hours of 8:00 a.m. to 5 : 00 p.m. Such sales at any other time of day are hereby prohibited. Except as provided for in Subsection (C) ( 1 ) above, outdoor sales are prohibited within any commercial district within the Village. However, application may be made for outdoor sales by non profit organizations for special events. Said permit shall be issued as a matter of right if it is determined by the Building Official that the special event does not violate any of the terms of the Village of Tequesta Code of Ordinances. ( 4) All sale sites shall be left in a clean and orderly manner upon completion of said sales activities. (E) Swimming Pool Regulations. I am forwarding this letter as our formal request to present the Great American Circus to the families of Tequesta on January 14 & 15, 1992 at the ::County line Plaza. Showtimes are 5:00 and 8:00 p.m, with each show lasting just under two hours. Our circus is an old fashioned, three ring circus under the big top with fun for the entire family. We have no games of chance, no mechanical . rides, and sell no alcohol. We are': the second largest under the big top that travels the. Eastern United States performing for over three hundred cities, travelling through an average of twenty two states annually. We. are the official. host of the P. T. Barnum Festival in'Bridgeport, Connecticut every year and have been featured on " Good Morning America " and in television commercials for the Mitsubishi Motor Corporation. We are working on a reputable, charitable organization to benefit from the appearances of the circus, but have not yet determined who the recipient is. If you should have any suggestions as to a local needy group, we would appreciate your guidance and suggestions. . Being so far away, we have deemed Cindy Masterson to be our agent in the Tequesta area, and she is permitted to sign documents on our behalf. The staff was available to us at all times with helpful suggestions on how to promote the shows, sell tickets, advertise, etc. The show, sponsored under the auspices of the Bellingham Athletic Booster Club, was of excellent quality. The staff was extremely knowledgeable, courteous, and professional. Through their expertise the show was a great success from all points of view, and we look forward to having them back next year. The show was held on our Athletic Field and there was no damage. The cleanup was so thorough that you could not tell that a circus had been there.
