The Village of Tequesta Zoning Board of Adjustment held a regularly scheduled Public Hearing at the Village Hall, 357 • Tequesta Drive, Tequesta, Florida, on Monday, September 16, 1991. The meeting was called to order at 7 : 30 P.M. by Chairman William Kirkland. A roll call was taken by Fran Bitters, the Recording Secretary. Boardmembers present were: Chairman Kirkland, Kenneth Northamer, Vice Chairman James Van Wagner, Alfred DeMott and John Turner. Scott D. Ladd, Clerk of the Board and John C. Randolph, Village Attorney were also in attendance. II. APPROVAL OF AGENDA Boardmember Van Wagner moved to approve the Agenda as submitted. Boardmember Turner seconded that motion. The vote on the motion was: - Alfred DeMott - for Kenneth Northamer - for James Van Wagner for John Turner - for William Kirkland - for the motion was therefore passed and adopted and the Agenda was approved as submitted. Zoning Board of Adjustment Meeting Minutes September 16, 1991 Page 2 III. APPROVAL OF PREVIOUS MEETING MINUTES (Zoning Board of Adjustment Meeting Minutes, August 19, 1991) . Boardmember Van Wagner moved to approve the above-referenced Minutes as submitted. Boardmember Turner seconded that motion. The vote on the motion was: Alfred DeMott - for Kenneth Northamer - for James Van Wagner - for William Kirkland - for John Turner - for the motion was therefore passed and adopted. IV. NEW BUSINESS 1. The application of Joanne Pafford and Peter Pallatto, owners of Lot 113, Tequesta Pines Subdivision, located at 37 cedar Hill Lane, requesting a variance to the terms of the Official Comprehensive Zoning Ordinance of the Village of Tequesta, Ordinance No. 355, as amended, Section X, Supplemental Regulations, Subsection (A) , Paragraph (1) , Miscellaneous' Structures, Sub-Paragraph (c) , Walls and Fences, to allow the addition of a three . (3' ) foot high trellis to the top of an existing six (6 1 ) foot high fence, in lieu of no wall or fence being erected with a height exceeding. six (61 ) feet, as required by the Zoning Ordinance. Joanne Pafford and Peter Pallatto were in attendance. Mr. Pallatto presented to the Board color photographs of the area where he desired to place a trellis on the back of his property which backs up to a drainage canal. He further explained that though the existing fence is six feet high, in some areas it looks lower because of the sloping of the land. Should the variance be granted, the total height would be seven feet high. Ms. Pafford explained that a hedge used to exist there, but past freezes have killed the hedge, and further stated that neighbors who had been consulted did not object to the trellis. Zoning Board of Adjustment Meeting Minutes September 16, 1991 Page 3 Scott Ladd stated there were no communications from surrounding neighbors in the file regarding this case. Boardmember Turner moved to approve the variance as requested. Boardmember DeMott seconded the motion. Attorney Randolph suggested that the motion be amended to indicate the approval is for the trellis as it is and not to be enclosed any further, nor made a solid structure, at any future date. Boardmember Turner amended the motion accordingly. Boardmember DeMott seconded the amended motion. The vote on the motion was: Alfred DeMott - for Kenneth Northamer - for James Van Wagner - for William Kirkland - for John Turner - for the motion was therefore passed and adopted. 2. The application of Douglas R. Girvin, owner of Lot 22, Block 2, Jupiter In The Pines Section ""C"", located at 312 Tequesta Drive, requesting a variance to the terms of the Official Comprehensive Zoning Ordinance of the Village of Tequesta, Ordinance No. 355, as amended, Section VII, Schedule of Regulations and Application of Regulations, Subsection (C) , Schedule of Site Regulations, C-2 District, minimum front yard setback, to allow for a front yard setback of fifteen (151 ) in lieu of twenty- five (251 ) feet as required by the Zoning Ordinance. Douglas Girvin was in attendance and presented to the Board two photocopied sheets showing the portion of the Lot which was taken in a condemnation proceeding for the widening of Tequesta Drive. Mr. Girvin explained that at the time of Site Plan Approval on the above-referenced lot, the lot was zoned C-1, with a front setback of 15 feet. In the interim, Tequesta has unilaterally re-zoned the property to C-2 which requires a front setback of 25 feet. A condemnation proceeding, instituted by the Village of Tequesta to widen Tequesta Drive took an additional five foot portion of Lot 22. As a result of that and the shape of the lot, the property owners find that the front setback requirement of 25 feet will Zoning Board of Adjustment Meeting Minutes September 16, 1991 Page 4 not permit the erection of the sort of building desired by the property owners. The present request is that the Board consider going back to the original front setback which originally applied to the property (15 foot setback) . Boardmember Northamer moved to approve the application as submitted. Boardmember DeMott seconded the motion. The vote on the motion was: Alfred DeMott - for Kenneth Northamer - for James Van Wagner - for William Kirkland - for John Turner - for the motion was therefore passed and adopted. 3. The application of Gene Wehage, as agent for John Estes, owner of property located at 148 Gulfstream Drive, Property Control No. 60-42-40-25-00-002-0040, requesting a variance to the terms of the Official Comprehensive Zoning Ordinance of the Village of Tequesta, Ordinance No. 355, as amended, Section XVI, Uniform Waterway Control, Subsection (B) , Dock and Pier Length, Width and Configuration, Paragraphs (1) and (7) , to allow the construction of a 4' x 107' pier with a 6' x 20' "L" shaped terminal platform, 548 square feet in area, in lieu of no dock or pier being constructed which extends waterward from the mean high water line in excess of seventy-five feet (751 ) , and the total area of all docks and piers located on any riparian parcel not to exceed five hundred (500) square feet for each one hundred (100) linear feet of that parcel shoreline, as required by the Zoning Ordinance. Gene Wehage was in attendance and explained that the 107 ' request was because the Department of Natural Resources (DNR) requires certain water depths. Mr. Wehage stated he had heard no objections from surrounding neighbors. Scott Ladd explained that this does meet the required setback of 25 feet. ADJOURNMENT Boardmember DeMott moved that the meeting be adjourned. Boardmember Van Wagner seconded that motion. The vote on the motion was: Alfred DeMott - for Kenneth Northamer - for James Van Wagner - for William Kirkland - for John Turner - for the motion was therefore passed and adopted.
