Bradford, Village Manager / / DATE: November 14, 1991 SUBJECT: Well 25, 26 and 27 Project; Raw Water Main Easement; Agenda Item As you know, the Village plans to loop the raw water main from Wells 25, 26 and 27 by way of a northern route through southern Martin County just north of the entrance to Heritage Oaks, thereafter, generally following the County Line Road route ,to the water treatment plant. This route will necessitate an easement from The State of Florida Department of Natural Resources and the Boy Scouts, in order for our raw water main to traverse their land. The attached correspondence from the Village Attorney' s office indicates that the requirements for considering the granting of an easement from the State of Florida are: O A resolution passed by the municipality O An appraisal of the value of the easement O Payment of a fee equal to the value of the easement, subject to possible state waiver. The attached resolution states that the easement is necessary for public potable water users, describes the easement needed and authorizes Village Staff to engage appraisers and to acquire the ; lands necessary. It is recommended that the Village Council adopt Resolution No. 1- 91/92. TGB/krb Recycled Paper RESOLUTION NO. 1-91/92 A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, AUTHORIZING THE ACQUISITION OF CERTAIN EASEMENT RIGHTS FOR LOCATION OF UNDERGROUND UTILITIES ON LANDS LOCATED IN MARTIN COUNTY, FLORIDA. WHEREAS, the Village Council of the Village of Tequesta deems it necessary to secure certain utility easement rights for the location of a water main for the provision of potable water for users of the Village of Tequesta Water System; NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL of the Village of Tequesta, Florida, as follows: Section 1. The Village Council of the Village of Tequesta hereby determines that it is necessary to acquire easement rights to certain lands in Martin County, Florida, for the purpose of providing potable water to users of the Village of Tequesta Water Utility System. The land necessary to be acquired is more particularly described in the attached Exhibit "A" . Section 2. The Village Council of the Village of Tequesta hereby adopts the description of the easement to be acquired on Exhibit "A" attached. Section 3. The Village Council of the Village of Tequesta hereby authorizes and instructs the Village Attorney and such other Village Officials and employees to take such actions as are needed, including the engagement of appraisers, to acquire by donation or purchase, easement rights to the above- described land for public purpose as set forth above. Section 4. This resolution shall take effect immediately upon its adoption. THE FOREGOING RESOLUTION WAS OFFERED by Councilmember who moved its adoption. The Resolution was seconded by Councilmember , and upon being put to a vote, the vote was as follows: FOR ADOPTION AGAINST ADOPTION The Mayor thereupon declared the Resolution duly passed and adopted this day of , A.D. , 1991. Box 3474 OFFICE Tequesta, Florida 33468-0474 NORe: Village of Tequesta - Wells Matter 9 Our File No: 13153.10 Dear Tom: Enclosed please find a copy of a proposed Resolution setting forth the Village's 'requirement of and intent to acquire an easement over property owned by the Florida State Department of Natural Resources. The Department of Natural Resources requires that such a resolution be passed by a municipality seeking to acquire an easement over its property. It further requires that the party seeking the easement commit to pay for an appraisal establishing the value of the easement and pay as a fee the value of the easement. The state may waive the fee requirement if the easement is to be used for the good of the public. I believe that any decision in this regard will be made after we have submitted the application for the easement. I spoke with our appraiser regarding the appraisal of the other three parcels to be acquired for the water wells and associated easements.
