Dear Don:
I have reviewed the exceptions to title policy which have been
provided in regard to the above referenced matter. Please be
advised that we would request the following exceptions under
Schedule C to be deleted from the final policy.
1. As to Parcels 1 and 2, we would request that Items 1, 2 and 3
under Schedule C be deleted as they do not appear to be
applicable to the subject properties.
2. As to all Parcels 1 through 12, we would request that Items 5
and 10, be deleted as they do not appear to apply to the
properties.

3. We would request that Items 12 and 13, the standard
exceptions, be deleted.
4. As to Item 14, it is my understanding that all mortgages
listed under Schedule C at Item 14 will join in the
conveyance.

Thank you for your letter of May 3, 1991. I am investigating the
matters outlined in your letter numbered 1 and 2 since the items
referenced in the proposed policy were items picked up on prior
policies issued by the Fund for the lots in question.
As to your Item 3, that we delete Items 12 and 13, that will be no
problem in the final policy.
As to your Item 4, referring to Item 14 on the title policy, it is
my hope that all mortgagees listed under Schedule "C" will join in
the conveyance. In order to save time, I have listed them as
exceptions to be deleted as approval is obtained. All letters have
been written to mortgagees, in the form which is attached hereto
for your information. I drafted the letter so that each unit owner
could make the request of their own mortgagee. I will do the follow
up work and hopefully all will be. deleted as exceptions. •
Finally, I did speak with an attorney at the Fund to get an idea as
to how to compute the value of the insurance to the Village. He
indicated to me that we may wish to take the valuation of each
individual lot, do a mathematical computation as to the value of
the overall lots times a fraction the numeration of which would be
the number of square feet being deeded ' to the Village and the
denominator of which would be the total square feet of the parcels.
If that is agreeable, I will do the computation and' provide an
amount of insurance based on that number. If that is agreeable,
please feel free just to give me a call, and I will work up the
numbers and send them to you in a separate correspondence.

Re: Request to execute Mortgagee's Quit Claim Deed
Dear :
This letter comes to request your assistance in executing the
enclosed "Quit Claim Deed of Mortgagee" and returning it in the
enclosed self-addressed, stamped envelope. We currently have a
mortgage with your institution, Loan No.
We are in the process of working with all of our neighbors and
the Village of Tequesta to deed over to the Village certain small
parcels of our lot for the purpose of creating a road right-a-way
and/or utility easement.
Enclosed, for your information, is a copy of the letter from
Mr. John C. Randall, attorney for the Village of Tequesta, who has
indicated his approval of the basic documents. As you can see, the
purpose of deeding over these parcels of property and for
requesting you to quit claim your interest as mortgagee in that
small piece is to allow the Village of Tequesta to bring up to
standard our existing road, and maintain it in perpetuity. The
Village's maintenance of our roadway will enhance the value of the
property, hence, you can see that your interest as mortgagee will
be is enhanced by your participation.
Once the Quit Claim Deed is executed, I would appreciate your
returning it to the following address:

Dear Skip: •
I have completed the computation as we have previously
discussed for purposes of ordering title insurance. I have taken
the number of square feet for each parcel being deeded, divided by
the total square feet of each parcel and multiplied that fraction
times the assessed value of each lot. To the sum of those amounts,
I have added $20,000.00 (the value of the road improvements) . The
total value of the property being deeded to the village, including
the $20,000.00 amount for road improvements is $115,618.00, which
I have rounded to $116,000.00.
If you have any questions regarding the computation, I will be
glad to furnish my worksheets. I am still awaiting the return of
the right-of-way deed and easement documents from the homeowners.
Upon receipt, I will furnish them to you so that we can obtain
signatures from the Village.

Please find enclose the fully executed Right-of-Way Warranty
Deed, Non-Disturbance Agreement, and Easement Agreement, together
with the Title Commitment in the amount of $116,000. At long last,
it appears that we have succeeded in completing our portion of this
matter.
As you can see, I have listed the applicable mortgagees
interests as exceptions in the title policy, but will work
conscientiously to have them deleted over time. One. has already
been deleted, that for Mr. & Mrs. Hayward by virtue of the Quit
Claim of Mortgagee, a copy of which is attached for your
information. One of the mortgagees which appeared on the original
proposed commitment have been paid off, so there are not too many
with which to deal. We will be following up with the remaining
mortgagees to ensure their cooperation.
I would appreciate your letting me know when this matter will
come before the Village Council and anything which 'I may need to
do in preparation for that occasion. I do thank you and appreciate
your help in moving this matter forward.

EASEMENT AGREEMENT
This Agreement, made and entered into by and between the
following parties:
JOHN P. RODERICK and KATHERINE M. RODERICK, his wife, (as to
Parcels 1 & 2 "B" and 3 "C", as hereinafter_described) ,
and
CONRAD T. MILLER and NELLIE M. MILLER, his wife, (as to Parcel
4"D", as hereinafter described) , and

all of which are collectively referred to hereinafter as
"Grantors", and the Incorporated Village of Tequesta, a municipal

made subject to an easement over, under and across the property

Village of Tequesta, for drainage and public utility purposes.
2. The easement rights and privileges herein granted shall
be perpetual, but shall terminate when, or at such time as, the
purposes hereof cease to exist, or are abandoned by Grantee, or
become impossible of performance.
3. Grantors hereby bind themselves, their heirs, and legal
representatives, to warrant and forever defend the above described
easement and rights unto Grantee.
4. The easement rights, and privileges granted herein are
non-exclusive, and Grantors, their successors and/or assigns,
reserve and retain the right to convey similar rights and
easements, not inconsistent with the purpose of the easement
granted herein, to such other persons as Grantors, or any of them,
may deem proper.
5. This instrument shall be binding on, and shall inure to
the benefit of, the heirs, executors, administrators, successors,
and assigns of the parties hereto.
6. Grantors also retain, reserve, and shall continue to
enjoy use of the property for any and all purposes which do not
interfere with and prevent its use by Grantee.
