CALL TO ORDER AND ROLL CALL The Village of Tequesta Zoning Board of Adjustment held a regularly scheduled Public Hearing at the Village Hall, 357 Tequesta Drive, Tequesta, Florida, on Monday, August 19, 1991. The meeting was called to order at 7': 30 P.M. by Vice Chairman Van Wagner. A roll call was taken by Fran Bitters, the Recording Secretary. Boardmembers present were: Robert Freimark, Kenneth Northamer, Vice Chairman James Van Wagner, Alfred DeMott and Edwin Nelson. Chairman William Kirkland was not in attendance. John Turner arrived at 7: 33 p.m. , at which point Alternate Robert Freimark stepped down to allow Mr. Turner to sit on the Board. Scott D. Ladd, Clerk of the Board and John C. Randolph, Village Attorney were also in attendance. l II.. APPROVAL OF AGENDA Boardmember Turner moved to approve the Agenda as submitted. Boardmember DeMott seconded that motion. The vote ,on the motion was: Alfred DeMott - for Kenneth Northamer - for James Van Wagner for Edwin Nelson - for John Turner - for the motion was therefore passed and adopted. J , Zoning Board of Adjustment Meeting Minutes August 19, 1991 Page 2 III. APPROVAL OF PREVIOUS MEETING MINUTES (Zoning Board of Adjustment Meeting Minutes, July 15, 1991) . Boardmember Turner moved to approve the above-referenced Minutes as submitted. Boardmember DeMott seconded that motion. The vote on the motion was: Alfred DeMott - for Kenneth Northamer - for James Van Wagner - for Edwin Nelson - for John Turner - for the motion was therefore passed and adopted. IV. NEW BUSINESS 1. The application of The Reverend Thomas Vengayil, Administrator, St. Jude's Parish, on behalf of J. Keith Symons, Bishop of the Diocese of Palm Beach, owner of St. Jude' s Catholic Church, located at 204 U.S. Highway One, North, requesting a variance to the terms of the Official Comprehensive Zoning Ordinance of the Village of Tequesta, Ordinance No. 355, as amended, Section VIII, Subsections (B) , (C) , (D) , (E) , (F) , and (H) (7) , to allow the construction of a new church sanctuary with a separate bulding for church offices and with the phasing of the required parking in two` (2) phases, Phase I to include 200 parking spaces, and Phase II to add an additional 240 parking spaces to be completed within five (5) years after the date of issuance of a "Certificate of Occupancy" for the new sanctuary and offices, in lieu of all of the required parking being provided prior to the issuance of a "Certificate of Occupancy", as required by the Zoning Ordinance. Zoning Board of Adjustment Meeting Minutes August 19, 1991 Page 3 Bill Shannon, representative for St. Jude's Church, and Jim Howell, architect, were in attendance for the above-referenced case. Mr. Shannon explained that the application is for a temporary variance, since the Church is requesting that certain provisions of the Zoning Code, with respect to parking, lighting for exterior parking, and landscape for parking lots be temporarily postponed. A drawing and an overhead projection were displayed of the overall plan. The present request for variance is only for the west parking lot. There are presently a little more than 300 parking spaces. The proposed plan will have a total of 440 parking spaces. The west parking lot requirements, under Village Code, require certain interior landscaping, hard surfaces, and lights. The application for temporary variance requests the opportunity to build this facility with the following exception: Surface with Bahia grass with a stabilized sub-surface of geo-webb or something comparable, install parking bumpers but avoiding hard surface driveways, avoid interior landscaping and lighting, on a temporary basis. The proposed connection to Village Boulevard will be completed in Phase I. Denial of this request would cause the further postponement of the construction of the new church because of lack of funds. Postponement of the new church would be detrimental to the overall community - the construction of it would not only be a boost for the community but would make a statement for Tequesta. The new construction is expected to commence directly after Village approval, with a hopeful target date of completion by Christmas, 1992. Phase II to add an additional 240 parking spaces to be completed within five (5) years after the date of issuance of a "Certificate of Occupancy" for the new sanctuary and offices would be subject to approval by the Village. Boardmember Turner moved to approve the variance as requested. Boardmember Northamer seconded the motion. Attorney Randolph asked 'if the Church would be willing to enter into a recordable ,Agreement with the Village regarding the requirement for future improvements within five years. Zoning Board of Adjustment Meeting Minutes August 19, 1991 Page 4 Boardmember Turner amended his motion accordingly to reflect the agreement of applicant to enter into a recordable Agreement with the Village. Boardmember Northermer seconded the amended motion. The vote on the motion was: Alfred DeMott - for Kenneth Northamer - for James Van Wagner - for Edwin Nelson - for John Turner - for the motion was therefore passed and adopted. Mr. Shannon agreed to be responsible for drawing up the Agreement. 2. The application of- Sandra (Ray) Starowesky, owner of Lot 78, Ridgewood Homes Subdivision, located at 68 Camelia Circle, requesting a variance to the terms of, the official Comprehensive Zoning Ordinance of the Village of Tequesta, Ordinance No. 355, as amended, Section VII, Schedule of Regulations and Application of Regulations, Subsection (C) , Schedule of Site Regulations, R-1 District, minimum side yard setback, to allow the continued use of an existing wood framed structure with a side yard setback of zero feet (0' ) , in lieu of 7.51 (feet) as required by the Zoning Ordinance, and Section X, Supplemental Regulations, Subsection (A) , Paragraph (1) , Miscellaneous Structures, Sub-Paragraph (c) , Walls and fences, to allow the continued use of an existing concrete block with stone veneer wall forward of the front building line, in lieu of no wall or fence shall extend forward of the front building line on any lot or parcel, as required by the Zoning Ordinance. Mrs. Starowesky explained that the planter (wall) was built by her son, without she or her son realizing a Permit was needed to do so. The woodframe structure on the other side r of the house, which was cited, was constructed approximately three years ago, also without awareness that a Permit was needed. Mrs. Starowesky apologized for her lack of awareness concerning the legalities of the structure, and asked the Board's mercy under the circumstances. Zoning Board of Adjustment Meeting Minutes August 19, 1991 Page 5 Boardmember Northamer explained he had driven by the property and found neither the wall structure nor the woodframe structure to be a detriment to the surrounding community nor the property itself. Boardmember DeMott moved the approve the application as submitted. Boardmember Nelson seconded the motion. The vote on the motion was: Alfred DeMott - for Kenneth Northamer - for James Van Wagner - for Edwin Nelson - for John Turner - for the motion was therefore passed and adopted. V. UNFINISHED BUSINESS There was no unfinished business. VI. ANY OTHER MATTERS There were no other matters before the Board. Zoning Board of Adjustment Meeting Minutes August 19, 1991 Page 6 VII. ADJOURNMENT Boardmember Northamer moved that the meeting be adjourned. Boardmember DeMott seconded that motion. The vote on the motion was: Alfred DeMott - for Kenneth Northamer - for James Van Wagner - for Edwin Nelson - for John Turner - for the motion was therefore passed and adopted.
