Fer the requirements of the Special Exception use Section of the
Zoning Code, I hereby submit my recommendation to the Village Council
with regard to the above subiect petitions as follows:
1. As to St. Jude' s Catholic Church:
A. A necessary variance as to the Phasing of certain parking
requirements was granted on August 19, 1991. Copy of approval
letter attached.
B. The height of the proposed 110' high cross on top of the
proposed new church building is in contravention of the.
proposed requirements of the Mixed-Use Ordinance currently
Under review by the Village and, therefore, may he determined
to be in contravention of the current state of "zoning in
progress" in the area where St. Jude' s is located. Copy of
proposed M-U Ordinance section attached.
C. The applicant is in the process of obtaining review and
approval from the Department of the Interior and DERM in order
to remove certain trees and undergrowth on the property. Anv
approval by Council should be subject to the applicant
receiving the approvals from these agencies prior to the
issuance of a C. O. for the proposed project.

2. As to the Exxon Service Station and Car Wash:
A. This project meets all special exception requirements and
other Village regulations with the exception of the Landscape
Code. A landscape waiver request has been submitted as part
of the site plan review package.
Each special exception request is in order and therefore, should be
considered for review and approval by the Village Council .

This letter is to confirm the action of the Village of
Tequesta Zoning Board of Adjustment at their August 19, 1991
Public Hearing granting approval of the above referenced
application for a variance to the terms of the Official
Comprehensive Zoning Ordinance of the Village of Tequesta, as
follows:
Section VI I I, Subsections ( B) , ( C) , ( D) , ( E) , ( F) , and
( H) ( 7) , to allow the construction of a new church
sanctuary with a separate building for church offices
and with the phasing of the required parking in two ( 2)
phases, Phase I to include 200 parking spaces, and Phase
II to add an additional 240 parking spaces to be
completed within five ( 5) years after the date of
issuance of a "Certificate of Occupancy" for the new
sanctuary and offices, in lieu of all of the required
parking being provided prior to the issuance of a
"Certificate of Occupancy", as required by the Zoning
Ordinance.
This approval is subject to the recording of an
agreement, acceptable to the Village Attorney, regarding
full compliance with the Zoning Code within five ( 5)
years of the date of the issuance of a Certificate of
Occupancy, as stipulated above.
c. Lot conglomeration shall be permitted; Property Development Standards
applicable to a single lot shall also apply to a land parcel formed by
conglomeration of lots; conglomeration of lots shall be restricted by maximum
buildin frontage. 7
5. Building Height:

a. mate buildings may not exceed five stories or a maximum of 70 feet above
average finish grade excluding spires, cupolas, monuments, flagpoles, and
chimneys which may not exceed 84 feet.
6. Building Uses:
a. All uses shall be conducted in enclosed buildings, except by special exception.
b. Buildings shall locate the main access to the street, the square or the plaza. A
secondary access or a fire escape is allowed in the rear or as specified herein.
7. Building Placement:
a. Buildings may be set back a maximum of 12 feet from the public right of way.No
building shall be placed at a distance greater than 62 feet from the centerline of
the public right-of-way.
8. Outbuildings:
a. Outbuildings arc permitted but must be located at the rear of the lots.
b. Outbuildings are permitted only on lots with a minimum length of 4.5 rods (74.25
feet).
c. Outbuildings shall not exceed 424 square feet of footprint or 1/4 of the yard area,
whichever is smaller.
d. Outbuildings may be used as garages, business services, rental apartment, or
multiple-family dwellings only.
e. Outbuildings shall not exceed two stories or 32 feet in height.
f. Outbuildings shall require no setbacks (0 feet) from rear or side lot lines.
9. Parking:
a. Parking lots shall be located at the rear or at the side of the lots. Garages shall
be located at the rear of the lot.
b. ,Adjacent parking lots shall have vehicular connections.
c. All parking lots shall be screened from the street with a wall that is at least 50%
opaque, a traditional picket fence or a hedge, on the frontage and rear lot lines,
and with a minimum height of 4 feet or 2 feet at time of planting.
d. On-street parking, along the frontage line of a lot,shall be added to its parking
requirements.

approving St. Jude' s application as submitted for the demolition
of the existing church and church offices, and the construction of
a new church and church office.
As you are aware, this proposed project must go before
the Village Counoil for Special Exception public hearing and • f or
Site Plan Review, Landscape Waiver request, and land clearing
( tree removal ) review and approval . Before • these reviews are
scheduled, you must first receive a variance from the Zoning Board
of Adjustment. The Zoning Board of Adjustment public hearing has
been scheduled for Monday, August 19, 1991, beginning at 7: 30 P. M.
in the Village Hall, 357 Tequesta Drive, Tequesta. You and/or

Construction of a new 24, 200 square foot main church and a
new 2100 square foot administration building.
Tom, The C. A. B. reviewed the above referenced project on July 24,
1991.
The following concerns were expressed by the Board regarding this
proposed project:
1. Board Member Dalack commented that the building style is
like nothing else in Tequesta.
2. Chairman Cook stated that she had problems with the west
•
side parking area.
Motion to approve the proposed project as submitted.
Vote on the motion: 3-1 to approve, with Member Dalack voting against
the motion.
Additional Board comments: None
Building Official comments: The total height above finish grade of .
the proposed new church building with the proposed cross is 110' and •
at this height will require a red beacon light attached to the top of
the cross.

I. CALL TO ORDER AND ROLL CALL
The Tequesta Community Appearance Board held a regularly
scheduled meeting at the Village Hall, 357 Tequesta Drive,
Tequesta, Florida, on Wednesday, July 24, 1991. The meeting
was called to order by Chairwoman Leslie Cook at 9 : 40 A.M.
Community Appearance Board members present were: Vice
Chairman Paul Coben, Claudette Dalack, and Victor Strahan.
Scott Ladd, Clerk of the Board was also in attendance.
II. APPROVAL OF AGENDA
Scott Ladd, Clerk of the Board, stated he needed to present
to the Board, under Item VI, ANY OTHER MATTERS, pictures taken
by Boardmember Ruth Maitland. Chairwoman Cook stated she had
an item to present under ANY OTHER MATTERS.
The Agenda was approved as amended. •

IV. NEW BUSINESS
A) An application from Francisco Galego, owner of Verner's
Danish Pastry Shop and Cafe Copenhagen, 287 U.S. Highway
One, South, Tequesta, for a 241 x 9 ' rear addition with
extended sidewalk and landscape strip to match existing.
Mr. Galego explained there are two existing walk-in coolers
inside, and the desire is to move them outside, with a stucco
exterior, conforming with the present building. The proposed
landscaping includes Sea Grape, Areca Palms, and one large
Cabbage Palm. Chairwoman Cook suggested the use of one more
Cabbage Palm to the row, possibly at the end.
Paul Coben moved that the application be approved, with the
understanding that the landscaping be upgraded to include at
least one more tree. Claudette Dalack seconded the motion.
The vote on the motion was:

Victor Strahan - for
Leslie Cook - for
the motion was therefore passed and adopted.
B) An application for the Village of Tequesta for
improvements to Tequesta Park.
Village Manager Tom Bradford, and Brett Nein, Landscape
Architect of Gee and Jensen, were in attendance in
representation of Tequesta Park. The reason for this
presentation to the Community Appearance Board, since the park
is located in Martin County, is because the Village is
applying for a Department of Natural Resources Florida
Recreation Assistance Program Grant for FY 91-92 . The Village
must, in order to meet the requirements of the Florida Grant
Program, (which is a 50/50 matching Grant Program) :
1) Have a Public Opinion Survey done, (as accomplished in the
last Village Newsletter) . Responses, to date, are
approximately 2-1 in favor of the park improvements.
2) Hold a Public Hearing, which was held on July 18, 1991.

3) Advisory Board Review. Today 's presentation before the
Community Appearance Board is done to meet that requirement.
4) Site Plans and Cost Estimates must be done. This function
is provided by Gee & Jensen of whom Brett Nein is a
representative.
The main goal of the project is to put state-of-the-art
lighting on the ballfield, and the paving of the shell rock
parking lot. Chairwoman Cook felt the parking lot should not
be paved - that it would be more aesthetic left natural. She
felt paving the parking lot would be a step backward instead
of forward. Paul Coben felt the grading could merely be
improved as opposed to paving. Claudette Dalack suggested
some re-thinking be done regarding paving the parking lot.
Mr. Nein explained that the key reason for the parking lot
being paved was to solve the drainage problem there.
Victor Strahan asked what sort of tenure there was on the
park. Mr. Bradford explained that Tequesta has a 50-year
lease on the park, with 35 years left on the lease. The land
itself is owned by the State of Florida. Mr. Strahan agreed
that asphalt on the parking lot would destroy the natural look
of the park. Scott Ladd stated an alternative option would
be a combination of asphalt aisle ways, the heaviest traffic
area, then paver block the parking areas, which would
eliminate the retention ponds. The Board felt :that was a
better suggestion than paving the entire parking area. Mr.
Nein explained that could be a more expensive process. He
reminded the Board that the requirement is that an equal
amount be spent on direct recreational improvements as is
spent on accessory improvements. The parking lot is
considered an accessory.
Mr. Bradford explained to the Board that the parking lot, in
its present state, is not helping the park at all. The runoff ' •
from the shellrock floods the Tot Lot because there is no
drainage control. Also, the shellrock (the lime) changes the
acid balance of the soil and serves to kill trees and other
plant life in and around the parking lot. Under the proposed
upgrade, the runoff would be controlled, sent to retention
ponds, and percolated back into the ground. Brett Nein
further explained that the parking lot is presently
substandard compared to Tequesta and Martin County standards.

Mr. Bradford stated that it is clear that the parking lot
needs to be improved. If the Village presents to DNR the idea
of putting in high-tech paver block, possibly costing 50% more
than what was initially proposed, it is possible that DNR will
kill the deal . The Board recommended that the grant and
proposals be sought, but that further engineering analyses be
done to determine if in the total grant dollar amount, we
could re-do the parking lot in a manner that would involve
part paver block, to accomplish the same goal of improving the
parking, but not to alter the character and appearance of the
parking lot.
Paul Coben moved that the Community Appearance Board go on
record as being in favor of the improvements to the lighting
of Tequesta Park, and further that the Village pursue a means
to improve the parking area with an alternative to asphalt
which would accomplish the major objective of improved
drainage and in keeping with the character of the Park, if
possible. Victor Strahan seconded the motion. The vote on
the motion was:

the motion therefore passed and was adopted.
Chairwoman Cook reiterated that she was definitely against any
vegetation being lost and against clearing any more trees to
install a soccer field.
C) An application from St. Jude's Catholic Church, 204 U.S.
Highway One, North, William Shannon as agent, for
demolition of the existing church and church offices, and
construction of a new church and church office.

Jim Howell and Mark Ugowski, of Dow, Howell , Gilmore Assoc. ,
of West Palm Beach, architects, were in attendance as
representatives of St. Jude' s Catholic Church. They displayed
Drawings and a Site Plan for the, proposed expansion of the
church. The application was for building a facility to seat
1200 people, and an administrative building, while retaining
the existing Parish Hall. A covered plaza would connect the
church, the Parish Hall and the administration building.
Point of entry would be off U.S. Highway One, with Village
Boulevard as a second entrance/exit. The U.S. One entrance
has, been revised to align with the existing curb cut. As
persons drive in, immediate parking and/or drop off are
available, with a continuous loop clockwise around the site
for smooth traffic flow. All aisle 'drives will be paved. All
parking areas will be grassed and landscaped.
Because of cost constraints, the project will be phased.
Phase I: The east parking area will be grassed parking spaces
with asphalt aisles. The west parking area will be grassed„
parking spaces and aisles, retention swale and perimeter
landscaping. Paved aisles, parking area landscaping and site
lighting will be installed in Phase II.
Phase II: There will be covered walkways and raised planters
installed, along with completing the west parking area with
paved aisles, curbed radius planters, irrigation system, full
landscaping of parking area and site lighting installed.
Phase III: Covering for the Shrine will be deferred to a
future date.

There will be a large, faceted stainedglassindow
blues, greens and reds, at the main entrance of the church
from the court yard area on the west side, which in daytime
hours will be unlit, but lighted at night. The outside of the • .
building will be banded stucco. Trees will have to be removed
from the site - 106 from the main sanctuary area and 72 from
the eco-site - to allow for the roadway at the west end of the
property leading to Village Boulevard.

Claudette Dalack commented that the building style is like
nothing else in Tequesta. Scott Ladd stated that it may not
be in keeping with the Town Center Master Plan, and reminded
the Board that Zoning In Progress is still in place in the
Village. Mr. Howell explained that the attempt was to
minimize the bulk of the building, therefore leaving no
alternative but to build higher.
Chairwoman Cook stated she had problems with the west end
parking area. Paul Coben felt the landscaping plan with the
large swale area was good.
Scott Ladd agreed the drainage plan was good, and that all
requirements of Landscape Ordinance No. 377 have been met, but
reminded the Board that the proposed cross on the east side
of the church is 11 stories high (110 ' ) and would need a red
flashing light on the top.
Paul Coben moved to approve the application as submitted.
Victor Strahan seconded the motion. The vote on the motion
was:

Chairwoman Cook inquired regarding the status of the partially
built NCNB Bank building at County Line Plaza, and asked if
it is possible to get that taken down. Scott Ladd explained
that was not possible, since NCNB is trying -to finalize a
merger. NCNB did clean up the site, removed the trusses,
removed the Port-O-Let, painted the beams to keep them from
rusting, etc. Mr. Ladd explained there has been a major
investment in this building with permit fees, impact fees,
etc. Chairwoman Cook suggested that in the future a time
limit be given to complete a building. The pending bankruptcy
of the plaza has been settled and Mid Atlantic Bank is now in
control . Chairwoman Cook suggested that a letter be written
to NCNB to inquire as to when construction might be finished.
VII. ADJOURNMENT
There being no further business before the Board, the meeting
was adjourned at 11:40 A.M.

Dear Mr. Howell:
This letter is in response to your application to the Village of Tequesta, seeking approval
for the construction of an entrance road for the St. Judes Catholic Church. The church is
located at 204 U.S. Highway 1 North in Tequesta, and is owned by the Diocese of Palm
Beach. The project has the potential to impact Florida scrub jays, federally listed as a
threatened species.
In accordance with the Endangered Species Act of 1973 (Act), as amended, only two
avenues are available to legally "take" a listed species, such as the scrub jay. "Take", as
defined in the Act, means "...to harass, harm, pursue, hunt, shoot, wound, kill, trap,
capture, or collect, or to attempt to engage in any such conduct." One avenue is through
the Section 7 consultation process using the Incidental Take statement in the Biological
Opinion. In order to use the Section 7 process, a Federal agency must be involved in the
project. If a Federal agency is not involved, the other method available is obtaining a
Section 10(a)(B) permit by developing a Habitat Conservation Plan in accordance with

following report for environmental consulting services at the above
referenced project.
This Agreement is made and entered into as of this Ninth day of
September, 1991 by St. Jude's Catholic Church (the Client) and
george g. gentile & associates, inc. (the Consultant) .
1. Agreement for Services:
The Consultant agrees to provide design and planning services
to the Client as more fully described in the Scope of Work,
and the Client agrees to compensate the Consultant for those
services under the terms of this Agreement.
2 . Scope of Work:
The Parties agree that the Scope of Work which the Consultant '
shall perform for the Client shall be defined as follows:
A. The Consultant shall perform a vegetation assessment on .
the proposed property to determine the existence of plant •
species that are listed as endangered, threatened, or of
special concern on federal, state and local lists. The
Consultant shall prepare a letter report of his findings
and submit it to the client for his review.

B. Perform a wildlife assessment on the proposed property to
determine the existence of wildlife on the property that
are listed as endangered, threatened or of special
concern on federal, state and local lists. The
Consultant shall perform his site work in a manner and
methodology as prescribed by the Florida Game and
Freshwater Fish Commission.
C. The Consultant shall prepare a full report on his
findings, meeting the requirements of the Department of
Environmental Resources Management of Palm Beach County, '
The Village of Tequesta and The Florida Game and
Freshwater Fish Commission.
The Client shall stake the corners of subject parcel for
the Consultant.
D. Additional Services shall be performed by the Consultant
upon written authorization from the Client. The
Consultant shall be compensated for said services as
stipulated in this Agreement. Additional Services shall.
include but not be limited to the following:
1. Environmental permitting based on the above reports
and. requirements of the governmental agencies.
2 . Preparation and performance of mitigation
requirements for any and all listed species found
and required by the jurisdictional agencies to be
mitigated.
E. Completion of the Items A through C above shall be within
ten (10) working days upon authorization and acceptance
of this Agreement.
3 . Compensation:
A. Compensation for Items A, B, and C under. Scope of Work
rendered by the Consultant shall be a fixed fee of Four
Thousand One Hundred Dollars ($4, 100. 00) plus
reimbursable expenses as described herein.
B. Compensation for Additional Services (Item D under Scope
of Work) rendered by the Consultant shall be hourly based
upon the following hourly rates plus reimbursable
expenses as described herein.

1. Principal time at a hourly rate of Eight Five
Dollars ($85. 00) • an hour.
2. Sr. Landscape Architect/Project Manager time at a
hourly rate of Fifty Five Dollars ($55. 00) an hour.
3 . Landscape Architect/Cadd Operator time at a hourly
rate of Forty Five Dollars ($45. 00) an hour.
4 . Technician time at a hourly rate of Thirty Five
Dollars ($35. 00) an hour.
5. Administration time at a hourly rate of Twenty Five
Dollars ($25. 00) an hour.
4 . Reimbursable Expenses:
Reimbursable expenses consist of out of pocket items of
expenses incurred by the Consultant. Included are
photographic services and the cost thereof, materials,
reproduction and printing other than normal blueprints and/or
xerox copies which are performed by outside vendors supported
by an invoice. The Client shall be responsible for direct
payment on all permits, fees, and other engineering reports or
studies that may be required.
5. Client's Responsibilities: •
The Client shall be responsible for the following:
A. The Client shall provide full information concerning the
Scope of Work, shall set forth the Client's objectives,
restraints, and criteria.
B. The Client shall provide the Consultant with a certified
copy of a survey. The Consultant shall rely on the
accuracy of this survey in the performance of his work
under this Agreement.
6. Payment for Services: •
The Consultant shall bill the Client for its services and
reimbursable costs due under this Agreement at such times as
it shall deem proper. All invoices are due and payable upon
receipt by the Client. The Consultant will stop all work per
this Agreement on invoices past due thirty (30) days. ' Work
will not commence until all past due invoices are paid in
full. The Consultant assumes no responsibility for damages,
either financial, physical or other, as a result of work being
stopped.

7 . Termination of Agreement:
This Agreement is terminable at any time. upon notice of the
Client or the Consultant to the other party. Termination of
this Agreement, however, shall not relieve the Client of any
responsibility for payment for any services performed by the
Consultant prior to receipt of the notice of termination.
8 . Extent of Agreement:
This Agreement represents the entire Agreement between the
Client and the Consultant concerning the Scope of Work and may
be amended only by written instrument signed by the Client and
the Consultant. In all respects, this Agreement shall be
governed by the laws of the state of Florida and venue
concerning any dispute that may arise under it shall be in
Palm Beach County, Florida.
9. Limits of Liability:
The Consultant or his Consultants, Agents, Representatives or
Employees shall not be liable to the Client for indirect,
special, reliance, incidental, consequential or exemplary
damages (other than personal injury damages) arising out of or
in connection with the performance of the services for this
Agreement beyond the amount of fees paid for such services.

Dear Father Vengayil:
This letter will serve to address the requirements of the Village
of Tequesta and Palm Beach County as they relate to the potential
traffic impacts associated with the expansion of the St. Jude's
Church located on the west side of U.S. 1 in the Village of
Tequesta, Florida.
Traffic Performance Standard
Any development approval that the Village of Tequesta issues must
be in compliance with the Palm Beach County Traffic Performance
Standards Code (Ordinance 90-40). which is meant to limit growth in
areas without adequate roadway capacity. The provisions of the
Code address applications for site specific development orders for
properties on which there is an existing use, as in the case of St.
Jude's Church. Specifically, any application for a site specific
development order for property on which there is an existing land
use shall be subject to the Code's standards only to the extent
that the traffic generation projected for the new site exceeds the
traffic generation of the existing land use.
St. Jude's Expansion Plans •
The proposed plan for the expansion of St. Jude's Church calls for
a consolidation of church services. Presently two sanctuaries are
used simultaneously - one in the existing church and the other in
the adjacent parish hall' structure. The new church will allow the
entire congregation to observe services together in the new
sanctuary. Therefore, there will be no additional traffic
associated with the construction of an enlarged church structure.

No other changes are proposed. No new activities are planned
during the week, and as demonstrated, the expansion plans are not
a response to expected new Sunday activity.
Site Improvements
Along with the expansion of St. Jude's Church building, significant
improvements to the site are planned. Among them are two site
access and circulation improvements:
o The driveway on U. S. 1 will be better aligned with
the existing median opening serving the St. Jude's
site, and
o A new driveway will be connected to the north-south
right of way which is adjacent to the western
property line of the church, which will connect
northerly to the road south of the shopping center.
These improvements will minimize the traffic impacts which are
presently experienced at St. Jude's Church.
Conclusion
No additional traffic will be associated with the proposed St.
Jude's Church. The proposed development is therefore in compliance
with the provisions of the Palm Beach County Traffic Performance
Standards Code.

approvals for St. Jude's Church in order to achieve your objective,
Christmas Mass, 1992 in the new church. Please feel- free to
