SUBJECT: Ordinance No. 426 and Ordinance No. 427,
Annexing Parcels of Land to the Territorial
Limits of the Village; Agenda Item
In accordance with Florida Statutes and the Village of Tequesta
Annexation Policy, the Village has advertised, copy attached,
for four consecutive weeks the proposed Second Reading and
Adoption of Ordinances No. 426 and 427 which were adopted by the
Village Council on First Reading at your meeting on August 15.
Additionally, the Village has notified all applicable
governmental entities of the proposed annexation for their
review and comment. As of this writing, the Village has
received only one comment, copy attached, from Martin County
which requests coordination of the Level of Service Standards
and any site related improvements. for the intersection of County
Line Road and U. S . One which Village staff is happy to do.
Therefore, being that the proposed annexations appear to be in
compliance with the requirements of Florida Statutes, and that
they are in keeping with the goals and objectives of the Village
Annexation Policy, it is recommended that the Village Council
finalize these annexations by the adoption of Ordinances No. 426
and 427.

NOTICE OF ANNEXATION
The.Village of Tequesta, Florida, proposes to annex certain parcels of land to the
territorial limits of the Village of Tequesta as described in Ordinances Nos.426 and r'
, 427.
The parcels, as identified on the map below,are contained and described in Ordi-
nance Nos. 426 and 427.
ORDINANCE NO.426 proposes to annex 5.237 acres +/-located west of U.S.Highway '
One North,and south of County Line Road along with sections of road rights-of-way :.
located in Section 30,Township 40 South, Range 43 East, Palm Beach County,.Flor-
ida.
ORDINANCE NO. 427 proposed to annex .92 acres +/-or 40,000 square feet at the
southwest corner of the intersection of County Line Road.and U.S. Highway One
North, along with.sectionsof road rights-of-way located in Section 30,Township 40
South, Range 43 East, Palm Beach County, Florida.
A complete legal description by metes and bounds of the areas proposed to be an-
nexed and the Ordinances can be obtained form the Office of the Village Clerk,357
'Tequesta Drive,Tequesta,Florida,Monday through Friday,between the hours of 8:30 '
A.M. and 5:00 P.M.
Second Reading and final action on the proposed annexation Ordinances will be
held at 7:00 P.M., Thursday, September 19, 1991, in the Tequesta Village Hall, 357
Tequesta Drive,Tequesta,Florida.Interested parties may appear at the hearing to be
heard with respect to the proposed Ordinances.
PLEASE TAKE NOTICE AND BE ADVISED, that if any person desires to appeal any
decision made by the Council with respect to any matter considered at this hearing,
he/she will need a record of the proceedings,and for such purpose,he/she may need
to ensure that a verbatim record of the proceedings is made,which record includes
the testimony upon which the appeal is to be based:

RE: Proposed Annexation Ordinance #426 and #427 for Village of Tequesta —
Dear Mr. Capretta:
On September 10, 1991 , the Martin County Board of County Commissioners met to
consider a request for comments regarding the above referenced annexations. Board
concern focused on potential impacts to the County Line Road/U.S. Highway 1
intersection.
Martin County residents from the Northfork of the Loxahatchee River utilize County
Line Road as the principle access point to U.S. Highway 1 . Currently, County Line
Road operates at an acceptable level of service. Maintaining an acceptable flow of
traffic at the intersection is a principle concern of the Board. The Board
requests .that the Village coordinate the site related intersection improvements
with the County Engineering and Growth Management Departments at such time as
development is proposed.
We appreciate your request for comments regarding the above referenced annexations
and we request that Martin County be kept informed of any specific development
plans submitted for either of the annexed areas-. In this way we can ensure that
County Line Road will continue to operate at an acceptable level of service.

ORDINANCE NO. 427
AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF
TEQUESTA, PALM BEACH COUNTY, FLORIDA, ANNEXING A
CERTAIN PARCEL OF LAND TO THE TERRITORIAL LIMITS OF
THE VILLAGE OF TEQUESTA.
WHEREAS, pursuant to Subsection 29 of Section 4. 02 of
Article IV of the Charter of the Village of Tequesta and Chapter
171, Florida Statutes, 1975, as the same may be amended from
time to time, the Village Council may annex any lands adjoining
the territorial boundaries of said municipality upon the
petition of the owner or owners thereof; and
WHEREAS, Tequesta Bay Partnership, the owner of a
certain parcel of land situated in Palm Beach County, Florida,
has filed a petition with the Village Council requesting that
the lands described therein be annexed to the territorial limits
of the Village of Tequesta, Florida.
NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE COUNCIL
OF THE VILLAGE OF TEQUESTA, FLORIDA, as follows:
Section 1. That the parcel of land owned by Tequesta
Bay Partnership and more particularly described within attached
Exhibit "A", legal description, along with the adjacent road
rights-of-way more particularly described within attached
Exhibits "B" and "C", legal descriptions, is hereby annexed and
incorporated into the Village of Tequesta, Florida with the same
force and effect as though same had originally been incorporated
into the territorial boundaries thereof. Said property shall be
annexed with a zoning classification of C-2, Community
Commercial District, with a land use pursuant to the Village
Comprehensive Plan of "Commercial".
Section 2. The parcel of land herein described shall
be subject to all of the ordinances, regulations and codes of
the Village of Tequesta.
Section 3. That this ordinance shall take effect
upon its approval and passage as provided by law.
