HomeMy WebLinkAboutDocumentation_Regular_Tab 10E_9/19/1991 ORDINANCE NO. 430 AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF TEOUESTA, PALM BEACH COUNTY, FLORIDA, AMENDING CHAPTER 6, BUILDING REGULATIONS, ARTICLE VIII, PERMIT FEES, SECTION 6-142, PERMIT FEES-BUILDINGS AND OTHER STRUCTURES, BY ADDING NEW PARAGRAPHS ( i), ( i) AND ( k); PROVIDING FOR SEVERABILITY; PROVIDING FOR CODIFICATION; PROVIDING AN EFFECTIVE DATE. NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE VILLAGE OF TEOUESTA, PALM BEACH COUNTY, FLORIDA, AS FOLLOWS: Section 1. Chapter 6 of the Code of Ordinances of the Village of Tequesta is hereby amended at Article VIII, Section 6-142 by adding a new Paragraph ( i) to read as follows: Sec. 6-142. Permit fees-buildings and other structures. ( i) Landscaping: Per Section 6-142(a), fee schedule. Section 2. Chapter 6 of the Code of Ordinances of the Village of Tequesta is hereby amended at Article VIII, Section 6-142 by adding a new Paragraph ( 1) to read as follows: Sec. 6-142. Permit fees-Buildings and other structures. ( j) Requests for refunds of permit fees paid must be submitted to the Department of Community Development within thirty (30) days of the date of issuance of the permit. There shall be no refunds of the plan submittal and review fee paid at the time of application for permit. Section 3. Chapter 6 of the Code of Ordinances of the Village of Tequesta is hereby amended at Article VIII, Section 6-142 by adding a new Paragraph (k) to read as follows: Sec. 6-142. Permit fees-Buildings and other structures. (k) In the event that a permit expires, renewal of the expired permit shall require the payment of the full permit fee in effect at the time of renewal. Subject to the approval of the Building Official, one or more, not to exceed four, requests for permit extensions can be made prior to the expiration of a permit. However, in no event shall extensions be granted by the Building Official on projects which have received variances, special exceptions, and site plan reviews which have otherwise lapsed pursuant to the Villages Zoning Code. A fee equal to twenty- five percent (25%) of the original permit fee shall be required for each approved permit extension. Section 4. Severability. If any provision of this Ordinance or the application thereof is held invalid, such invalidity shall not affect the other provisions or applications of this Ordinance which can be given effect without the invalid provisions or applications, and to this end, the provisions of this Ordinance are hereby declared severable. Section 5. Codification. This Ordinance shall be codified and made a part of the official Code of Ordinances of the Village of Tequesta. Section 6. Effective Date, This Ordinance shall take effect immediately upon its passage and approval, as provided by law. THE FOREGOING ORDINANCE was offered by Councilmember who moved its adoption. The Ordinance was seconded by Councilmember and upon being put to a vote, the vote was as follows: FOR ADOPTION AGAINST ADOPTION.
