PUBLIC HEARING MINUTES
MAY 20 , 1991
I. CALL TO ORDER AND ROLL CALL
The Village of Tequesta Zoning Board of Adjustment held a
regularly scheduled Public Hearing at the Village Hall, 357
Tequesta Drive, Tequesta, Florida, on Monday, May 20, 1991.
The meeting was called to order at 7:40 P.M. by Boardmember
John P. Turner. A roll call was taken by Fran Bitters, the
Recording Secretary. Boardmembers present were: John P.
Turner, Alfred DeMott, and Alternate Robert Friemark.
Chairman William Kirkland arrived at 7:45 p.m. Vice Chairman
James Van Wagner and Boardmember Kenneth Northamer were not
in attendance. Scott D. Ladd, Clerk of the Board, and Village
Attorney John C. Randolph were in attendance.
II. APPROVAL OF AGENDA
The Agenda was approved as submitted.
III. APPROVAL OF PREVIOUS MEETING MINUTES (Zoning Board of
Adjustment Meeting Minutes, April 15, 1991) .
The above-referenced Minutes were approved as submitted.
Boardmember DeMott moved to approve the above-referenced
Minutes as submitted. Boardmember Friemark seconded the
motion. The vote was:
John Turner - for
Robert Friemark - for
Alfred DeMott - for
the motion was therefore passed and adopted.
Chairman Kirkland arrived at 7:45 p.m.

IV. NEW BUSINESS
1. The application of Nicholas Porto, as agent for Jupiter
Inlet Colony and on behalf of Ocean Towers South
Condominium Association, as owner of a parcel of land
located at the southwest corner of the property located
at 100 Beach Road and as legally described as' follows:
A parcel of land lying in Lot 197 of the Plat of
Subdivision of Gomez Grant and Jupiter Island, as
recorded in Plat Book 1, Page 80, Public Records of Palm
Beach County, Florida, a more complete and specific legal
description being on file at the Village Hall; requesting
a variance to the terms of the Official Comprehensive
Zoning Ordinance of the Village of Tequesta, Ordinance
No. 355, as amended, Section VII (C) , Schedule of Site
Regulations, R-3 District, minimum front yard, side yard
and rear yard setbacks, to allow the construction of an
addition to the existing Jupiter Inlet Colony Town
building with a front yard setback of zero feet (01 ) in
lieu of sixty feet (601 ) , an east side setback of two and
one-half feet (2.51 ) in lieu of forty feet (401 ) and a
rear yard setback of three feet (31 ) in lieu of forty
feet (401) , as required by the Zoning Ordinance.
Additionally, requesting a variance to Ordinance 355, as
amended, Section VIII (H) , Off-Street Parking Space
Requirements, to allow the provision of no required
parking spaces in lieu of one (1) parking space, as
required by the Zoning Ordinance.
Nicholas Porto, Mayor, Jupiter Inlet Colony stated the Colony
has a building which was originally constructed for the Colony
Police Department. For years the Town Clerk of the Colony
operated out of her own home. Upon her resignation the new
Clerk was placed in the same building with the Police, which
was extremely small. There is a small room at the Police
Department which is approximately a 5 x 7 room, with space
only for a desk and typewriter. The file cabinets are kept
in the lavatory. This is obviously not a practical situation.
More space is much needed, hence the above-referenced
application for an addition and a variance.

A strip of land adjacent to the Police Department for that
addition has been purchased from Ocean Towers South
Condominium Association. The proposed addition will be the
same design as the existing building (stucco with a tile
roof) . Half of the proposed addition will be in' Tequesta, the
other half in Jupiter Inlet Colony. The existing chain link
fence will be moved. Snapshots of the area were presented to
the Board. There are plans to landscape the area; however,
those plans will not be firm until the Jupiter Inlet Colony
receives approval from Tequesta for the above-referenced '
variance application.
Boardmember moved to approve the application for variance as
submitted. Boardmember DeMott seconded the motion. The vote
on the motion was:

Robert Friemark - for
Alfred DeMott - for
William Kirkland - for
the motion was therefore passed and adopted.
V. UNFINISHED BUSINESS
There was no unfinished business.
VI. ANY OTHER MATTERS
There were no other matters before the Board.

VII. ADJOURNMENT
Boardmember Turner moved to adjourn the meeting. Boardmember
DeMott seconded the motion. The vote on the motion was:
John Turner - for,
Robert Friemark - for
Alfred DeMott - for
William Kirkland - for
the motion was therefore passed and adopted.
The meeting was adjourned at 7:55 P.M.
