SUBJECT: Loxahatchee River Environmental Control District
(ENCON) Stormwater Management Utility Advisory
Committee; Tequesta Designate; Agenda Item
As you know, Stormwater Management is becoming a bigger issue with
each passing day. As Florida communities attempt to keep up with
growth and address past infrastructure shortfalls, how to pay for
infrastructure such as stormwater systems becomes paramount. Aquifer
recharge needs and requirements as well as existing and forthcoming
pollution control mechanisms will add additional costs to stormwater
mechanisms.
As Vice Mayor Mackail mentioned at the last Village Council Meeting,
the Stormwater Utility Concept, as authorized by Florida Statutes, is
becoming more and more attractive with each passing day as the
appropriate means of managing and paying for stormwater mechanisms.
ENCON realizes this and has created a Stormwater Management Utility
Advisory Committee. This Committee will work with ENCON in further
defining the role ENCON will play relative to ENCON' s direction
toward a regional stormwater utility. Additionally, the Committee is
envisioned to communicate back to local governments the activities of
ENCON. The proposed Committee members are as follows:
o Village of Tequesta
o Town of Jupiter
o Town of Jupiter Inlet Beach Colony
o Town of Juno Beach
o Martin County
o Palm Beach County
o Northern Palm Beach County Water Control District -
o South Indian River Water Control District

Mr. Dent informs me that the time and date of the Committee ' s
meetings will be set by the Committee. ENCON is looking for a
Committee membership mix that will entail staff members, engineers
and political representatives.
I believe that the Village should appoint a representative to this
proposed ENCON Committee. The Village is desirous of forming its own
stormwater utility at the appropriate time for our needs and as such,
should be represented on the ENCON Committee to coordinate the
activities of these two governmental entities.
I will be happy to represent the Village on the Committee if this is
your desire. Alternatives for your consideration are a Village
Councilmember with a strong interest in this subject, another staff
member, the Village Consulting Engineer or a citizen who Village _
Councilmembers feel is highly qualified to represent the Village in
this regard.

SUBJECT: STORMWATER MANAGEMENT UTILITY
Advisory Committee Formation
Dear Mr. Bradford:
In February, 1990 , the District set out to define what role
could be played by our Agency in the management of
stormwater. In establishing our role we did not want to
duplicate activities of local governments, special districts
or regulatory agencies . Several areas were found to be
either not addressed, only marginally addressed or best
resolved through regional means . Current and long term
involvement by the District in each of these areas could
provide substantial benefits to the health, safety, and
welfare of the community as well as protection to the
Loxahatchee River.
In February, 1991 , the District Governing Board confirmed
its desire to fulfill its role in stormwater by ranking the
issue as a priority item for District involvement. Over the
past three months the Board has allocated funding for the
current year, solicited proposals from consultants for the
establishment of a plan and fee structure for the area and
initiated the formulation of a Rule to guide future programs .
One of the key elements to the establishment of a Regional
Utility is the participation of local governments on an
advisory committee. This committee will work with the
District in further defining the role we will play, and
communicate back to the local governments the activities of
the District.
We request that the Village of Tequesta designate a member
for this committee and advise our office by June 28, 1991,
of your representative' s name, address, and telephone number.
