CALL TO ORDER AND ROLL CALL The Village of Tequesta Zoning Board of Adjustment held a regularly scheduled Public Hearing at the Village Hall, 357 Tequesta Drive, Tequesta, Florida, on Monday, April 15, 1991. The meeting was called to order at 7: 30 P.M. by Vice-Chairman, James Van Wagner. A roll call was taken by Fran Bitters, the Recording Secretary. Boardmembers present were: Kenneth W. Northamer, John P. Turner, Alfred DeMott, James Van Wagner, and Alternate Robert Friemark. Chairman William Kirkland was recovering from surgery and therefore was not in attendance. Also present were: Scott D. Ladd, Clerk of the Board, and Village Attorney John C. Randolph. II. APPROVAL OF AGENDA The Agenda was approved as submitted. III. APPROVAL OF PREVIOUS MEETING MINUTES (Zoning Board of Adjustment Meeting Minutes, March 18, 1991) . The above-referenced Minutes were approved as amended, with the following correction: Page 1, last paragraph, reflected a change to "governing board of the County Club at the golfcourse" which should have been "Board of Governors of Tequesta Country Club. " L ' Zoning Board of Adjustment Meeting Minutes April 15, 1991 Page 2 Boardmember DeMott moved to approve the above-referenced Minutes as amended. Boardmember Northamer seconded the motion. The vote was: John Turner - for James Van Wagner - for Ken Northamer - for Robert Friemark - for Alfred DeMott - for the motion was therefore passed and adopted. IV. NEW BUSINESS 1. The application of Paul F. & Nora W. Trow, owners of Lot 8, Bay Harbour Subdivision, located at 25 Bay Harbor Road, requesting a variance to the terms of the Official Comprehensive Zoning Ordinance of the Village of Tequesta, Ordinance No. 355, as amended, Section X, Supplemental Regulations, Subsection (A) , General Provisions, Paragraph (1) (c) , to allow the extension of an existing wall forward of the front building line, in lieu of no wall or fence being permitted to extend forward of the front building line on any lot or parcel, as required by the Zoning Ordinance. Scott Ladd, Clerk of the Board explained, one letter had been received regarding the above-referenced case, from Richard Black, President of the Bay Harbor Association, in support of the application of Paul F. & Nora W. Trow. Richard Neibling, general contractor, was present in representation for Mr. and Mrs. Trow. He explained the proposed wall would be an aesthetically, architectural advantage with a tile top, the wall itself being cement block and stucco. Mr. Neibling gave a brief background for the application: The Trow home sits at the very southwest corner of Bay Harbor, which has a u-shaped private street. Two partial walls were built in 1968 when the home was originally built. Mr. and Mrs. Trow purchased this home a few years ago. Their preference is to connect the two walls. This will complete an architectural structure that now looks rather incomplete. There have been no objections from adjoining property owners. Zoning Board of Adjustment Meeting Minutes April 15, 1991 Page 3 Boardmember Turner asked, since the road is a private road, is it not part of the Tequesta Street system? Scott Ladd explained it was one of two private streets which Tequesta has, and it was, in fact, annexed into the Village as a private road. Mr. Ladd continued by explaining that the street is private and not in question, but nonetheless, the zoning regulations still apply to the property in question. Boardmember Turner, stating there was really nothing to object to, moved to approve the application as submitted. Boardmember DeMott seconded the motion. The vote on the motion was: John Turner - for James Van Wagner - for Ken Northamer - for Robert Friemark - for Alfred DeMott - for the motion was therefore passed and adopted. V. UNFINISHED BUSINESS There was no unfinished business. VI. ANY OTHER MATTERS There were no other matters before the Board. Zoning Board of Adjustment Meeting Minutes April 15, 1991 Page 4 VII. ADJOURNMENT Boardmember DeMott moved to adjourn the meeting. Boardmember Northamer seconded the motion. The vote on the motion was: John Turner - for James Van Wagner - for Ken Northamer - for Robert Friemark - for Alfred DeMott - for the motion was therefore passed and adopted.
