Bradford, Village Manager / DATE: May 3, 1991 SUBJECT: Ordinance Amending Building Regulations to Prohibit Fugitive Dust and/or Blowing Sand from Construction Sites; Agenda Item As you recall at a recent Village Council Meeting, Scott Ladd, Building Official, recommended the creation of an ordinance that would give his department additional powers to regulate construction sites in regard to sand, dust, and debris which can, from time to time, become a problem for adjacent properties. The attached Ordinance gives the Building Department the ability to require materials, such as fill, to be stabilized with coverings, wetting or approved chemical application to minimize this potential. The attached Ordinance has been approved by the Village Attorney for legal form and sufficiency. It is recommended that the Village Council approve this Ordinance. Tom, attached is a copy of a. proposed ordinance that will be an enhancement to our on—going code enforcement program and our mission to provide the best possible protection for our citizens. Recycled Paper DRAFT ORDINANCE NO.___ AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, AMENDING THE CODE OF ORDINANCES OF THE VILLAGE OF TEQUESTA BY AMENDING CHAPTER 6, BUILDINGS AND BUILDING REGULATIONS, ARTICLE I, IN GENERAL, BY ADDING A NEW SECTION 6-3, FUGITIVE DUST AND/OR BLOWING SAND; PROVIDING FOR SEVERABILITY: PROVIDING FOR CODIFICATION; PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, AS FOLLOWS: Section 1. Chapter 6, Article I, of the Code of Ordinances of the Village of Tequesta is hereby amended by adding a new Section 6-3 as follows: Sec. 6-3. Fugitive dust and/or blowing sand. ( a) During the course of any construction or demolition work being done on any premises, it shall be unlawful for any person to cause, permit or allow the emissions of particulate matter from any source whatsoever, including but not limited to incidents caused by vehicular movement, transportation of materials, construction, alteration, demolition or wrecking of buildings or_ structures, or - the stockpiling of sand or ''dirt, without taking reasonable precautions to prevent such emissions or to preclude fugitive particOlates that may trespass on neighboring properties ;during dry and windy weather. In the case of Astockpiled particulate - materials, such materials shall be stabilized by adequate coverings, by wetting, by approved chemical application or by other approved means, to the satisfaction of the Building Official. (b) In addition to other remedies for violations of this Code, the violation yof this Section shall constitute grounds for the issuance of a stop-work order by the Building Official in accordance with the provisions of the Building Code. Section 2. Severability. If any provision of this Ordinance or the application thereof is held invalid, such invalidity shall not affect the other provisions or applications of this Ordinance which can be given effect without the invalid provisions or applications, and to this end, the provisions of this Ordinance are hereby declared severable. Section _3. Codification. This Ordinance shall be codified and made a part of the official Code of Ordinances of the Village of Tequesta. Section 4. Effective Date. This Ordinance shall take effect immediately upon its passage and approval, as provided by law. THE FOREGOING ORDINANCE' was offered by Councilmember , who moved its adoption.
