Harrison, Assistant to Vil age nager DATE: April 4, 1991 SUBJECT: Tequesta Park; Negotiations with Martin County Per your request, this is to report the status of negotiations for cost-sharing of Tequesta Park with Martin County. Village staff met with Martin County staff in the summer of 1990 to discuss an interlocal agreement to include Martin County contribution to the operational expenses of Tequesta Park. At that time, we were told that there was no funding in the Martin County FY 90/91 budget to contribute to Tequesta Park. Martin County officials said that they would get back to us regarding an interlocal agreement. The next event was a letter from you to Commissioner Walt Thom in December, 1990, requesting that action be taken regarding the park. In January of 1991, I received a request for information from the Martin County Park Department, which I provided to them. Last month, I contacted Commissioner Thom as it had been indicated to me that any action would probably be initiated by Commissioner Thom. When I spoke to Commissioner Thom, he said he did not know of any interlocal agreement in process. The main justification for cost-sharing is that Martin County is counting eight acres of Tequesta Park as community park provided to Martin County residents in its Comprehensive Development Plan (pages 7-4, 7-5 and 7-6 attached) . On page 7-6 of the Plan, Tequesta Park is referenced as a facility " . . .which will be available to Martin County residents with the procurement of a formal written agreement which meets the public access and other requirements of Rule 9J-5. " If Martin County does not do what its Comprehensive Plan says . it will do, the Village would have legal options once the County's plan is accepted by the Department of Community Affairs, and this acceptance is expected to occur in the next couple of months. Based on facts available now, our attorney has indicated that the Village would probably be able to use at least two legal avenues through Circuit. Court, may be able to petition the DCA for relief, and could explore whether or not Tequesta could propose a plan amendment to Martin County's Comprehensive Plan. WKH/krb/mk • .
