SUBJECT: Building Department Review for Code Sufficiency.
SUBJECT: Nozzle Nolen Office Building
341 South Old Dixie Hwy.
Demolition of a portion of and reconstruction of the
west end of the existing office building as a result of
the County' s proposed widening of Old Dixie Hwy.
Tom, I have reviewed the above referenced protect and
determined that it meets, as being presented for Site Plan Review,
the technical requirements of the Village Codes and Regulations
except as to Ord. 377, Landscape Regulations, for which the
. applicant has submitted an application for, waiver for those
regulations. This project was initiated as a result of the County
taking of a portion of the applicants property in order to widen
Old Dixie . Hwy. This County action prompted the applicant to seek
a variance to the front setback required for the relocated west
wall of the existing building and the relocation of the applicants
existing free standing sign for which a variance was granted.
The Building Department staff recommends approval of
this proposed project.

PROJECT: Nozzle Nolen Office Building

west end of the existing office building as a result of
the County' s proposed widening of Old Dixie Hwy.
Tom, The C. A. B. reviewed the above referenced project on March
6, 1991.
The following concerns were expressed by the Board regarding this
proposed project:

1. Chairperson Leslie Cook felt that the 1' 10" strip of
around in front of the relocated west wall should be
landscaped.
2. Member Paul Coben wondered why there was no wall sign
indicated on the proposed building and urged the
applicant to consider a wall sign when submitting for
future approvals.
Motion to approve the proposed project subject to the following
condition:
1. The eventual ( after the County concludes their road and
sidewalk work) landscaping of the 1' 10" strip between
the proposed sidewalk and the west wall of the
relocated building.
Vote on the motion: 5-0 to approve.
Additional Board comments: NONE
Building Official comments: This proposed demolition and
relocation of the west end of Mr. Nolens building was the subject
of and request for a variance from the Zoning Board of Adjustment
at their meeting of March 18, 1991. -A copy of the approval
letter for that variance request is attached to this memo.

James Coble moved to approve the wall as submitted, with the
exception of the sign, which is tabled until a later date.
Claudette Dalack seconded the motion. The vote was:

the motion was therefore passed and adopted.
D) An application from Jane S. Hunston, Esq. , of Desantis,
Cook & Hunston, P.A. , as agent for Kenneth Nolen, for the
demolition and subsequent reconstruction of the front
portion of the Nozzle Nolen building located at 304 South
Old Dixie Highway.
Jane Hunston, Esquire, Ken Nolen, owner of Nozzle Nolen, and
Charlie Wagner, the contractor, were in attendance in
representation of this application. Ms. Hunston explained
that the County has taken, by eminent domain proceedings, a
significant portion ( about 1/3 the total square footage of
Mr. Nolen's building) to widen Old Dixie Highway. Mr. Nolen
has several other applications: 1) application for a variance
in order not to meet the 15 foot setback requirement because
of the significant amount of space that needs to be demolished
and reconstructed before the County comes through there. The
present timetable is April 1, 1991. Today's meeting is to
show the CAB the portion of the building that will be
demolished and to show the proposed reconstruction of the
front of the building. The color of the proposed building
will be the same as the existing building, with an entrance
on the side. Pictures were presented for the CAB's
information. The roof will be similar to the shingle that
presently exists. The sign which is now to the north will be
replaced to the south, about five feet to the east of the
right of way.
Scott Ladd explained they are applying for a variance for the
sign and the building. Ms. Hunston explained they are also
applying for a landscape waiver since there is not much time
to accomplish everything. There will be a 1' 10" strip
between the sidewalk and the building. Leslie Cook felt that
area should be landscaped.

Vice Chairman Coben asked why there was no sign on the
proposed building. Mr. Nolen responded that he did not know
he could have two signs. Scott Ladd informed him that was
possible. Mr. Nolen said if the CAB approved it, he would do
it. Mr. Coben urged the applicant to bring a specific plan
when he returns for approve of a sign on the building.
Victor Strahan moved to approve the application as submitted,
subject to the eventual (after the County concludes their road
and sidewalk work) landscaping of the 1 ' 10" strip between the
sidewalk and the building. Claudette Dalack seconded the
motion. The vote was:

the motion was therefore passed and adopted.

There was no unfinished business.
VI. ANY OTHER MATTERS
Chairwoman Cook mentioned the Beautified Highways Program and
stated she would like to see the railroad track area in
Tequesta landscaped similar to that which was done by
Jupiter's railroad tracks. Scott Ladd suggested they wait
until after the County puts in the five-lane highway which is
proposed, since that project will take a large portion of that
subject area.

Subject: Zoning Board of Adjustment approval of Nozzle Nolen
application for variance.
This letter is to confirm the action of the Village of
Tequesta Zoning Board of Adiustment at their March 18, 1991 Public
Hearing granting approval of your application for a variance to
the terms of the Official Comprehensive Zoning Ordinance of the
Village of Tequesta, to allow the demolition of a portion of and
subsequent reconstruction of an existing structure with a front
yard setback of zero feet ( 0' ) , in lieu of fifteen feet ( 15' ) as
required by the Zoning Ordinance. Additionally, the Board
approved the variance to allow the relocation of an existing free-
standing sign to provide a setback from the front yard property
line of zero feet ( 0' ) , in lieu of ten feet ( 10' ) as required by
. the Zoning Ordinance.
This approval has no bearing or relationship to any
other approvals or permits which might be required. The Village
of Tequesta Building Department should be contacted in this
regard.

NATURE OF WAIVER: ( DESCRIBE GENERALLY THE NATURE OF THE WAIVER
DESIRED) Village of Tequesta Ordinance No. 377 requires that whenever a structure
is altered in any way that the landscaping be upgraded to meet present criteria
recuirements set forth in that Ordinance. Applicant is requesting a waiver of that
rec irement at this time because the Palm Beach County road right-of-way widening
of A-1-A is scheduled to commence April 1 , 1991 , and Mr. Nolen, the property owner,
is under severe time constraints to demolish the portion of the building that presently
encroaches upon the new right-of-way and to reconstruct the same. (See Exhibit "B")
JUSTIFICATION OF WAIVER: ( SUPPORTING DATA, WHY APPLICANT FEELS
WAIVER SHOULD BE GRANTED) For the above-stated reasons, it would result in an
undue hardship for Mr. Kenneth Nolen to be required to upgrade the landscaping on
the subject property at this time. At a later date he hor's to make an addition to the
existing building and will have to meet the requirements of Ordinance No. 377 at that
tine and in any event by the expiration of the five-year deadline set forth in the
Orainance.
NOTE: APPLICANT MAY BE REQUIRED TO INCLUDE THE FOLLOWING ITEMS
WITH THIS APPLICATION:
