SUBJECT: Public Hearing to Abandon the Eastern Fifteen (15) Feet
of the Thirty (30) Foot Right-of-Way of Country Club Drive
that Extends South of Tequesta Drive and is Situated
Between the Tequesta Country Club Subdivision and Bayview
Terrace
This is to give you advance notice of a Public Hearing that we will be
conducting at the February 14 Village Council Meeting. The Public
Hearing will be to receive the input of the public relative to the
above referenced public right-of-way abandonment. Letters informing
the abutting property owners will go out on Thursday, January 31 and
thereafter you may receive phone calls pertaining to this matter.
The background on this subject is as follows:
o At the Village Council Meeting on June 23, 1988, the Village
Council indicated a willingness to conduct a Public Hearing to
provide for the abandonment providing that landscaping and
irrigation be undertaken for Bayview Terrace Subdivision where it
abuts Tequesta Drive. As you know, this has been completed and
is a beautiful addition to our Village.
o Previous requests were to abandon all of the thirty (30) foot
right-of-way granting property owners on each side fifteen (15)
feet of the thirty (30) foot right-of-way. The petition received
by the Bayview Terrace property owners is to only abandon the
easternmost fifteen (15) feet granting to them the same. This
may eliminate the previous concerns of abutting Tequesta Country
Club residents which in the past have appeared, at least from my
perspective, to be opposed to such •an abandonment.
You are under no obligation to approve this abandonment at this time.
Perhaps the idea of abandoning only half of the right-of-way to the
Bayview Terrace property owners will prove to be an acceptable
compromise to all parties concerned. Regardless, you will no doubt
hear the pros and cons to this issue.
Between now and February 14, should you have any questions regarding
this issue or wish to refer any persons to me, please do not hesitate
to do so.

Dear Mr. Ladd:
The property owners of Bayview Terrace Subdivision, whose property abutts the
easternmost fifteen feet of the thirty foot right-of-way for Country Club
Drive, south of Tequesta Drive, are submitting a petition requesting that
the Tequesta Village Council give consideration to conducting the necessary
public hearing to consider a road abandonment. The road, which the afore-
mentioned Bayview Terrace property owners request that the Village abandon,
is the easternmost one-half (fifteen feet) of the thirty foot right-of-way
for Country Club Drive, south of Tequesta Drive. The owners, whose property
abutts the easternmost fifteen feet of the thirty foot right-of-aay previously
mentioned, are listed in the enclosed petition. We are asking the Village of
Tequesta to abandon only the easternmost fifteen feet of the thirty foot road-
way in question.
Enclosed, for your and the Village Council's perusal, are the following
documents:
1) Petition to abandon the easteiiniust fifteen feet of the thirty
foot right-of-way for Country Club Drive, south of Tequesta
Drive
2) Record of the property owners fran the Palm Beach County Tax
Rolls
3) Copy of letter from Mr. Thomas G. Bradford to Mr. Kim M.
Smolka regarding the abandonment of the roadway in question

Dear Mr. Ladd:
This request is an addition to the previous petition requested on September 11,
1990. This petition is an addition to the 15' right of way abandonment pre-
viously mentioned.
I would like to request that the 5 foot limited access easement which runs along
the most west end of Lots 3, 4, 9, and 10 be abandoned or moved to the furth-
est point west of the previously requested 15 foot right of way abandonment.
I believe that if we have to keep the 5 foot limited access easement it should.
be relocated on the west end of each lot.

of the right—on—way behind our homes .
1 . The Plat with Mr. Ladd 's letter is incorrect . Due to a
Replat , Lot 600 is also adjacent to this right—of—way.
Please see attached.

2. I have not been able to contact Mr. and Mrs . Bracci for
their approval , but will do so over the weekend . Due to
the sewage lift station behind their home, this
resolution will have miminal impact on their property.
I wanted to provide you a copy of our Petition as soon as
possible so that you could take the opportunity to see that the
reasons for our objecton are valid .

Re: Resolution No 07-90/91 , Vacating and abandoning a
certain fifteen foot portion of a thirty foot
right-of-way
Dear Mr. Ladd:
We, as adjacent property owners to the subject right-of-way,
strongly object to the above resolution for the following
reasons :
1 . It will prevent access to the rear of our lots for
ourselves and future owners to park motorhomes, boats ,
etc. in compliance with the Village of Tequesta
screening codes. This loss of access will reduce the
useful value of our property and eliminate a feature
that may help resales in the future.
The western fifteen feet of this thirty foot
right-of-way has a ten foot utility easement with power
poles, guy wires, and several large trees that prevent
access.
2 . It will permit houses to be built, or additional
features added to existing homes, in Bayview Terrace
that are fifteen feet closer to our existing homes. We
wish to keep this buffer zone as wide as possible to
maintain our privacy and to reduce noise.
.
We further request that Mr. Van Brock repair the shell rock road in the
right-of-way to the condition it was in before it was destroyed during
the site preparation of Bayview Terrace.. The attached photograph and
letter, verified as an accurate description by witnesses, show the
condition of the road at the beginning of site preparation. The
photograph was of a fox that had been displaced by initial site
preparation.

A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF
TEQUESTA, PALM BEACH COUNTY, FLORIDA, VACATING AND
ABANDONING A CERTAIN FIFTEEN FOOT PORTION OF A THIRTY
FOOT RIGHT-OF-WAY ON THE PLAT OF TEQUESTA, AS RECORDED
IN PLAT BOOK 25, PAGE 8, PUBLIC RECORDS OF PALM BEACH
COUNTY, FLORIDA.
WHEREAS, the owners of the lands abutting the property
hereinafter described have petitioned the Village to abandon
and vacate a certain fifteen foot ( 15' ) . portion of the thirty
foot ( 30' ) right-of-way, platted as Tequesta Drive and commonly
known as Country Club Drive, located over and across the land
• more fully hereinafter described and as shown on Exhibit "A",
attached hereto; and
WHEREAS, the said right-of-way has never been paved and
has never been used by the . public; and
WHEREAS, the Village Council of the Village of Tequesta
does hereby find and determine that the necessity for the •
fifteen foot ( 15' ) portion of the right-of-way located on the
following described property does not serve Any public purpose
and is not necessary for public use;
NOW, THEREFORE BE IT RESOLVED BY THE VILLAGE COUNCIL OF
THE VILLAGE OF TEQUESTA, FLORIDA, AS FOLLOWS:
That that certain fifteen foot ( 15'.) portion of the
right-of-way platted as Tequesta Drive and commonly . known as
Country Club Drive, as shown on the Plat . of Tequesta, more
particularly described as follows, to wit:
The easternmost fifteen feet ( 15' ) of the
southernmost seven hundred three point thirty-
- one feet ( 703. 31' ) of the thirty foot ( 30' )
right-of-way, identified as Tequesta Drive, and
commonly known as Country Club Drive, on the
Plat of Tequesta, as. recorded in Plat Book 25,
Page 8, Public Records of Palm Beach County,
Florida.
be and the same, is hereby vacated and abandoned.
THE FOREGOING RESOLUTION was offered by Councilmember
who moved its adoption. The
motion was seconded by Councilmember
and upon being put to a vote, the vote was as follows:

Dear Property Owner:
As owner of property in the Village of Tequesta,
adjacent to a right—of—way, a portion of which is proposed to be
abandoned in accordance with the attached proposed Resolution No.
07-90/91, and as a matter of courtesy, this letter is intended to
notify you of a Public Hearing scheduled for February 14, 1991
beginning at - 7: 00 P. M. in the Council Chambers of the Village
Hall, 357 Tequesta Drive, Tequesta, Florida, in which this subject
will be discussed and voted upon by the Village Council . You are
invited to comment on this proposal in writing prior to the
Hearing by addressing correspondence to my attention at the
letterhead address, or you may be heard in person during the
Hearing.
