SUBJECT: Ordinance No. 419, Second Reading; Agenda Item
Attached hereto, please find a report that I requested from Greg
Spencer regarding the impact of the Ordinance and referendum on
the location of Station 11. It appears that the Village has
more control relative to guaranteeing the location of Station 11
in Tequesta if we continue to contract with Palm Beach County
and not include ourselves within the Fire-Rescue MSTU.
Alternatives to protecting the Village are referenced and may
prove to be acceptable from the Village's perspective. However,
it would take time to determine whether these alternatives will
suffice.
In light of this situation, I recommend that we postpone Second
Reading of Ordinance No. 419. Should we wish to revive the
issue, we can do so between now and fall of this year and still
meet the deadline for removing the cost of fire-rescue from our
millage effective October 1, 1992.

Preliminary Report
DATE: January 29, 1991
This is a preliminary report reference the proposed referendum
on dissolving the Village Fire-Rescue contract and joining the
Palm Beach County Fire-Rescue MSTU . This report is based on
phone conversations with Battalion Chief Thomas Murphy , Palm
Beach County Fire-Rescue, between January 25th and January
29th, 1991 .
I contacted Chief Murphy on Friday, January 25th, to discuss
some points of interest that developed subsequent to the first
reading of a proposed ordinance on joining the MSTU.
The main topic focused on assurances from Chief Brice during
the preceding months that Station 11 on Seabrook Road would
remain in Tequesta and that this assurance could be
incorporated into the Service Contract between both parties.
What impact would the ordinance and referendum have on the
location of Station 11?
1 . I•f the current contract were maintained, County Fire-
Rescue would incorporate wording to guarantee that
Station 11 would remain in Tequesta.
2 . If the current contract were dissolved, and Fire-Rescue
was delivered within the MSTU, no guarantee would be
incorporated into the existing contract.
Alternatives available under Option 2 are:
A) Have the Board of County Commissioners issue a
legally binding letter of assurance. This,
according to County Attorney Denise Desill is
the most appropriate and expeditious . This _
would be initiated by Chief Brice after the
referendum.
B) Incorporate wording into land lease for Station
11 on Seabrook Road. The land contract is
scheduled for renegotiation in 1991 and an
agreement included herein could assure the
station as is for the next fifteen years or
extended duration of the contract . However,
Chief Murphy did indicate that since we can
anticipate growth in the surrounding area, the
county will have the operational need to increase
the size of the station or add more apparatus .
The county may not want the existing building but
would be willing to relocate within the Village
at another location
C) Enter into another, yet undetermined contract or
commitment from the county so as to assure the
location of a fire station.
Chief Brice has already made a written letter of commitment to
the Village Council in December , 1990 .
As a matter of timing, the earliest inclusion into the MSTU
would be October , 1992 as at least nine months notice must be
given to the property appraiser, according to Florida
Statutes , Chapter 125 .
Each of these options will be discussed further and if any
changes or other options are available I will advise.
