Re: Application for Zoning Text Amendment
Dear Mr. Ladd:
Thank you for the copy of the proposed Zoning Text Amendment
to Ordinance 355 . I believe that the proposed amendment language
is fair and well drawn. However, to avoid any future controversy
over accessory buildings, I would suggest the following additions
to your proposed ordinance
1 . The first phrase could be enlarged to more specifically
define "Churches" as including accessory buildings with the
following:
"15 . Churches, which shall be deemed to include
buildings for religious services and accessory
buildings for administrative offices, grounds and
building maintenance, religious education, and
congregational gatherings, subject to the following
conditions : . . . " . (Proposed addition underlined)
• 2 . If you find the proposed revision above acceptable then
subsection "b" should also be revised to be consistent :
"b. Religious services Churches shall be within a
free-standing Churgh building. (Additions
underlined, deletions stricken)
Please consider these revisions to the proposed Zoning Text
Amendment for possible insertion prior to first reading. I will ,
of course, be at the Village meeting to discuss the terms of this
letter, or you may contact me at your convenience at 627-2112 .

ORDINANCE NO. .___
AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF
TEQUESTA, PALM BEACH COUNTY, FLORIDA, AMENDING ZONING
ORDINANCE NO. 355, AS AMENDED, BY AMENDING SECTION VII,
SCHEDULE OF REGULATIONS, BY ADDING ADDITIONAL SPECIAL
EXCEPTION USES TO THE C-2, COMMUNITY COMMERCIAL
DISTRICT FOR CHURCHES AND PUBLICLY OWNED AND OPERATED
COMMUNITY BUILDINGS; PROVIDING FOR REGULATIONS AS TO
CHURCHES; PROVIDING FOR SEVERABILITY; PROVIDING FOR
CODIFICATION; PROVIDING AN EFFECTIVE DATE.
NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE COUNCIL
OF THE VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, AS
FOLLOWS:
Section 1. Section VII, Subsection ( D) , Paragraph
( 6)( d) of the Official Zoning Ordinance of the Village of
Tequesta, Ordinance No. 355, as amended, is hereby amended by
adding additional Special Exception Uses to the C-2, Community
Commercial District, identified as No. ' s 15 & 16, to read as
follows:
15. Churches, subject to the following conditions:
a. The minimum lot size shall be five ( 5) acres
under Unity of Title, the sole use thereof to
be for church use.
b. Churches shall be within a free—standing
building.
c. Churches shall be prohibited within a
shopping center, mall, storefront or other
retail facility.
16. Publicly owned and operated community buildings.
Section . 2. Severability. If any provision of this
Ordinance or the application thereof is held invalid, such
invalidity shall not affect the other provisions or
applications of this Ordinance which can be given effect
without the invalid provisions or applications, and to this
end the provisions of this Ordinance are hereby declared
severable.
S_ection_ 3. Codification. This Ordinance shall be
codified and made a part of the Official Code of Ordinances of
the Village of Teguesta, Florida.
Section 4. Effective Date. This Ordinance shall take
effect immediately upon its passage and approval, as provided
by law.
