Regular Council STAFF MEMO Y Meeting: Regular Council - Mar 14 2024 Staff Contact: Wayne Cameron Department: Building Consider approval of Special Event permit application for Farmer's Market event by Gallery Square North property owner, Eric Peterson (see attached Special Event Permit Application), to take place at 361-389 Tequesta Dr, Gallery Square North Plaza. The event is to be held on Saturdays, from March 16th to May 25th, from 8am to 1pm. This is a special event permit application to take place on Saturdays from March 16th to May 25th, 2024 from 8am to 1 pm in the parking lot of Gallery Square North, located at 361-389 Tequesta Dr. Each Saturday, the market will host 15-20 vendors, showcasing and selling their diverse range of products. The event will be sponsored by Fitnest and Marie Antoinette's business owner and one of the Gallery Square North owners, Eric Peterson. Written Consent from Lighthouse Art Center, also property owner, and Good Shepard Church for parking overflow have been provided with the special event permit application packet (attachment 1). In accordance with Village of Tequesta Code of Ordinances Sec 78-561, we acknowledge that a maximum of four permits is allowed per address or business in any single calendar year. Given that the proposed Farmers Market exceeds the number of events sponsored by the same business, council approval is now sought. The attached Special Event Permit Application, has been reviewed by the Police Department, Fire Department, Building Department, and Village Manager (attachment 1). Additionally, we have included a Farmer's Market Proposal Presentation (attachment 2) and a request for sponsorship letter (attachment 3) for your review. Inspection to be done on the first day of event. • By submitting a complete application, the applicant expressly agrees that it shall indemnify,defend and hold the Village harmless from any and all damage to any real or personal property,and from any and all injury or death suffered by any person directly or indirectly related to the consumption of alcoholic beverages in conjunction with the special event. Non-Profit Enterprises: • The Village may issue non-profit permits to any person or organization for the conduct or operation of occasional sales and/or fundraising projects held by non-profit enterprises, either regularly or temporarily,when the applicant signs an affidavit that the applicant operates without private profit, for a civic, public, charitable,youth, service,educational, literary,fraternal, or religious purpose. A person making application under this section must comply with all rules and procedures for the granting of special event permits as set forth in this section.All persons operating under a non-profit permit shall operate their non-profit enterprise in compliance with this section and all other rules and regulations of the Village. Required Documents The following items must be submitted at the time of application: • Summary of event on official letterhead of organization, signed by the applicant • Proof of insurance in amounts acceptable to the Village for the type of event.The Village shall be named as additional insured on all liability insurance (not a certificate holder). ■ Expected traffic,fire-rescue, and utilities impact, if any,and proposed mitigation plans. • Copy of all required state and county permits if event will be held on or utilize state and/or county- controlled property. • A refundable deposit is required if the event is held on any Village property. Site Plan required with each application accompanied with drawing indicating layout for event. o All event sites shall be left in a clean and orderly manner upon completion of event. Special Event Fees • Under 200 attendees: $40.00 • Over 200 attendees: $100.00 • Per Village Resolution 36-19, fees for property owners that are 501(c)(3) non for profit entities shall be reduced by 50%. Over the last 3 weeks we have seen a wonderful show of support, families a re together shopping,the village's sidewalks have been f u I I of people walking to our ma rket and the local shops and business are also benefitting from the attendance. I believe we have provided a nice event for our residents to enjoy on Saturday mornings. ( have been present at each market the entire time and have not witnessed any parking or traffic issues.The overflow parking lot is working as planned and many visitors are walking, biking and using golf carts.VVe have contained our market tothe original area as proposed,the northeast section of the parking lot that shares a wall with the fire department which allows for about 9596 of the parking lot to still be utilized. We plan to have 15 to 20 vendors. We would like to hold this event on each Saturday morning in the month of February from Sam to noon. Our intent is to provide the Village of Tequesta and neighboring communities a Farmers Market where local vendors can have the chance to showcase their businesses. All vendors will be setup on the east side of the parking lot up against the concrete wall shared with the fire department property. Both the entrance and exit to Gallery Square North will be fulling functioning,and 95%of the parking lot,we also have permission from Good Shepard Episcopal Church for overflow parking.Please see diagram and photos below. The applicant shall provide contact Information, including name and contact information for on-site event management for each date of your event. This information shall be relayed to the fire department prior to the event. 2. The applicant will not exceed the Occupant load of any businesses or buildings. 3. The applicant will maintain emergency vehicle access and egress throughout the event. Fire Lanes and Fire Department access shall be maintained open. 4. The applicant shall be responsible for maintaining crowd control and have an evacuation plan. Planning should include considerations for civil disturbance and crowd control 5. The applicant shall have a plan for Severe weather conditions, including response to changing weather as well as predicted weather.
