Bradford, Village Manager %�� ' Date: September 26, 1996 Subject: Appointment of Special Master; Agenda Item Section 2-92 of Ordinance No. 522 sets forth the terms for appointment of the Code Enforcement Special Master. The Special Master shall be designated by the Village Council for a term of two years. The Special Master shall be an attorney and a member of the Florida Bar. The Special Master serves at the discretion of the Village Council and may be removed from such position with or without cause. Attached hereto, please find copies of the resumes of those attorneys who responded to our advertisement for the Special Master position. Based upon her experience in this specific field, Village staff recommends the selection of Paulette Torcivia as she meets the requirements of Tequesta' s ordinance. Per your request, Ms . Torcivia will be present at the meeting to be introduced to you and allow you to ask any questions you may have. It is recommended that the Village Council appoint Ms . Dear Your Honor and Council Members, As a member of the Tequesta Country Club Community Code Enforcement Committee,I am familiar with current problems the village faces regarding the way some homeowners maintain their property. As we approach the year 2000 we must not allow the village to become a mixture of beautiful homes in between ramshackle dwellings. However,one should temper that thought to distinguish those who merely made a poor decision in color selection versus one who neglects the property altogether. In other words all violations must be addressed but the penalties may vary. I have participated in various means of code enforcement since 1975 thanks to the United States Army. These activities ranged from personnel to entire compounds supporting extremely sensitive materials or projects. Consequently, I have performed these tasks on four continents dealing not only with the Department of Defense Codes but the host nation laws were applied as well. As an attorney,I interpret the statutes of Florida on a daily basis. Thus the opportunity to interpret Village Codes and apply them to individual cases should require the same amount of diligence. As a student in Law School,I was a Justice on the school Honor Court. On occasion the Honor Court would conduct hearings regarding a cheating incident. As difficult as it was to judge fellow students with their careers at stake I was able to render decisions in every case. I believe this background gives me the confidence to render a decision objectively without collateral influence. Otherwise,the Special Master's decisions will be undermined with ridicule as any judges decision could.
