Bradford, Village Manager-?, Date: September 16, 1996 Subject: Ordinance Designating Fire Chief as Civil Defense Director in Lieu of Police Chief; Agenda Item Chapter 6.5 of the Code of Ordinances, entitled Civil Defense and Disaster Management, sets forth the chain of administrative responsibilities, issuance of warnings, and designates the Civil Defense Director. Currently, this Chapter designates the Chief of Police as the Civil Defense Director. Most civil defense activities in the Village of Tequesta pertain to disaster management and, specifically, hurricane preparation, evacuation, and post-hurricane activities . The Ordinance designating the Police Chief as the Civil Defense Director was drafted prior to the creation of the Tequesta Fire-Rescue Department. Since the Fire-Rescue Department already has a hazardous materials component which is related to civil defense and since hurricane preparation and disaster management activities are traditionally handled by fire-rescue departments in Palm Beach County, it has been our goal to formally transfer this responsibility to the Fire-Rescue Department by naming the Fire Chief as the Civil Defense Director. I have discussed this matter with the Fire Chief and he is agreeable to the same. With us coming upon the conclusion of the 1996 Hurricane Season, the relatively recent appointment of Chief Allison to oversee the Police Department and with the Fire-Rescue Department coming upon its 3rd anniversary, it is felt that now is a good time to make this formal change. It is recommended that the Village Council adopt the proposed Ordinance naming the Fire Chief as the Tequesta Civil Defense Director. AN ORDINANCE OF THE VILLAGE COUNCIL OF THE . VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, AMENDING SECTION 6.5-3 SO AS TO PROVIDE FOR THE FIRE CHIEF TO BE THE CIVIL DEFENSE DIRECTOR; PROVIDING FOR SEVERABILITY; PROVIDING FOR CODIFICATION; PROVIDING FOR THE REPEAL OF CONFLICTING ORDINANCES; PROVIDING AN EFFECTIVE DATE. NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, AS FOLLOWS: Section 1. Section 6.5-3 of the Code of Ordinances is hereby amended to provide that the Fire Chief shall be the Civil Defense Director, to read as follows: • "Sec. 6-5-3. Civil Defense Director. For purposes of this Chapter, the Fire Chief of the Village of Tequesta Department of Fire-Rescue is the Civil Defense Director. " Section 2. Severability. If any provision of this Ordinance , or the application thereof is held invalid, such invalidity .ishall not affect the other provisions or applications of this hOrdinance, which can be given effect without the invalid • • H provisions or applications, and to this end, the provisions of I! this Ordinance are hereby declared severable. liSection 3. Repeal of Ordinances in Conflict. All other hOrdinances of the Village of Tequesta, Florida, or parts ( thereof which conflict with this or any other part of this 11Ordinance, are hereby repealed. !'
