Subject: Ordinance Establishing Ambulance Transport Service and
User Fee Rates for Same; Agenda Item
The attached Ordinance was reviewed by the Finance and
Administration Committee at their meeting held on October 30,
1996 . It is the Committee ' s recommendation that the attached
Ordinance be approved by the Village Council . The Ordinance
establishes a transport fee of $310 . 00 per call and a $6 . 00 per
mile mileage fee.
It is recommended that the Village Council adopt this Ordinance.

AN ORDINANCE OF THE VILLAGE COUNCIL OF THE
VILLAGE OF TEQUESTA, PALM BEACH COUNTY,
i FLORIDA, AMENDING CHAPTER 9 OF THE CODE OF
ORDINANCES RELATING TO FIRE PROTECTION AND
; PREVENTION SO AS TO PROVIDE FOR THE
ESTABLISHMENT OF A PRE-HOSPITAL EMERGENCY
MEDICAL CARE SERVICE; PRESCRIBING REGULATIONS
GOVERNING THE SERVICE; ESTABLISHING USER FEE
CHARGES FOR SUCH SERVICE; PROVIDING FOR OTHER
PROVISIONS RELATING TO FIRE MEDICAL CARE
I WITHIN THE VILLAGE OF TEQUESTA; PROVIDING FOR
SEVERABILITY; PROVIDING FOR REPEAL OF
ORDINANCES IN CONFLICT; PROVIDING FOR
CODIFICATION; PROVIDING AN EFFECTIVE DATE.

Section 1 . Chapter 9 of the Code of Ordinances of the
'! Village of Tequesta relating to Fire Protection and Prevention is
H hereby amended to include a new Article IV, entitled "Pre-Hospital
Emergency Medical Service" to read as follows :
"ARTICLE IV. PRE-HOSPITAL EMERGENCY MEDICAL SERVICE

Sec. 9- Supervision of pre-hospital emergency
medical service.
The Chief of the Fire-Rescue Department shall plan,
direct, control and coordinate the pre-hospital emergency
II medical services activities within the Fire Rescue
Department for the Village of Tequesta and other areas of
the Village it is obligated to service.
Sec. 9- Regulations governing service.
The Chief of the Fire Rescue Department shall assure
that every primary emergency medical response unit which
responds to medical calls within its service area be
staffed as an advanced life support unit as set forth in
Florida Administrative Code Rule 10D-66 . 050 . All
advanced life support units shall operate in compliance
with all requirements of the Florida Statutes and Florida .
Administrative Code and be equipped as required by all
such rules.._and. regulations governing_ the 'provision-of
li advanced life support services.

II Sec. 9- Levy and purpose.

For the purpose of regulating the use of the pre-
I: hospital emergency medical care system in the Village of
Ii Tequesta so as to assure that every user 'bears a
proportionate share of the costs of fire rescue emergency
medical system and to help defray the costs attributable
to this service within the Village limits and service
I' areas, user fees are hereby levied on every user of the
i. pre-hospital emergency care system in accordance with the
schedule of fees and other provisions of this chapter.

Sec. 9- Determination of fee amounts.

II The pre-hospital emergency care user fees shall be
determined and reviewed annually in accordance with a
detailed analysis of associated costs. The purpose of
this review is to evaluate the level of service for the
pre-hospital emergency medical 'care system to determine
whether it should be adjusted based on changed
conditions, to analyze the effects of inflation or other
�i cost factors on the actual cost of providing such
I services, and to ensure that the user fees charged will
II not exceed its reasonably anticipated costs of fire
II rescue pre-hospital emergency medical care system. The
Village Council may annually adjust the established user
fee rates to reflect changes in the cost of relevant
I capital purchases and equipment. All changes or
adjustment in the established user fee rates shall be
1i made by ordinance or resolution and shall apply after the
: effective date of such modification.

Sec. 9- Schedule of user fees.

I! The initial fire rescue pre-hospital emergency medical
I! care system user fees for emergency medical care
I treatment and transportation within the service areas
I! shall be as follows :

11 Emergency Medical Treatment $ 0 .00
;I Emergency Medical Transportation $310 .00

Plus, per mile charge, pickup to hospital $ 6 .00
II Fire rescue emergency medical care service user fees
I shall be paid, in cash, no in-kind contribution for such

Section 2 . Severability. If any provision of this
II Ordinance or the application thereof is held invalid, such
I invalidity shall not affect the other provisions or applications of

11 provisions or applications, and to this end, the provisions of this '.
Ii Ordinance are hereby declared severable. `

Section 3 . Repeal of Ordinances in Conflict . All other
11 ordinances of the Village of Tequesta, Florida, or parts thereof
h which conflict with this or any part of this Ordinance are hereby
T repealed.

h Section 4 . Codification. This Ordinance shall be codified .
ii and made a part of -the official Code of Ordinances of the Village .

it Section 5 . Effective Date. This Ordinance shall take
m effect immediately upon its passage and approval, as provided by
11 law.
