Subject: Engineering Services Agreement Phase II - Final
Design, Reverse Osmosis Treatment Plant
Please find attached, for your review and Council approval, two
sets of an engineering services proposal from Mr. Bill Reese of
Reese, Macon & Associates, Inc. , Lake Worth, Florida, in the
amount of $235, 000 . 00 . Execution of this agreement will allow
Mr. Reese to complete final design of the treatment facility, raw
water piping for the two on-site wells, and piping for the reject
disposal line to.. the,. outfall located at the Jupiter Inlet east of
the U.S. 1 Bridge.
In addition to the above fee, Mr. Reese is recommending we
allocate an additional $45, 000 to pay for permit fees associated
with the Plant, reject main and engineering cost associated with
acquiring DEP Industrial Waste Permit and the ERP Environmental
Resource Permit and RO Well No. 2 design. Total funds needed
will then be $300, 000 . 00 for the above tasks.
The Finance Director is optimistic that these funds are available
from current retained earnings. of the Water Enterprise Fund.
Upon closing of the FY 95/96 books, the required funding will be
confirmed.
Please place this item on the Village Council agenda of
November 14, 1996 for review and approval .

Engineering Services,Phase II-Final Design
Gentlemen:
We are pleased to submit this proposal for engineering services in connection with engineering services
for the Village's reverse osmosis treatment plant. REESE,MACON and ASSOCIATES, INC.,
hereinafter referred to as the Engineer, shall perform the services as documented below for the Village
of Tequesta,hereinafter referred to as the Client.
SCOPE
The Engineer and Client understand that this work shall be for engineering services related to an
approximate ultimate 4.0 MGD R/O facility,initially sized for 1.0 MGD. This work includes all
facilities located on the plant site including raw water piping to the two(2)proposed on-site wells and
piping for the reject disposal along with the associated outfall structure. Note that the reject disposal
being proposed is for a direct discharge into the Jupiter inlet, east of the U.S.1 bridge. This work
excludes any well design and associated specifications for the second well. The preliminary design,
Phase I, was authorized on February 23, 1996. The Client understands that this proposal work will be
to authorize the Engineer to proceed with final construction plans and specifications(Phase II). The
Client further understands that Phase I and II work collectively, includes submittals and processing of
all permits related to this project. Construction related services will be performed under Phase III.
The following specific tasks will be performed by the Engineer as authorized:
Phase II-Final Design
1. Prepare final design plans and outline specifications.
2. Prepare an updated construction cost estimate based upon the final design.
3. Provide engineering services.related to the processing of permitting applications and
approvals. Note that permit submittals will be made under Phase I work previously approved.
4. Advertise the project,-attend bid opening, evaluate the bids and make a recommendation of
award.
5. .Prepare contract documents for execution by the Village and successful Contractor.

Phase III- Construction Services __._
1. Perform construction contract administration services to include all engineering duties set forth in the
General Conditions and Supplementary General Conditions.
2. Provide a resident project representative.
The above scope is predicated on the assumption that the Client shall furnish, at no cost to the Engineer, all
available pertinent information including previous reports,plans,specifications,permits and other data relevant
to the performance of the above services for the project.
The following specific information and/or items shall be furnished at no cost to the Engineer:
1. Surveys: topographic,property, boundary, permanent reference-monuments:
2. Appropriate professional interpretations.
3. Data prepared by or services rendered by others such as subsurface explorations laboratory tests and
inspections of samples.
4. All permit application and government inspection fees.
5. Title search and abstract of property.
TIME OF PERFORMANCE (Phase II)
The Engineer will complete Phase II work within 240 days of receipt of authorization, exclusive of delays
beyond the control of the Engineer.
Phase II-Final Design
For Scope Items 1 -5 under Phase II,the Engineer shall be paid a lump sum fee of Two Hundred Thirty Five
Thousand Dollars($235,000).
Phase III - Construction Services
The fees for this phase cannot be fully determined until the specifics of the design are completed. Therefore,
the fee associated with Phase III will be determined within 45 days prior-to completion of,Phase II. The-fees
will be submitted for acceptance prior to commencement of any work on this phase. The Engineer will not
perform any work under this phase until the Village has reviewed and accepted the proposed fee.
Invoices for services rendered are issued on a monthly basis and are due within thirty(30)days of the invoice
date. Interest at a compound rate of one and one-half percent per month shall be charged to any past due

COST ESTIMATES
Construction cost estimates are developed from knowledge of market conditions and based on the experience
of the Engineer. However,the Engineer exercises no control over the competitive bidding process and,
therefore, makes no guarantee of the accuracy of the estimate when compared to previous estimates or actual
bids.
TERMINATION
This agreement may be terminated by either party by giving thirty(30) days written notice. The Engineer shall
be paid for all services rendered prior to the termination date.
ACCEPTANCE
Acceptance of this proposal may be indicated by executing this document in the space provided below. The
Engineer shall proceed with work on only the specific phase(s) authorized by the Owner. The Engineer
understands the Owner's intent to issue separate authorizations for each phase. This contract shall be
considered void if not executed within thirty(30) days from the above date. Upon execution of this agreement
the Client shall return one copy to the Engineer.
