Elwell, Chairman Town of Briny Breezes SUBJECT: RELOCATION OF THE COASTAL CONSTRUCTION CONTROL LINE City of Delray Beach (CCCL) THROUGHOUT PALM BEACH COUNTY Town of Gulf Stream Town of Highland Beach At the October 21, 1996, meeting of the Beaches & Shores Council , Town ofjunoBeach Highland Beach Mayor Arlin Voress (Chairman of the Coastal Communities Coalition) and County Connlssloner Mary McCarty provided Town of Jupiter an update of the subject matter. Mayor Voress and Commissioner f ter Inlet colon McCarty advised that the State intends to establish the relocated Town o Jupiter y line as proposed in 1992, unless all 19 coastal municipalities h,plter Inlet District approve delegation of this authority to Palm Beach County. City of Lake Worth Such delegation would enable thl CCCL to be relocated throughout the Town of Lantana County using a 'zonal approach. ' The zonal approach would employ a scientifically appropriate methodology to account for the unique Town of Manallapan characteristics of the shoreline In different parts of the County. Calk) —"= As all of you are aware, in 1992 the then DNR (now DEP) proposed to establish a new Coastal Construction Control Line (CCCL) in Palm Beach County under Florida $ttatuts 161. Public Hearings were held in the county and many di eed with the proposed positioning of the line. The Coastal itie■ Coalition was formed in 1992, in ' an effort to assist many concerned parties along the coact and to tell their story to DIP. Over the intervening time, much work has been dons by many, in looking at the model wed by the State, to develop the CCCL proposal. While the PEER review group that assessed the $300M study of the model, reported their concerns with the model, the DEP is not able to accomodats "some of the unique features of our coastal area into their activities. Hence, the DIP will use the existing CCCL proposal, or some small modification thereof, to set the new CCCL in the county. The DEP is willing to delegate this authority to the County only if all coastal communities agree. Such delegation would allow a "zonal" approach in setting the line, to accomodate local sone characteristics, in the county. The County would only be interested in such an activity if all of the coastal municipalities requested such action. The matter of immediate concern deals with the decision of whether or not the determination of the final location of the Coastal Construction Control lime should be turned over to the County or not.The matter is well laid out in the article[a copy of which is attached) but requires a couple of additional comments. I. You should be receiving a FAX today asking whether or not the village would prefer to have to County do the engineering or allow the line to remain as the State has already located it. The cost would be approximately S300.000 and would probably be split on a % of shore line in the particular community. in our case that would be about one and one half miles out of 48 or approximately S7,500. The village will have to sign a contract if all communities agree and be involved in the process with the County. 2. Please note that if one community says "no" the proposal to turn it over to the County will be dropped. 3. A vote on this matter will be held at the November meeting of the Countywide Beaches and Shore Council on November 12, 1996. No response will be counted as a "no" vote. 4. Dear Tom, You sent me an info copy of the Ref. meeting notice. I will be out of town on that date and unable to attend. I believe Tequesta should be represented, however, if only to keep informed as to proposals regarding relocation of the CCCL. Mr. John Holton, Alternate Representative to the Palm Beach Countywide Beaches & Shores Council, has expressed interest and may attend the meeting. Personnally, I am somewhat skeptical regarding special pro- visions for P B County to do its own relocation of the CCCL. This relocation is proposed for all of Florida's coastline, not just P B County alone and a "zonal approach should not be limited to one county alone. Any unique features of P B County's coastline surely overlap into adjacent counties. A much larger, regional, approach might be realistic but that's basically what DEP is proposing for the whole project. I think that objections to DEP's CCCL relocation proposal can only be made on a scientific, technical basis and not on a political or economic basis. Meeting, attendees should include technical Professionals, not just municipal managers and electees. I suggest that. DEP be encouraged to proceed with their current plans. Technical objections and cI nges can legitimately be made at any time in the future, no matter where the actual line is located. Sincerely, William D. It is my current intention to have the Village Council take formal action on the survey presented in Mr. Elwell ' s memorandum at their meeting on November 14, 1996 . I am certain the Village Council would appreciate hearing from the Beach Road Association relative to delegation of CCCL authority from the State to Palm. Beach County. If possible, would you please provide me with a position statement of the Beach Road Association regarding this issue? If time or other constraints make this request impossible, please let me know so that I may pass this on to the Village Council during their deliberations . If at all possible, I need to hear from the Beach Road Association by November 7 , in time to include your comments with the agenda back-up materials delivered to Village Council on November 8 for their November 14 Village. Mr. John Holt, Tequesta Alternative Representative - Palm Beach Countywide Beaches and Shores Council, spoke to the assembled condominium presidents, and or their representatives. Following discussion, a unanimous motion was passed directing my response as follows. It is the considered opinion of the Beach Road Association that the State of Florida should be empowered to establish the relocated line as proposed in 1992, and that the authority should not be delegated to Palm Beach County.
