-MEMORANDUM TO: Thomas G. Bradford, Village Manager FROM: Scott D. Ladd, Building OfficialDATE: December 5, 1996 SUBJECT: Public Hearing for Special Exception Use (Church Affiliated Elementary School) Public Hearing for Variance Request for Parking Site Plan Review (13,500 sq.ft. School & Minor Storage Addition to Parish Hall) Episcopal Church of the Good Shepherd 400 Seabrook Road, Tequesta Tom, attached are eighteen (18) packets of revised plans and other support documents that go with the original packets that went out for the November 14, 1996 meeting for the above referenced Public Hearings (special exception use and variance) and site plan review. Please place these items on the agenda of the December 12, 1996, Village Council meeting. This item was originally presented at the November 14, 1996 Council meeting wherein the Council approved the minor storage room addition and tabled the remainder of the proposed project until the December ,12, 1996 Council meeting. The Council also directed the applicant, Village staff and the affected residents to meet in a workshop to resolve their differences and\bring back a revised proposal to the Council on December 12, 1996. The workshop was held on November 21, 1996 at 4:00 P.M. in the Parish Hall at the Church of the Good Shepherd. The workshop was attended by sixteen (16) individuals (see attached sign-in log). The workshop lasted until 6:00 P.M. and was very productive. The results of the workshop are also attached. The main emphasis was on locating the proposed school facility farther north in order to then relocate the fenced in play area to the south side of the building between the school facility and the Village Hall annex building. This site configuration would provide the greatest buffer to the surrounding residential properties. All of the agreed upon conditions will be set forth in a Developers Agreement that the applicant is currently drafting. Staff recommends approval. Special Exception: An examination of the special exception criteria by staff indicates the following: O The proposed use is a valid use for consideration by the Village Council. . o The proposed use is designed, located and proposed to be operated so that the public health, safety and welfare will be protected. o There should be no adverse affect on the value of surrounding properties. O The use is compatible with adjacent development and the character of the zoning district where it is to be located (R-1, Single-Family Dwelling District). • t Page 2 Episcopal Church of the Good Shepherd 11-14-96 0 Adequate off-street parking has not provided in accordance with the code requirement and a variance is being requested. Ingress and egress is provided and causes minimal interference with traffic on abutting streets. 0 The use conforms with all applicable regulations of the R-1 Single-Family Residential District. Additionally, attached for Village Council consideration are the applicable factors as set forth in Section (J), Subsection (3), items (a) through (I). Variance: The applicant has requested a variance for the required number of off-street parking spaces. Section VIII. Off-street and on-street parking and loading regulations, required that for mixed-uses, the total requirement for off-street parking shall be the sum of the requirements of the various uses computed separately. Therefore, in order to comply with the code, the Church would have to provide parking as follows: Church 63 spaces Office 16 spaces Parish Hall 19 spaces Thrift Shop 7 spaces School 26 spaces TOTAL 131 spaces The Church currently has 70 parking spaces and will provide an additional 9 spaces, for a total of 79 spaces in lieu of 131 as required by the code. All parties, including village staff and the Mayor of Tequesta, met on November 21, 1996, at 4:00 p.m. December 4, 1996 1) It was agreed upon that the proposed location of the new school building will be • moved further to the north. The proposed location of the new playground will be relocated to the south side of the new school building, placing it between the proposed school and the Village Hall Annex facility. 2) It was agreed upon that the applicant will clear scrub brush and other foliage that should be appropriately removed for the proposed construction along the east end of the site. The appropriate foliage for removal would include all foliage determined to be a nuisance(as listed in the Xeriscape Guide for South Florida, South Florida Water Management District) or in the way'of approved construction. 3) It was agreed upon that the applicant will plant new shrubbery, in a staggered row along the east property line, so as to reduce the intrusion of noise from church or school activities to neighboring properties. 4) It was agreed upon that a masonry wall,to be eight (8)feet high, will be placed in a curved fashion on the east side of the proposed school building. This will create an opaque view of the landscaped courtyard area of the proposed school, while also minimizing any noise created in the landscaped courtyard, and shielding any perceived, annoying sounds to neighboring properties. 5) It was agreed upon that an expansion of five(5)feet, to the existing forty-five(45) foot radius, will be added to the"drop-off cul-de-sac", resulting in a fifty(50)foot radius. 6) It was agreed upon that a solid stockade-style fence will be installed along that portion of the north property line adjoining Lot#4,Ridgewood Subdivision. And that shrubbery will be planted along that portion of the north property line adjoining Lot #'s 5 and 6, Ridgewood Subdivision. 7) It was agreed upon that all of the preceding items will be prepared by the applicant in the form of a Developer's Agreement , according to Ordinance #425, Village of Tequesta. Developers Agreement Between The Episcopal Church of the Good Shepherd and The Village of Tequesta This agreement to be in accordance with Ordinance No. 425 of the Village Council of the Village of Tequesta for the property located at: The South 275 feet, measured at right angles to the South line thereof, of that part of the Northeast 1/4 of the Southeast 1/4, lying East of the East right -of-way line of Seabrook Road, as conveyed to the county of Palm Beach by Deed recorded in Official Record Book 524, Page 211, Palm Beach County records, in Section 25, Township 40 South. Range 42 East, Palm Beach County, Florida. The Episcopal Church of the Good Shepherd, the owner of the above described property, for the purpose of the development of the proposed Classroom Additions agrees to the following: 1. Locate the Classroom Addition, North of the originally proposed location, as per the revised site plan submitted. 2. Locate the Playground, South of the building which was originally proposed to be east of the building, as per the revised site plan submitted. 3. Clear_the exotic vegetation which has been de, :-:d a nuisance from the east end of the site to be in accordance with Ordinance No, ' 11 4. Plant new shrubbery along the east property line, so as to reduce the intrusion of noise from church and school activities to neighboring properties as per revised landscape plan submitted. 5. Construct an eight foot high masonry wall on the East side of proposed new school building, which will create an opaque view of the landscaped courtyard, while also minimizing any noise coming from that area which might effect the adjacent properties, as per revised site plan and landscape plan submitted. 6. Construct the cul-de-sac with a fifty foot radius as per the revised site plan submitted. 7. Plant shrubbery along the North property line where lots 5&6 adjoin the site to create the same effect that is mentioned in item 4 above, as per the revised landscape plan submitted. 8. Tentatively agreed with Richard Carberry, the current owner of lot 4 bordering to the North property line, to construct a solid stockade-style fence to be located on the property of lot 4. Page 1 of 2 It is agreed and understood that the proper permits will be applied for and adhered to and that the development of the proposed classroom additions are consistent with the Comprehensive Plan and Land Development Regulations of the Village of Tequesta, pending the approval of the Council to grant the Special Exception Usage, Parking Variance and Site Plan Approval. Its is also agreed and understood that the failure of the developer to address a particular permit, condition, term or restriction shall not relieve the developer of the necessity of complying with any law governing said permitting requirements, conditions, terms or restrictions. This agreement shall endure for a period of five years from the date of its signing, per Section 3. of Ordinance No. 425 an Ordinance of the Village Council of the Village of Tequesta. Taylor; Rector The Episcopal Church of the Good Shepherd LatA„it/ 400 Seabrook Road Witness Tequesta, Fl 33469 Page 2 of 2 • ORDINANCE NO. 425 AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA, PROVIDING FOR REQUIREMENTS FOR DEVELOPER AGREEMENTS, PROVIDING FOR PUBLIC HEARINGS; PROVIDING FOR DURATION; PROVIDING FOR PERIODIC REVIEW AND CONSISTENCY WITH THE COMPREHENSIVE PLAN AND LAND DEVELOPMENT REGULATIONS; PROVIDING FOR CANCELLATION, MODIFICATION OR REVOCATION OF DEVELOPMENT AGREEMENTS; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL OF ORDINANCES IN CONFLICT; PROVIDING FOR CODIFICATION; PROVIDING AN EFFECTIVE DATE. WHEREAS, pursuant to S 163.3223, Florida Statutes, the Village may establish procedures and requirements to consider and enter into a development agreement with any person having a legal or equitable interest in real property located within the jurisdiction of the Village; and WHEREAS, the Village desires to regulate and provide for the ability to consider and enter into development agreements. BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA, AS FOLLOWS: Section 1. Public Hearings. (1) Before entering into, amending, or revoking any development agreement for a development as defined in the Comprehensive Plan of the Village of Tequesta, the Village shall conduct two (2) public hearings. (2) (a) Notice of intent to consider a development agreement shall be advertised seven (7) days before each public hearing in a newspaper of general circulation and be mailed before the first public hearing to all affected property owners that reside within the Village within three hundred feet (300') of the property subject to the application. The day, time, and place at which the second public hearing will be held shall be announced at the first public hearing. All advertising costs as provided herein shall be borne by the applicant. (b) The notice shall specify the location of the land subject to the development agreement, the development uses proposed on the property, the proposed population densities, and the proposed building intensities and shall specify a place where a copy of the proposed agreement can be obtained. Section 2. Requirements. (1) A development agreement submitted to the Village for consideration shall include the following: (a) A legal des•-ription of the Land subject t, he development agtee:sent ,And the ;.. of it= 1c 1•'.1 and equitable owners. kb) The duration of the development agreement. (c) The development uses permitted on the land, including population densities, building intensities and height. (d) A description of public facilities that will service the development, including who will • provide such facilities, the date any new facilities, if needed, will be constructed, and a schedule to assure that public facilities are available concurrent with the impacts of development. (e) A description of any reservation or dedication of land for public purposes on the property subject to the development agreement. (f) A description of all approved development permits or permits which need to be approved for the development of the lands. (g) A finding that the development permitted or proposed is consistent with the Comprehensive Plan and Land Development Regulations of the Village of Tequesta. (h) A description of any conditions, terms, restrictions or other requirements determined to be necessary by the Village for the public health, safety or welfare of its citizens. (i) A statement indicating that the failure of the development agreement to address a particular permit, condition, term or restriction shall not relieve the developer of the necessity of complying with any law governing said permitting requirements, conditions, terms or restrictions. (2) The Village may require that a development agreement provide that the entire development or any phase thereof be commenced or completed within a specified period of time. (3) Consideration of a development agreement by the Village shall not in any be considered as consideration of an application to amend the Comprehensive Plan of the Village. Section 3. Duration. The duration of a development agreement shall not exceed five (5) years, and may be extended by the mutual consent of the parties subject to the public. hearing requirements as set forth in Section 1. Section 4. Consistency and Periodic Review. (1) A development agreement and authorized development shall be consistent with the Comprehensive Plan and Land Development Regulations of the Village of Tequesta. (2) 'The Village shall review the land subject to the development agreement at least once every twelve (12) months to determine whether there has been good faith compliance with the terms of the development agreement. If the Village finds on the basis of substantial competent evidence there has been a failure to comply with the terms of the development agreement, the agreement may be revoked or modified by the Village pursuant to a public hearing as set forth in Section 1. Section 5, Law Governing. (1) The development of the land shall be governed by the Village of Tequesta Code of Ordinances in existence at the time of the execution of the development agreement and all applicable state and federal laws. 2 r (2) The Village may apply subsequently adopted laws and policies to a development that is subject to a development agreement if the Village has held a public hearing and determined: (a) The subsequent laws or policies are not in • conflict with the laws and policies in existence at the time of execution of the development agreement and do not prevent development of the land uses, intensities or densities in the development agreement; or (b) The subsequent laws or policies are essential to the public health, safety or welfare and expressly state that they shall apply to the development that is subject to development agreement; or (c) The subsequent laws or policies are specifically anticipated and provided for in the development agreement; or (d) The Village demonstrates that substantial changes have occurred in pertinent conditions existing at the time of approval of the development agreement; or (e) The development agreement is based on substantially inaccurate information supplied by the developer. Section 6. Amendment or Cancellation. The development agreement may be amended or cancelled by the mutual consent of the parties to the development agreement or by their successors or assigns. Section 7. Recording of a Development Agreement. Within fourteen (14) days after the Village enters into a development agreement, the Village shall record the agreement with the Clerk of the Circuit Court in Palm Beach County, Florida. A copy of the recorded development agreement shall be submitted to the state land planning agency within fourteen (14) days after the agreement is recorded. The provisions of the development agreement shall be binding upon and the benefits of the agreement shall inure to all successors in interests to the parties to the agreement. Section 8. Modification or Revocation. If state or federal laws are enacted after the execution of a development agreement which are applicable to preclude the parties' compliance with the terms of the development agreement, such agreement shall be modified or revoked as is necessary to comply with the relevant state or federal laws. Section 9. Severability. If any provision of this Ordinance or the application thereof is held invalid, such invalidity shall not affect the other provisions or applications of this Ordinance which can be given effect without the invalid provisions or applications, and to this end, the provisions of this Ordinance are hereby declared severable. Section l0. Repeal of Ordinances in Conflict. All other ordinances of the Village of Tequesta, Florida, or parts thereof which conflict with this or any part of this Ordinance are hereby repealed. Section 11. Codification. This Ordinance shall be codified and made a part of the official Code of Ordinances of the Village of Tequesta. 3 §ection 12. Effective Date. This Ordinance shall take effect immediately upon its passage and approval, as provided by law. THE FOREGOING ORDINANCE was offered by Councilmember who moved its adoption.
