Ladd, Building Official From: Damian Peduto,Planner — gt Village Manager's Office Subject: Request for Agenda Item to Be Placed on the Regular(April 10, 1997) Village Council Meeting/CDBG Citizen Participation Requirement Date: March 24, 1997 According to the general rules and guidelines for the Community Development Block Grant (CDBG), Hurricane Opal Recovery Funding Program(DR-1074), which is the current program that we are in the process of obtaining an award of$121,716.33, we must provide two(2)distinct opportunities for local citizens' comments and questions. These are required to take place either at a regular public hearing as an additional agenda item, or during a special meeting. Neither situation requires a legal notice, however, both require a general notice of meeting in a local newspaper. I have established for one of the two(2)required meetings to take place at the Village Hall on Thursday, April 3, 1997, to begin at 4:00 P.M. I respectfully request that the second of the two (2) required participation events take place as a specific agenda item on the upcoming Village Council agenda, for April 10, 1997. I have verified the specific intentions of this requirement with Ms. Margaret Peters, Department of Community Affairs, who will be reviewing our application for correct information, procedures and completeness. Ms. Peters assured that the two (2) situations described in the paragraph above, would meet the state requirement of providing an opportunity for local citizens to submit questioelvorcomments regarding the CDBG funds for which the village is currently applying. If there is any thing that I will need to prepare for the meeting, or if there is any question regarding this memorandum, please let me know. Pursuant to Emergency Rule 9B-ER96-3, Florida Administrative Code, these funds will be allocated by the Department based upon the amount of documented damage from the above referenced disasters and the availability of other supplemental recovery funds from HUD (see Attachment 1). This correspondence announces the alloc::zion of these funds and presents the selected allocation method. The amount of supplemental funds received by the Department are not sufficient to fund all of the outstanding disaster recovery projects identified by eligible local governments. Therefore,the Department has chosen to allocate the available funds based on a pro-rata share of • disaster damages documented by the Federal Emergency Management Agency (FEMA) and the U.S. Small Business Administration (SBA). This allocation process is described below: • Step 1: Determination of FEMA and SBA Disaster Damages for Eligible Jurisdictions The Department obtained the most recent available figures for eligible SBA loans, Individual and Family Grant (IFG) awarc's, Public Assistance (PA) ;.wards, and Temporary Housing (TH) assistance for the counties which were Presidentially declared disaster areas subsequent to either Hurricane Opal (DR-1069) or severe Southeast Florida flooding (DR-1074). This information is presented in Attachment 2. FEMA and SBA disaster data is provided only on the county level and is unavailable on the city level. The Honorable Janet Getting Paget 1) Local governments which received supplemental CDBG disaster recovery funds directly from HUD for the purpose of recovery. from Hurricane Opal; and 2) Local governments which did not submit any projects to the Department for funding consideration subsequent to the Department's June 5 and June 14, 1996 solicitations for disaster recovery projects This exclusion was done by eliminating these jurisdictions' damage amounts from further consideration in the allocation process, as depicted in Attachment 3. Since Fort Walton Beach and Lee County both received supplemental disaster recovery funds directly from HUD,these jurisdictions were eliminated from further funding consideration. Fort Walton Beach was eliminated from consideration by reducing Okaloosa County.'s disaster damage figures by 14:89 percent'This was done because:the p6ptilat on of Fort Walton Beach in the 1990 U.S.Census was 14.89 percent of the County's total. Calhoun,Gadsden, and Walton counties and their constituent jurisdictions were also eliminated from funding consideration,due to the fact that these jurisdictions did not submit disaster recovery projects to t'he Department for consideration. • Step 3: Initial Share Allocation Based on the percentage of FEMA and SBA damage amounts which were not excluded in Step 2 above, an initial share allocation of supplemental CDBG funds was computed (see columns 1 and 2, Attachment 4). Step 4: Redistribution of Unfeasibly Small Grant Awards All grant awards with an initial share allocation below$75,000 were redistributed to counties which had an initial share allocation above this amount(see column 3, Attachment 4). The reason for this redistribution is that very small CDBG grant awards are not administratively feasible, due to statutory and regulatory requirements which are attached to these funds. The redistributed funds($134,224)were allocated to the remaining seven eligible counties based on each county's percentage of total FEMA and SBA damage:, in those seven counties (see columns 3,4, 5, and 6,Attachment 4). Step 5: Gulf County Redistribution After the initial fund redistribution, Gulf County had an allocation of$80,384. Emergency Rule 9B-ER 96-3,.Florida Administrative Code, specifies the minimum size of any awarded gent be $100,000, in order to promote administrative feasibility. Therefore,S 19,616 was redistributed from the six counties which had an award allocation greater than S75,000. The redistributed funds were reduced from the award of the remainin- six eligible counties based on each county's percentage of total FE*lA and SBA damages those six counties(see column 7• Attachment 4). y' The Honorable Janet Getting Page 3 Step 6: Final CDBG Award Allocation A final CDBG award is hereby made to the following counties and the constituent local governments in those counties which submitted disaster recovery projects to the Department for consideration prior to July 2, 1996 (see column 8,Attachment 4): Bay County $2,173,004 City of Callaway • City of Lynn Haven City of Mexico Beach 'City of Panama City - • _ City of Panama City Beach _ . The Department will not select projects and funds will not be contracted until the chief elected official of each local government notifies the Department that they concur with the allocation amount of funds and the allocation process within the county. Projects which are eligible for further funding consideration in your jurisdiction are provided as Attachme: :5. Only these projects will be / considered for fund ing. All projects must meet the eligibility conditions delineated in Rule 9B- ER 96-3 (Attachment 1).. Section 8 housing voucher projects have been eliminated from consideration,because HUD did not make an allocation to the State for this purpose. The Department will set up a meeting in each county where an allocation has been made, in order to provide additional information regarding eligibility,to provide general technical assistance and to facilitate meetings between county and city governments. This meeting will be scheduled within 30 days of the date of this letter. As soon as the Department receives this authority and the community allocations are received,the Department will proceed to contract these funds. Our goal is to have these funds under contract within 90 to 120 days from the date of this letter. This letter also serves as a notification of administrative hearing rights. Any jurisdiction which was a Presidentially Declared Disaster Area pursuant to Hurricane Opal (DR-1069) or Southeast Florida flooding (DR-1074) AND which submitted a disaster recovery needs inventory to the Department of Community Affairs subsequent to its June 5th and June 14th requests for submission of such an inventory (henceforth, "eligible jurisdiction") has the right to an administrative proceeding pursuant to Section 120.569 Florida Statutes. If the eligible jurisdiction does not dispute issues of material fact raised by this decision, then the administrative proceeding will be pursuant to Section 120.57(2)Florida Statutes . If an administrative proceeding pursuant to Section 120.57(2) is held,the eligible jurisdiction will have the opportunity to be represented by counsel, to present to the Department written or oral evidence in opposition to the Department's action, or to present a written statement challenging the legal grounds upon which the Department is justifying its actions. If the eligible jurisdiction di )utes any issues of material fact stated in this decision,the eligible jurisdiction has the right to Lai administrative hearing before an administrative law judge of the Division of Administrative Hearings, pursuant to Section 120.57(1),Florida Statutes. A petition is f'ed when it is received by Jane Bass,Agency, Clerk, in the Department's Office of General Counsel,2555 Shumard Oak Boulevard,Tallahassee, Florida 32399-2100. The petition must include an original signature by someone authorized to act on • behalf of the eligible jurisdiction; facsimile filing of a petition 3 not permitted by department rule. A petition must specifically request an administrative proceeding, it must admit or deny each material fact contained in this decision, and it must state any defenses upon which the eligible jurisdiction relies. If an eligible jurisdiction lacks knowledge of a particular allegation of fact,the eligible jurisdiction must so state and that statement will operate as a denial. The eligible jurisdiction waives the right to an administrative proceeding if it does not file a Petition for Administrative Proceeding with the Agency Clerk within 21 days of receipt of this letter decision. Any a.peal must specify in detail the basis for review. Unless the.appeal clearly describes disputed issues of material fact,the proceeding wilrbe conducted pursuant to Section 120.57(2)Florida Statutes, and applicable rules. To the extent that the Department accepts the facts represented in the application, but denies funding based on the interpretation of law or rules, an informal proceeding is appropriate. In order to assist your local government in contracting for these available funds,the Department plans to hold a meeting on Thursday,January 30, 1997, from 9:00 a.m. to 5:00 p.m. in Conference Room A of Building 502 at 3323 Belvedere Road in West Palm Beach. The topics covered at this meeting will include: • Introductions of attendees • Discussion of potential projects and the criteria that must be met to determine eligibility • Review of CDBG program requirements • Any questions or concerns you or your staff may have Please be prepared to make a 30 minute presentation of your local government's priority projects. Oslund Page 2 a) The activity is designed to meet community development needs having a particular urgency;or b) The activity benefits low and moderate income persons;or c) The activity is determined to aid in the prevention or elimination of slums or blight. *See Attachment 2 of this letter for a description of the specific criteria and support documentation required to show that each activity carried out by the grantee meets a national objective. 4) HUD requirements that these funds must be for expenses and repairs related to the specific disaster(s)noted above**, and, a) There must be a clear and compelling need for the CDBG emergency supplemental funds for expenses and repairs related directly to the disaster; b) Of the CDBG funds available,no amount may be used for activities reimbursable by the Federal Emergency Management Agency(FEMA)or available through the Small Business Administration(SBA);and c) The activities funded must be those that would not otherwise be funded through currently available federal, state, or local resources. **The Chief Elected Official of each jurisdiction must certify that each activity meets these HUD requirements. This certification must be retained in the local government's CDBG files for future reference. Additionally, your local government must retain documentation on file which supports each of these certifications. • 5) All activities carried out with these funds must be CDBG eligible activities as defined at Section 105 of the Housing and Community Development Act of 1974 and at 24 C.F.R. Section 570.201 (see Attachment 3). Following this scheduled meeting you must negotiate with other eligible jurisdictions in your county, including the county,to allocate the available CDBG funds totaling$365,149.00 for your geographic county area. For your convenient reference,we have attached a list of all the contact people's names, addresses, and phone numbers for all the eligible jurisdictions in the geographic county area as Attachment Four(4). Following these negotiations, each local government listed must transmit a letter signed by the Chief Elected Official to DCA which states that he/she agrees with the local allocation process and identifies the proposed grant amount to be received by that jurisdiction. This correspondence informed Conunissio Board or n• ► HCD of the Town's decision to not offer support for the local negotiation and allocation process, and requested a share of the supplemental grant. The Karen T. Marcus Town of Jupiter, as one of the selected municipalities, was kept informed, in writing. Carol A.Roberts of the related State efforts. Correspondence from the State as well as from this office. Warren H.Newell stressed the importance of meeting one(1) of the three(3)National Objectives of the Community Development Block Grant (CDBG) Program; one of them being the Mary Mccarty benefit to low-and moderate-income persons. It is acknowledged that at the start of Ken L roster the process there was some confusion as to the appropriate National Objective to be met, and since it is U. S. Department of Housing and Urban Development's (HUD) preference that projects benefit low- and moderate-income persons, this office was proceeding under that assumption. To provide clarification and technical assistance to the County and all selected municipalities, the State mailed letters on January 9, 1997, advising of two•(2) meetings. The purpose of the meetings was clearly indicated in the correspondence, and it included discussion of the (3) possible National Objectives to be met. The State's first meeting occurred on January 30, 1997; the Town of Jupiter was not represented. At that meeting, the State clarified the National Objective eligibility as well as FEMA's funding role. It was also decided by those in attendance that HCD was to provide the necessary staff assistance to coordinate scheduling of the • negotiation meeting. • Our office notified each selected municipality of the scheduling of the negotiation meeting, via certified mail on February 7, 1997(Attachment II). Finally, I would like to remind the Town of Jupiter, that no application will be accepted or contracts let by the State until they have received the letter supporting the results of the local negotiations. The Town's decision of not supporting the local negotiation and allocation process may ultimately result in loss of funding not only to-Palm Beach County,but to the Village of Tequesta,the City of West Palm Beach, and the entire County, as a geographical area, if the April 30, 1997 application deadline is not met.
