FEBRUARY 5, 1997 I . CALL TO ORDER AND ROLL CALL • • The Tequesta Community Appearance Board held a meeting at - the Village Hall, 357 Tequesta Drive, Tequesta, Florida, on • Wednesday, February 5, 1997 . The meeting was called to order at 9:37 A.M. by Chair Leslie Cook. Boardmembers present were: Chair Leslie Cook, Vice •Chair Vic Strahan, Claudette Dalack, Paul Coben, and Molly McCormick. Also in attendance was Joanne McCabe, sitting in -for'Scott D. Ladd, Clerk of the Board. �. II . APPROVAL OF AGENDA The agenda was, accepted as revised with the addition of reorganization. .- III. COMMUNICATIONS FROM CITIZENS There were no communications from citizens. IV. APPROVAL OF PREVIOUS MEETING MINUTES 1 . The minutes of the Community Appearance Board meeting of January 8, 1997 were accepted with the spelling of Faxahatchee grass to be corrected on page 10. • • Recycled Paper • • COMMUNITY APPEARANCE BOARD • MEETING MINUTES FEBRUARY 5, 1997 PAGE 2 V. REORGANIZATION Boardmember Coben made a motion to nominate Leslie Cook as Chair of the Community Appearance Board for the coming year. Vice. Chair Vic Strahan seconded the motion. The vote on the motion was: Leslie Cook - for Vic Strahan - for Paul Coben - for Claudette Dalack - for Molly McCormick - for The motion was therefore passed and adopted. • Chair Cook made a motion to nominate Vic Strahan as Vice • --Chair of the Community Appearance Board for the coming fear. Boardmember McCormick seconded the motion. The vote 'on the motion was : Leslie Cook - for Vic Strahan - for- Paul Coben - for -- Claudette Dalack - for • Molly McCormick . - for The motion was therefore passed and adopted. Boardmember Coben made a motion to nominate Scott D. Ladd Cook as Clerk of the Board for the Community Appearance Board for the coming year. Vice Chair Vic Strahan seconded the motion. VI . NEW BUSINESS 1 . An application from Dailey & Associates , Inc. For the installation of a 3 ' x 6 ' wall sign, burgundy trim and copy and beige background, at 112 U.S. One North. Dan Dailey, Dailey & Associates, 112 North U.S. One, explained that his firm served as the Village' s mappers, • ' and needed a sign so people could find them. Boardmember Coben made a motion to approve the application as submitted from Dailey & Associates, Inc. for the installation of a 3' x 6' wall sign, with burgundy trim and copy and beige background at 112 U.S. One North. Boardmember Dalack seconded the motion. The vote on ttie motion was: Leslie Cook - for • • Vic Strahan - for Paul Coben - for Claudette Dalack - for Molly McCormick - for The motion was therefore passed and adopted. VI. UNFINISHED BUSINESS Vice Chair Strahan commented that as a tenant of Tequesta Plaza and as a member of the Community Appearance Board he had been approached by numerous people who questioned the appearance of Tequesta Plaza and why other people had upgraded their property to comply with Ordinance 377 and Tequesta Plaza appeared to have made no effort whatsoever to do the same. Chair Cook commented that she had also been questioned on this matter. Ms. McCabe responded that the Village had been in litigation with the owner, Mr. Felhaber, and therefore had not been able to pursue this matter. Ms. COMMUNITY APPEARANCE BOARD MEETING MINUTES FEBRUARY 5, 1997 PAGE' 4 McCabe explained that Code Enforcement Officer Davis was currently in the process of notifying everyone who was not at the point in. the compliance process that they should be, whether they were past the 30-day time period to apply for permit, whether they had been before the Community Appearance Board and had not brought in additional plans required to proceed to Village Council; or whether they had done nothing.. Officer Davis explained that the Village Attorney had advised that Ordinance 377 compliance should not be pursued in the case of Tequesta Plaza while in litigation. However, he had now been notified to proceed, and a notice was being mailed that week to Mr. Felhaber. Notices of violation were also being sent that week to everyone else who had not complied with Ordinance #377. The notices all gave ten days to comply or the case would go before the Special Master for hearing. In response to a • question' from Chair Cook, Ms. McCabe explained that Rinker was in the process of applying for permits and that a permit had been issued to them the . previous day for a sprinkler system.; and Tequesta Insurance .had been issued a permit for resurfacing and cutouts in their parking lot. • Code Enforcement Officer briefly • discussed businesses that would be sent violation notices. Officer Davis pointed out that each notice contained the reason for violation, and explained that they were at various stages in the process. Other businesses which were in the process of complying were discussed. Officer Davis commented that the Special Master system was working well. Boardmember Dalack expressed her thanks for the beautiful bright begonias planted by the Village. Tom Little, 486 Dover Road, asked whether the ordinances • under which the Community Appearance Board functioned, including Ordinance #377, were being' enforced to improve the aesthetic value of the Village as a whole. Ms. McCabe responded that the first part of the ordinance stated the intent, and a copy was available in her office or a copy was available in the Village .Manager' s office. Mr. Little COMMUNITY APPEARANCE BOARD MEETING MINUTES FEBRUARY 5, 1997 PAGE . 5 questioned whether the Tree Board was for aesthetic purposes, to which Mr. Preston responded affirmatively. Chair Cook commented on the importance of trees, and stated that was why the Village had become a tree city. Boardmember Coben commented that on several of the approvals under Ordinance _3377, the -Board had agreed to have property 'owners install trees just outside their property boundaries in the Village right-of-way. Boardmember Coben commented that the property owner would be providing maintenance for trees on Village property. Boardmember Coben questioned what type of liability would exist. in connection with those trees , citing an example of Blair House, whose Board was concerned what would happen if someone' s car hit one of those trees which was owned by their association, and who would be responsible for damage. Discussion ensued, after which Ms. McCabe stated that she would look into the matter and get an opinion from the Village Attorney as quickly as possible. VIII . ANY OTHER MATTERS • There were no other matters to come before the Board. VII. ADJOURNMENT The meeting was adjourned at 10:01 A.M.
