Each packet includes a copy of the draft ordinance and a copy of the Countywide amendments to the National Electric Code as reccomended by the Building Code Advisory Board of Palm Beach County. This is ' a housekeeping item that we are required to do every two to three years in order to keep current with our adopted construction codes. Copies of the proposed National Electric Code, 1996 edition, are available for public inspection at the Department of Community Development . Please place this item for first reading on an upcoming council meeting agenda. The Village Attorney has reviewed the draft ordinance and has approved it as to legal form and sufficiency. AN ORDINANCE OF THE VILLAGE OF TEQUESTA, FLORIDA, AMENDING CHAPTER 6 OF THE CODE OF ORDINANCES, BUILDINGS AND BUILDING REGULATIONS, AT ARTICLE III, SECTION 6-41 AND 6-42, TO PROVIDE FOR THE ADOPTION OF THE 1996 NATIONAL ELECTRIC CODE AND THE 1996 EDITION OF THE UNIFORM COUNTYWIDE AMENDMENTS TO THE NATIONAL ELECTRIC CODE; PROVIDING FOR PREVAILING STANDARDS IN THE EVENT OF CONFLICT; PROVIDING FOR REPEAL OF ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; PROVIDING FOR SEVERABILITY; PROVIDING FOR CODIFICATION; PROVIDING AN EFFECTIVE DATE. WHEREAS, the Village of Tequesta, Florida has adopted uniform building codes together with certain amendments to the codes which are intended to address specific local conditions within Palm Beach County,Florida; and, WHEREAS, new model codes have now been published in the several categories relating to building and construction, and the same have been updated and revised, including administrative changes, as recommended by the Palm Beach County Building Code Advisory Board; and, WHEREAS, the Village Council of the.Village of Tequesta has determined that the 1996 edition of the National Electric Code and the Uniform Countywide Amendments thereto, are consistent with the adopted Comprehensive Development Plan of the Village of Tequesta, Florida as required by Section 163.3194(2),Florida Statutes; and, WHEREAS, the Village Council of the Village of Tequesta, Florida deems it necessary and advisable to amend its building and construction codes by adopting the 1996 National Electric Code and Countywide Amendments as set forth herein, NOW, THEREFORE,BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA,FLORIDA,AS FOLLOWS: Section 1. Section 6-41 of the Code of Ordinances of the Village of Tequesta is hereby i j amended by adopting and incorporating into the Code the National Electric Code, 1996 Edition as fully as if set forth at length herein as the Electric Code of the Village of Tequesta. Section 2. Section 6-42 of the code of Ordinances of the Village of Tequesta is hereby amended by adopting and incorporating into the code the Uniform, Minimum Countywide Amentment to the National Electric Code, 1996 Edition, as fully as set forth at length herein. Section 3. Prevailing standards in the Event of Conflict. It is the intent of this Ordinance to maintain the highest standards for Building and Construction in the Village of Tequesta. Therefore, in the event of a conflict between the standards and requirements of the several codes hereby adopted,the more stringent provisions shall prevail. Section 4. Repeal of Ordinances in Conflict. All other Ordinances of the Village oil • Tequesta, Florida, or parts thereof which conflict with this or any other part of this Ordinance are• hereby repealed. Section 5. Severability. If any provision of this Ordinance or the application thereof isi held invalid, such invalidity shall not affect the other provisions or applications of this' Ordinance, which can be given effect without the invalid provisions or applications, and to this; end, the provisions of this Ordinance are hereby declared severable. Section 6. Codification. This Ordinance shall be codified and made a part of the official Code of Ordinances of the Village of Tequesta. Section 7. Effective Date. Mackail • ATTEST: Joann Manganiello i Village Clerk Ij ii BUILDING CODE ADVISORY BOARD OF PALM BEACH COUNTY MODEL COUNTYWIDE AMENDMENTS FOR THE 1996 NATIONAL ELECTRICAL CODE CODING: Words underlined are additions to the 1996 NEC Words stricken are deletions .to the 1996 NEC ARTICLE 90 - INTRODUCTION 90-10 - INCORPORATION OF STANDARD The Model Countywide Administrative Code is hereby adopted by reference and is incorporated as if herein, and is intended to provide for the administrative aspects of the National Electrical Code and these amendments thereto. CHAPTER 1. General ARTICLE 100 - DEFINITIONS Scope. This article contains only those definitions essential to the proper application of this Code. It is not intended to include commonly defined general terms or commonly defined technical terms from related codes and standards. In general, only those terms used in two or more articles are defined in Article 100. Other definitions are included in the article in which they are used but may be referenced in Article 100. Part A of this article contains definitions intended to apply wherever the terms are used throughout this Code. Part B contains definitions applicable only to the parts of articles specifically covering installations and equipment operating at over 600 volts, nominal. All the definitions as listed in the latest edition of the Standard Building Code shall be a part of this Code. A. General And/Or: in a choice of two code provisions, signifies that use of both provisions will satisfy the code requirement and use of either provision is acceptable also. Electrician: Is a person who is engaged in the electrical trade or business and who is qualified under the terms and provisions of this Code. Electrical Apprentice: Is a person who is engaged in learning the electrical trade by working with and under the supervision of a journeyman electrician who holds a valid certificate of competency and who shall be held responsible for the work of such an apprentice. Journeyman Electrician: Is a person qualified by experience and/or education to perform work in the electrical trade. Shall be certified by the Construction Industry Licensing Board of Palm Beach County. • 1 REV 6/21/96 H:\common\1996necAl CHAPTER 2. WIRING DESIGN AND PROTECTION ARTICLE 210 - BRANCH CIRCUITS A. General Provisions 210-1 Scope. This a tiUlu covers Lra►,cli circuits except fui brauch circuits which supply ui—y uiulvi circuits with combination leads. The provisions of this article apply to branch circuits supplvins lighting or appliance loads or combinations of both. Where motors or motor-operated appliances are connected to any branch circuit that also supplies lighting or other appliance loads, the provisions of both this article and article 430 shall apply. Article 430 applies where a branch circuit supplies motor loads only. Branch circuits shall be plainly marked at the overcurrent protective device so that they can be quickly and positively identified. Exception: Branch circuits for electrolytic cells as covered in Section 668-3(c). Exceptions No. I and 4. Section 210-8. Ground-Fault Circuit-Interrupter Protection for Personnel. (a) Dwelling Units. All 125-volt, single-phase, 15-and 20-ampere receptacles installed in the locations specified below shall have ground-fault circuit-interrupter protection for personnel. (1) Bathrooms (2)Garages and ground-level portions of unfinished accessory buildings used for storage or work area. Exception No. 1: Receptacles that are not readily accessible. Exception No. 2: A single receptacle or a duplex receptacle for appliances located within dedicated space for each appliance that in normal use is not easily moved from one place to another, and that is cord-and-plug connected in accordance with Section 400-7(a) (6), (a) (7), or (a) (8). Receptacles installed under exceptions to Section 210-8(a)(2) shall not be considered as meeting the requirements of Section 210-52(g). (3) Outdoors. Exception: Receptacles that are not readily accessible and are supplied from a dedicated branch circuit for electric snow-melting or deicing equipment as covered in Article 426 shall be permitted to be installed without ground fault circuit-interrupter protection for personnel. (4) Crawl spaces. Where the crawl space is at or below grade level. (5)Unfinished basements. For purposes of this section, unfinished basements are defined as portions or areas of the basement not intended as habitable rooms and limited to storage areas, work areas, and the like. Exception No. 1: Receptacles that are not readily accessible. [BCAB 96-16]. B. Branch-Circuit Ratings 210-26. AppIiance Branch Circuits Dwelling Unit(s). The following appliances shall be installed on a separate branch circuit: (1) air conditioners, (2'Lrefrigerators, (3) dishwashers. (4) garbage disposals, (5)microwave ovens, and(6) any appliance rated at or above 1/4 horsepower or 750 watts. [BCAB 96-21] C. Required Outlets 210-50 General. (d)Spacing. Any building to be used for other than office occupancies, warehouses used for storage only or dwelling units, shall have receptacles installed each twenty (20) feet of unencumbered wall space. All receptacles shall be installed at accessible locations and this accessibility shall be maintained regardless of wall fixtures or other modifications. Office occupancies shall have receptacles installed each twelve (12) feet of unencumbered wall space. Receptacles are not required in warehouses used for storage only. Feeder Conductors. All feeder conductors to panelboards shall be installed in an approved raceway In addition all feeder conductors to panelboards with extra circuit spaces in one and two family dwelling shall include a grounded (neutral) conductor and shall be sized not less than the equipment grounding conductor specified in section 250-95. [BCAB 96-6&96-28] • ARTICLE 220 - BRANCH-CIRCUIT, FEEDER AND SERVICE CALCULATIONS A. General 220-4 (e) General Lighting Outlets - Dwelling Unit. In dwelling units. a 15 ampere circuit may have ten(10)general lighting outlets and a 20 ampere circuit may have twelve (12) general lighting outlets. • H:\common\1996nec.6.1 5 REV 6/21/96 • ARTICLE 230 - SERVICES B. Overhead Service-Drop Conductors 230-28 Service Masts as Supports. Where a service mast is used for the support of service-drop conductors, it shall be of adequate strength or be supported by braces or guys to withstand safely the strain imposed by the service drop. Where raceway-type service masts are used, raceway shall be rigid metal conduit or intermediate metal conduit, minimum 2 , and all raceway fittings shall be identified for use with service masts. Only power service-drop conductors shall be permitted to be attached to a service mast. [BCAB 96-20] D. Service- Entrance Conductors 230-43. Wiring Methods for 600 Volts, Nominal or Less. Service-entrance conductors shall be installed in accordance with the applicable requirements of this Code covering the type of wiring method used and limited to the following-methods: (1) opeit 2) Typc IGS cable; (3) rigid metal conduit; (4) intermediate metal conduit; (5) electrical metallic tubing;. [SCAB 96-8] • F. Service Equipment- Disconnecting Means 230-70. General. (a) Location. The service disconnecting means shall be installed at a readily accessible location either outside of a building or structure, or inside nearest the point of entrance of the service conductors. If more than eight (8) feet, per set of service entrance conductors are located inside of the building as determined by Section 230-6, a disconnect with overcurrent protection must be installed at the location the conductors enter the building. Service disconnecting means shall not be installed in bathrooms. [SCAB 96-9] • H:\common\1996nec.6.t 6 REV 6/21/96 6 1 ARTICLE 250 - GROUNDING J. Grounding Conductors 250-91. Material. The material for grounding for conductors shall be as specified in (a), (b), and (c) below. (a) Grounding Electrode Conductor. The grounding electrode conductor shall be of copper. , aluu]inuu, or copper-clad alum nurn. The material selected shall be resistant to any corrosive condition existing at the installation or shall be suitably protected against corrosion. The conductor shall be solid or stranded, insulated, covered, or bare and shall be installed in one continuous length without a splice or joint. Exception No. 1: Splices in busways shall be permitted Exception No. 2: Where a service consists of more than a single enclosure as permitted in Section 230-40, Exception No. 2, it shall be permissible to connect taps to the grounding electrode conductor. Each such tap conductor shall extend to the inside of each such enclosure. The grounding electrode conductor shall be sized in accordance with Section 250-94, but the tap conductors shall be permitted to be sized in accordance with the grounding electrode conductors specified in Section 250-94 for the largest conductor serving the respective enclosures. The tap conductors shall be connected to the grounding electrode conductor in such a manner that the grounding electrode conductor remains without a splice or joint. Exception No. 3: It shall be permitted to splice the grounding electrode conductor by means of irreversible compression-type connectors listed for the purpose or the exothermic welding process. (b) Types of Equipment Grounding Conductors. Exception No. 3: When using electrical metallic tubing in an exterior use,for feeders or branch circuits, an insulated equipment grounding conductor to carry the continuous bond shall be required Chapter 3. Exception: See Section 501-4(b), Exception. ARTICLE 348 - ELECTRICAL METALLIC TUBING 348-i. Use. The use of listed electrical metallic tubing shall be permitted for both exposed and concealed work. Ferrous or nonferrous electrical metallic tubing, elbows, couplings, and fittings shall be permitted to be installed in concrete, except for slab on grade in direct contact with the earth, or in areas subject to severe corrosive influences where protected by corrosion protection and judged suitable for the condition. Conduit Bodies, Junction, Pull and Outlet Boxes to be Accessible. Conduit bodies, junction, pull and outlet boxes shall be so installed that the wiring contained in them can be rendered accessible without removing any part of the building or in underground circuits without excavating sidewalks, paving, earth, or other substance that is to be used to establish the finish grade.
