PLAN OF IMPROVEMENTS
NORTHERN PALM BEACH COUNTY IMPROVEMENT DISTRICT
UNIT OF DEVELOPMENT NO. 36
I. INTRODUCTIONS
A. General
The Northern Palm Beach County Improvement District (District) was created by Chapter
59-994 Special Acts of Florida and operates according to certain provisions of Chapter 298,
Florida Statutes and Chapter 59-994, Special Acts of Florida, as amended. The District was
created to preserve and protect water resources for sanitary or agricultural purposes or when the
1111 same may be conducive to public health, convenience or welfare. The District was subsequently
empowered to construct and maintain public utilities including water and sewer, drainage,
i irrigation, water management, roadway or related activities including offsite improvements in Palm
IIIIBeach County in an area more particularly described in the Special Act, as amended, creating the
District.
B. . Previous Investigations
-; The land area included within this Unit has experienced significant flooding in the past. In
'. 1983, the Towi\of Jupiter initiated a study to determine the cause and provide recommendations to
r__f alleviate this flooding. Early findings of the study determined that the natural drainage basin which
contributes to the reported flooding encompasses properties within the municipal jurisdictions of
the Town of Jupiter and the Village of Tequesta. Additionally, Palm Beach County had significant
involvement by virtue of roadway improvements planned for Old Dixie Highway within the Unit
boundary. Cooperative efforts among these governmental entities continued for several year to
j identify the extent of the drainage basin, identify improvements to provide positive drainage while
meeting regulatory requirements, and to develop estimated costs to implement the program. In
_` September 1991, the three governmental entities requested involvement by Northern Palm Beach
5 County Improvement District to facilitate implementation of the proposed drainage system.
On September 20, 1996, the District reviewed voting results which indicated that at least
51% of the landowners approved the formation of the Unit. On October 4, 1996 and November
I20, 1996, Resolutions designating and confirming, respectively, NPBCID Unit of Development
No. 36 were approved.

_- This Plan of Improvements is authorized by.the Board of Supervisors of the Northern Palm
Beach County Improvement District at the request of more than 51% of the current Landowners.
As a prerequisite to implementation of this Plan of Improvement, the Landowners are obligated to
disclose the existence of this Plan of Improvements to prospective buyers, pursuant to a disclosure
ti_
document to be approved by the District.
D. Acknowledgements
This Plan is based in part on data and exhibits provided by the Landowner's engineer,
Kimley-Horn and Associates, Inc., the Engineer for the Town of Jupiter.

The District Engineer would like to acknowledge the efforts of the involved governmental
entities and Kimley-Horn and Associates, Inc. in working with the District to provide information
used in this Plan.

E. Purpose and Scope
The purpose of this Plan of Improvement is to present the nature,:extent and cost of the
proposed improvements which maybe funded by the District and maintained by either the District
or another similarly empowered overnmental entity.
The text of this Plan generally describes the improvements, the estimated costs associated
with implementing the improvements and recommendations. This Plan is not intended to be used
for exact representation or for construction purposes. Detailed construction plans and
specifications will be prepared for the improvements authorized by this Plan.
F. Lands in Unit No. 36
The land area within Unit No. 36 encompasses 60.58 acres more or less and is located
within the corporate boundaries of the Town of Jupiter and the Village of Tequesta. Exhibit No. 1
shows the general location of Unit No. 36 in relation to the northern region of Palm Beach County.
The Unit Boundary map (Exhibit 2) reflects the lands to be included in Unit 36. The Legal
Description of Unit 36 is shown as Exhibit No. 3. Unit No. 36 is located south of Tequesta Drive,
west of US Highway No. 1 and State Road Alternate AIA, and north of Riverside Drive. Unit 36
lands are located within Section 31,Township 40 South, Range 43 East. Excluded from the unit is
the Florida East Coast Railroad right-of-way.

1— II. EXISTING CONDITIONS
A. Topography ,
IThe land surface in Unit 36 ranges from elevation 8.5 to 20 feet NGVD (Exhibit 4). The
lands within the Unit are developed with the exception of isolated lots. •

B. Climatolo'
Unit 36 is located in a subtropical climate zone. Winters are generally mild to dry while
summers are usually warm and rainy. The annual temperature averages approximately 75 degrees
t Fahrenheit. Approximately 70 percent of the annual 60 inches of rainfall occurs between June and
October. Maximum and minimum annual recorded rainfall in this area are 100 inches and 40
inches, respectively.

C. Soils and Vegetation
V
The United States Department of Agriculture Soil Conservation Service Soil Survey of
iPalm Beach County, Florida, identifies the existing soils in this area as St. Lucie Sand. The area is .
developed and therefore very little native vegetation exists.

D. Utilities
Potable water is provided by the Village of Tequesta and sanitary wastewater service is
provided by the Loxahatchee River Environmental Control District. Florida Power and Light
miN
Company provides electric service and Southern Bell provides telephone service.
E. Land.Use and Zoning
I A portion of Unit 36 is located in the Town of Jupiter, and a portion of the Unit is located
in the Village of Tequesta. Zoning and land use regulations are in place and administered by the
governing entity.
F. Drainage .
IThe existing drainage (Exhibit No. 4) is primarily via overland flow. There are existing
conventional pipe and inlet drainage facilities within the basin which are shown on Exhibit No. 5.

The drainage basin has no outfall facility or capability, which results in frequent and severe
flooding.

_ r A. Surface Water Management System,
1. Regulatory Requirements .

TThe proposed storm drainage collection, conveyance, and outfall facilities are designed to
satisfy the water quality requirements of SFWMD. The improvements received conceptual
approval, Permit No. 50-01859-5, from the South Florida Water Management District on May 11,
in
1989. For water quality enhancement, "Best Management Practices" and other "state of the art"
r
techniques which may arise are planned for incorporation into the construction plans for the
Project. •
A discharge capacity of approximately 80 cfs Was arrived at through the use of flood
routing calculations and is designed to prevent flood stages from reaching the lowest floor
elevations within the service area under the 100-year, 3-day storm event.
2. Description of Improvements

— Elements of the water management system for Unit 36 are shown on Exhibit 5. There are
existing facilities which collect stormwater runoff. The proposed'.improvements consist of a
conveyance system and an outfall system. The outfall system will`discharge into an existing
manmade wetland which discharges into the Loxahatchee River.

The District will require certain rights of way and easements as necessary for the operation.
and maintenance of the water management and outfall system. Included will be access to the
4 conveyance and outfall system and other areas as required.

A component of this project is the purchase of right-of-way from the FEC Railroad for
Iinstallation of the conveyance/water quality components of the system. The cost of acquiring this
right-of-way is included in the estimated cost of implementation.

Table 1 lists the proposed Plan of Improvement improvements for Unit No. 36 together
with estimated costs. The summary also includes an estimate for administrative, engineering and

IV. MAINTENANCE RESPONSIBILITIES
The maintenance of the conveyance and outfall system improvements will be by the
Northern Palm Beach County Improvement District or another governmental entity.
V. METHOD OF FINANCING
Several alternative methods of funding the proposed Improvements constructed on existing
or Landowner provided public rights of way or lands that will have to be acquired as previously set
forth herein are available to the District in accordance with past policy and applicable state statutes.
These are as follows:
A. Donations of the proposed improvements provided such improvements are
constructed in accordance with plans and specifications approved by the District
Engineer.
B. Funding to the District by governmental entities for construction of proposed
improvements.

C. Construction of proposed improvements utilizing District financing, to be repaid
from annual assessments to the benefitted lands within the Unit until the
indebtedness is retired.
D. Combination of A, B and C above with advanced funds reimbursed.
VI. RECOMMENDATIONS •
Based on the information presented in this report, the following recommendations are
— made:
_ A. That the Plan of Improvement be approved by NPBCID Board of Supervisors.

B. That all lands, rights of way or easements required for the improvements be
furnished to the District in fee simple title and/or in a perpetual easement in
accordance with District policy and at no cost to the District except as to those lands
that will have to be acquired as previously set forth herein.
- — C. That the water control facilities and other improvements presented in this plan be V
constructed to the extent that Unit 36 lands are benefitted; and upon their
completion, be maintained and operated for the benefit of the lands within Unit 36.
