Subject: Resolution Urging Expansion of the Use of Sewage
Treatment Revolving Fund to Include Stormwater
Management Facilities; Agenda Item
As was noted at your recent Stormwater Utility Board Meeting,
Tequesta Stormwater Utility can always put to good use additional
sources of revenue . There is a push right now within the State
Legislature to expand the use of the Sewage Treatment Revolving
Fund to include Stormwater Management Facilities . As we have so
vividly learned in our on-going struggle with ENCON, pollutant
loadings from stormwater are the most significant source of
surface water pollution in the Loxahatchee River and the State of
Florida.
Accordingly, it would be very beneficial if legislation were
passed that allowed Stormwater Management Facilities to be paid
for from the Revolving Fund.
We have put together the attached Resolution for your
consideration in the effort to expand the use of the Revolving
Fund to include Stormwater Management Facilities . It is
recommended that the Village Council adopt this Resolution.

RESOLUTION NO. 20-96/97
A RESOLUTION OF THE VILLAGE COUNCIL OF THE
VILLAGE OF TEQUESTA, PALM BEACH COUNTY,
jl FLORIDA, SUPPORTING LEGISLATION EXPANDING
THE USE OF THE SEWAGE TREATMENT REVOLVING
FUND (SRF) TO INCLUDE STORMWATER MANAGEMENT
I+ FACILITIES; PROVIDING FOR AN EFFECTIVE DATE.

WHEREAS, State revolving funds were established by the Clean
dWater Act Amendments of 1987 to provide a permanent source
of financing for state and local government water quality
hprojects; and

WHEREAS, the Clean Water Act allows for the use of SRF's for the construction of wastewater treatment plants, the
implementation of approved state nonpoint source management
programs and ground-water protection strategies, and the
Ij development and implementation of estuary conservation and
:1 management plans, and
WHEREAS, the Florida Legislature has limited the use of the
SRF 's to include only wastewater facilities and treatment;
I and
WHEREAS, the treatment of wastewater has been largely
:I effectuated by the use of SRF's and local initiatives,
! minimizing the need for future use of the fund for extensive
wastewater treatment facilities; and
11 WHEREAS, pollutant loadings from stormwater are the most
1 significant source of surface water pollution in the State
of Florida, in some cases as much as ten times greater than
11 wastewater pollutants; and
I! WHEREAS, the Legislature of the State of Florida is
considering legislation during this Session which would
I expand the use of the SRF to include the treatment of
stormwater; and

1,; WHEREAS, the Village of Tequesta has a strong commitment to
I the treatment of stormwater, having established a stormwater
h utility; and
1! WHEREAS, proper management of stormwater will improve the
freshwater bodies within the State of Florida, including the
Intracoastal Waterway and Loxahatchee River.
I; NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE
VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, AS FOLLOWS:

r hereby enthusiastically supports and approves the proposed
ii. Florida Legislation which would include the use of the State
Revolving Loan Fund to promote and finance stormwater
management facilities and projects .

Resolution to the Committee on Natural Resources, the
• 'i Environmental Protection Committee, and the Water and
h Resource Management Committee of the Florida Legislature,
li the Palm Beach County Municipal League and Palm Beach •

Section 3. This Resolution shall take effect immediately
upon its passage.
THE FOREGOING RESOLUTION WAS OFFERED by Councilmember
