Recommendations Pertaining to Implementation; Agenda
Item
The final Regional Roadway Mediation Meeting was held on June 18,
1997 . Attached hereto, please find a copy of the Regional
Roadway Mediation Accord prepared by the various Stakeholder
Groups as a result of this long and tedious mediation process .
Most of the items sought by Tequesta Stakeholders are dealt with
in a general sense. The Tequesta Stakeholders did the best they
could under the adverse circumstances . The adverse circumstances
consisted primarily of a unified recalcitrant position by Martin
County Stakeholders to oppose the Connector Road.
Please recall that mediation is a process that provides for
outcomes that are agreed upon. Arbitration, on the other hand,
provides for a potentially binding outcome, without respect to
agreement of the parties to the dispute.
It is recommended that the Village Council receive and file the
Regional Roadway Mediation Accord for future reference.
On the other front, the local governments that were a party to
the Regional' Roadway Mediation Process, including Tequesta,
proposed to the various Stakeholders that we would pursue the
provision of a local planning agency (LPA) pursuant to Chapter
163 of the Florida Statutes, by way of an interlocal agreement
between the parties, whereby they would each appoint members to
the LPA that would make recommendations to the governing bodies
of each government relative to comprehensive planning associated
with the identified regional roadways which were a part of the
Mediation Hearings. These roadways would include County Club
Drive, possibly Tequesta Drive, the Connector Road, the Western
Connector, Longshore/Northfork Drive, Church Street, and
Loxahatchee River Road. It was envisioned that citizens, as well
as elected officials, would serve on this LPA. This process
would ensure that each participating local government would have
to take action at a public meeting on the recommendations of the
LPA created to deal with these regional roadway issues . Martin
County is anticipated to participate upon conclusion of Section
28 litigation.

The Village Council should take some formal action relative to
the local government recommendations of the Regional Roadway
Mediation Process, namely, whether or not Tequesta intends to
participate in the proposed LPA. If so, your vote will get the
ball rolling toward the initiation and completion of the
interlocal agreement to formalize this proposal .
I think the proposal has merit in that it allows the citizens
most affected to make comprehensive plan recommendations relative
to the regional roadways . The Village Council would not be
required to accept the recommendations of this specific LPA.
However, the Village Council may wish to consider what
ramifications, if any, this would have on Tequesta' s current
comprehensive planning process, wherein the Village Council sits
as the LPA for Elements associated with the Comprehensive Plan.
For example, would the proposal cause Tequesta' s planners to take
Transportation Element issues potentially affecting Country Club
Drive and Tequesta to the proposed LPA, in addition to the
current Tequesta LPA?
Subject to such legal and planning issues being satisfactorily
resolved, I would recommend that the Village Council give
consideration to approving this proposal .

I want to again thank all of you for the opportunity to have served as your mediator in this
Roadway Issues Mediation. I congratulate you for having achieved the Accord.that you have,
and for your agreement and commitment to the soon-to-be-formed Joint Planning Agreement
under Florida Statute 163,which will provide the basis for your continuing work together to
refine and implement the regional solutions you've agreed to.
Enclosed is a fully-typed copy of the Accord, as presented at our Joint Meeting of Stakeholders
and Government on June 18. My portable printer proved no more reliable than my car that
afternoon!
Also enclosed is a revised List of the Stakeholder Groups' Representatives,Individuals and
Government Representatives, together with their addresses and telephone numbers. This
consolidated list should prove helpful in enabling both Stakeholder Groups and Government to
continue the improved level of communication that you have achieved, and help in your future
correspondence and scheduling of meetings under the Joint Planning Agreement.
Approach your ongoing discussions, meetings and negotiations with the same spirit of
cooperation, patience and collaborative problem solving that you have demonstrated during the
Mediation process. Agree up front to the same Ground Rules and proven communication
protocol that have enabled you to really listen to each others' concerns and interests, and work
together to implement your regional solutions to these issues with civility and mutual respect for
one another.
I am confident that, once the Section 28 appellate process is resolved, all four Governments will
be productively involved in the Joint Planning process with the Stakeholder Groups'
Representatives and, in the meantime, a lot of progress can be made toward feasibility studies,
ongoing discussions and implementation that is essential to your long range plan for global
roadway solutions.
Stay involved and committed to the process you've designed, and I wish you well.

ROADWAY ISSUES MEDIATION
STAKEHOLDER GROUPS' ACCORD
JUNE 18, 1997
The Stakeholder Groups in the Roadway Issues Mediation support the general
principle of a comprehensively planned and developed regional road system
that fairly distributes the burden of traffic among all neighborhoods.
By the foregoing, we mean that we want our governments to work together in
an organized, collaborative and productive manner to implement long-term,
rather than piecemeal / band-aid solutions, and we offer the following as
guidance.
The Stakeholder Groups strongly recommend that the governmental entity
formed for the purpose of implementing these solutions include representatives
of the Stakeholder Groups.
We agree that there is an urgent need for the construction of an inter-county
Western Corridor Roadway, running from the vicinity of Island Way in Martin
County to Indiantown Road, in the vicinity of Shoney's, in Palm Beach County.
Our Governments must plan and build this Roadway with adequate build-out
levels to handle traffic for the foreseeable future. Our Government participants
in this Mediation must work together to ensure that construction of this
Western Corridor can begin at the earliest possible time, and be completed
before any new development of any undeveloped land is permitted, including
Sections 28, 33, 3 and 4.
In accomplishing the foregoing, our Governments must minimize adverse
impact upon, and maximize compatibility with, all existing residential
neighborhoods and all environmentally-sensitive land.
We also support controlling traffic impact through reasonable traffic calming
and enforcement of traffic regulations on all our roadways.

We understand and support Martin County's efforts to promote responsible
growth and limit density, and urge Martin County to amend its Comprehensive
Plan to include the Martin County segment of the Western Corridor as soon as
possible.
AGREEMENT on Limestone Creek/ Church Street (March 26, 1997, refined
April 2, 1997): Minimize traffic to Church Street caused by non-Limestone
Creek community development.
The Public Forum Mediation Meeting of April 2, 1997, was attended by a large
number of Little Club residents and resulted in Stakeholder Groups' consensus
- to consider the construction of a Bypass Road. Other Stakeholder Groups
oppose construction of a Bypass Road, recognizing this is a complex issue
requiring definitive studies and collaborative efforts by Governmental, Business
and Residential entities.
We recommend that County Line Road be left as engineered,with accurate
weight limits on bridges and improved through-truck control and law
enforcement.
We strongly emphasize the priority of completing the Western Corridor in both
Palm Beach and Martin Counties as a means to minimize traffic on existing
roads and protect existing neighborhoods.
Let it be emphatically noted that Loxahatchee River Road, Northfork Drive and
Church Street shall not be alternatives to the construction of the Western
Corridor. To do so will not solve long-term regional planning needs.
