Joann, attached are 18 sets of packets for the above referenced subject. The applicant,Mr. Russo
is seeking approval by the Village for a variance to a minimum side yard setback and to close in,
with walls,the area at his existing building that was formerly a drive through teller facility when a
bank was at 110 Bridge Road. Please place this development matter on the agenda for the
September 11, 1997 council meeting. Thanks.

Staff Report and Recommendation
110 Bridge Road Corporate Office: Andrew Russo,Property Owner and Applicant.
Request for a Variance and Site Plan Approval. The property is located at 110 Bridge
Road and is within the C-2, Community Commercial District.
Background:
The property is located just west of the Apex Texaco Service Station on the south side of Bridge
Road. There is an existing building that was previously a bank and is now a real estate office.
The applicant desires to enclose with walls,the part of the existing building that was the former
bank facilities drive through teller area. In order to do this,the applicant needs to receive a
variance to the zoning code for the required minimum side yard setback. The request is as set
forth on the attached legal notice for the variance request.
Development Review Committee/Staff Review:
After review by the DRC on July 15, 1997,the comments and/or areas of concern expressed by
the DRC are as follows:
o Applicant needs to obtain a variance to the Villages minimum side yard setback as required
within the C-2 zoning district.
o Applicant needs to remove the asphalt that lies outside the east property line along the
existing hedge that abutts the Texaco Servive Station property.
o Applicant needs to remove the existing Florida Holly that is located at the southwest corner of
the property.
o Applicant needs to install a Reduced Pressure Backflow Preventer as required by the Tequesta
Water Utility.
Staff Recommendation:
The Applicant is fully aware of the above listed comments/requirements by the DRC and agrees
to properly address each one of them. This proposed alteration to the existing building is
considered a minor change to the facility and as such will have no adverse affect on the property
or the surrounding commercial area. Notices were sent out to all property owners located within
300'(feet) of the subject property as part of the required application for variance process. Staff
recommends approval.

Public Notice is hereby given that the Village Council of the Village of Tequesta will hold a
Public Hearing during the Village Council meeting beginning at 7:00 P.M., Thursday, Sept-
ember 11, 1997, in the Village Hall, 357 Tequesta Drive, Tequesta,Florida, to consider:
An application from Andrew Russo, owner of the property located at 110 Bridge
Road,Property Control No. 60-43-40-30-00-000-7250, requesting a variance to the
terms of the Official Comprehensive Zoning Ordinance of the Village of Tequesta,
Ordinance No. 355, as amended, Section VII, Schedule of Regulations and Appli-
cation of Regulations, Subsection(C), Schedule of Site Requirements, C-2 Comm-
unity Commercial District, minimum side yard setback, to allow the closing in of an
existing drive through canopy with walls with a side yard setback of 8.83' (feet), in
lieu of 10' (feet) setback, as required by the Code.
At such time and place,the Village Council will hear all evidence in support of or in opposition
to this application.

made by the Village Council with respect to any matter considered at this meeting or public
hearing,he/she will need a record of the proceedings, and for such purpose he/she may need

Request for variance on side yard setback from 10' to 8'-10" This is an existing
building which currently is at the 8'-10" setback.
Justification of Variance for 110 Bridge Road:
1. The special conditions and circumstances that exist which are peculiar to
this building involved are that the building was constructed in 1982 and
was permitted with the plans clearly showing a side yard setback of 8'-10".
The building was used as a bank and drive-through. It is now used as an
• office and the drive through is not needed. To enclose the drive-through
structure involves infilling between the existing columns, which are at the
previously approved setback of 8'-10". This condition would not be
applicable to other buildings in the same C-2 zoning district, unless they
were likewise permitted with a lesser setback.
2. The special conditions and circumstances do not result from the actions of
the applicant. The building was purchased by the applicant with the
existing structure at 8'-10" side yard setback.
3. The granting of the variance will not grant any special privilege to the
applicant. The variance is a result of existing conditions previously
permitted.
4. The literal interpretation of the provisions of the ordinance would deprive
the applicant of rights commonly enjoyed by other properties and would
Work unnecessary and undue hardship since the building already exists
and the applicant is not requesting to go beyond the existing building
structure line.
5. The variance requested is the minimum variance that will make possible
the reasonable use of the building as the building already exists.
6. The granting of the variance will be in harmony with the general intent and
purpose of the ordinance and that such variance will not be injurious to the
area involved or otherwise detrimental to the public welfare as the building
already exists.
