Ladd,Director of Community Development DATE: September 2, 1997 SUBJECT: Draft Ordinance to increase Permit Fees Additional background information Joann, as a part of my 97/98 budget review, I was asked to examine our current permit fee • structure with the intent to increase those fees that have not kept pace with the permit fees being charged by other municipalities in the north end of Palm Beach County. After contacting seven (7) area municipalities, five(5)responded with their current fee schedules. As a result of studying the five respondents, I was able to prepare a Revenue Enhancement Analysis, a copy of which is attached. Also, an examination of Department records indicated that we have not had a fee increase for over nine (9) years. Now that the Dept. of Community Development is operating as an Enterprise Fund, it is very important that we keep pace with our permit fee charges, in order that the Dept. of Community Development is properly funded. The proposed fee increases are minor in nature but will generate approximately $20,000 more than what we are currently collecting. REVENUE ENHANCEMENT ANALYSIS DEPARTMENT OF COMMUNITY DEVELOPMENT OBJECTIVE: Analyze the various revenues that the Department of Community Development takes in and review the Fee Basis in comparison to other communities in order to increase certain fees, if there is justification to do so. METHODOLOGY: The Department contacted seven [7] area Communities requesting information regarding their current Permit Fees and other related Building Dept. charges . In re- sponse to our request, five [5] Communities sent us information. The five [5] Communities were as follows : 1. Jupiter 2. North Palm Beach 3. Lake Park 4. Riviera Beach 5. Boca Raton After receiving the information from the five [5] Communities , a comparison review was performed in order to identify Fee areas where the Village was charging less than these other Communities . RESULTS: After completing the review, as stated above, certain Fee areas were identified as areas where sufficient justification exists to warrant revising the Villages Permit Fee structure as follows : o "Minimum Permit Fee" - Each of the Communities indicated minimum permit fees higher than Tequesta as follows: 1. Jupiter $35.00 2. North Palm Beach $30 .00 3. Lake Park $30.00 4. Riviera Beach $30 .00 5. Boca Raton $35.00 6. Tequesta $25.00 Therfore, it is recommended that the Village increase the "Minimum Permit Fee" in all Permit Categories, such as; Building, Electrical , Plumbing, Mechanical , and Gas to $35.00. REV981 Page 2 Revenue Enhancement Analysis Department of Community Development Results, Continued o "Fees based upon ranges", such as, 0 - 499, 500 - 999, etc. The Town of Lake Park uses"Fees based upon ranges" also, and their fee structure is considerably higher than ours. In addition, for Tequesta, there is no doubt that we are not being properly compensated for on our current range based fee structure due to the fact that we cannot intake, review, process and print out a permit and then perform an inspection for what we currently receive as a permit fee. Therefore, it is my recommendation that we revise our range based fee struc- ture as follows: Valuation: Amount of Fee: 0 - 499 in value $35.00 500 - 999. 99 40.00 1,000 - 1,499. 99 45.00 1,500 - 1, 999 . 99 50 .00 2 ,000 - 2,499. 99 55.00 2 ,500 - 2 , 999. 99 60.00 3, 000 - 3,499. 99 65.00 3 ,500 - 3 , 999 . 99 70 .00 4, 000 - 4, 499. 99 75.00 4, 500 - 4 , 999.99 80 .00 5,000 - 5,499. 99 85.00 5,500 - 5,999. 99 90.00 ' 6,000 and above, the fee is equal to $90.00 for the first 6,000 with the remainder at 1. 60 % Note: For the Communities reviewed that used a percen- tage basis for some or all of their permit fees, the % ranges went from a low of .125 for very large valuations such as 1,000 ,000 & up to a high of 3% for up to 10,000 in value with various % falling in between. o "Demolition Permit Fees" - Tequesta's current fee for dem- olition work is a flat fee of $50.00 . Riviera Beach charges a fee of $100 .00, Jupiter charges 1.5% of the value of the work with a minimum fee of $250.00 and the remainder of the Communities surveyed base the fee on the value and their fee tables. Therefore; it is recommended that the Village charge a fee for demolition work on our "Range based fee structure" as set forth above. REV982 Page 3 Revenue Enhancement Analysis Department of Community Development Results, Continued • o "Reinspection Fees" - The Villages current fee charged for reinspections is $20.00. North Palm Beach charges $40.00, Riviera Beach charges $30.00, Jupiter charges $35.00 and Boca Raton charges $25.00. Therefore; it is recommended that the Village increase the fee for reinspections to $35.00 . SUMMARY: There appears to be sufficient justification to increase certain Village permit fees and other fees as outlined above. The remainder of the Villages permit fee stucture appears to be adequate and in line with other Communities in Palm Beach County. • Due to the time constraints attached to this analysis of the Department of Community Development 's permit fees , an estimate of how much additional income would be derived from these proposed increases in fees was not provided. Chapter 6 of the Code of Ordinances is hereby amended at Article VIII, Section 6-144 by amending paragraphs (a), (c), (d), (e)1 and 3, (g) and (j) to read as follows: Sec. 6-144. Same-Electricity. (a) The minimum fee for any permit for electrical work will be: $35.00. (c) Temporary Service: 1. 200 ampere inclusive $35.00 2. Each additional 100 ampere or fraction thereof 10.00 (d) Change of Service and Panel: 1. 200 ampere inclusive $35.00 2. Each additional 100 ampere or fraction thereof 10.00 (e) Remodeling and/or Additional Wiring: 1. Minimum Fee: Commercial- Minimum electrical permit for commercial will be $35.00 per tenancy (1-10) outlets). For every outlet over 10, an additional $0.90 per outlet shall be charged in addition to the minimum permit. Residential- Minimum electrical permit for residential will be $35.00 per tenancy (1-10) outlets. For every outlet over 10, an additional $0.60 per outlet shall be charged in addition to the minimum permit. 3. Swimming Pools: Residential package unit (transformer, controls, pump, lights, bonding, grounding and switches) $35.00 (g) Minimum Sign Permit (including 2 ballasts or 2 transformers) $35.00 • Additional Ballasts or Transformers, each $ 5.00 (j) Reinspection Fee: Each reinspection made due to condemnation(red-tag or failed inspection) of work, work not ready at the time specified in the application for inspection or for failure to call for final or other inspection $35.00 Section 4. Section 6 of the Code of Ordinances is hereby amended at Article VIII, Section 6-145 by amending paragraph (1)to read as follows: Sec. 6-145 Same-Air Conditioning. (a) Reinspection Fee: Each reinspection of a heating, ventilating, air conditioning or refrigeration system made due to condemnation (red-tag or failed inspection) of work, work not ready at the time specified in the application for inspection or for failure to call for final or other inspection $35.00 Section 5. Chapter 6 of the Code of Ordinances is hereby amended at Article VIII, Section 6-146 by amending paragraph(a)to read as follows: Sec. 6-146 Same-Gas. (a) Reinspection Fee: Each reinspection made due to condemnation (red-tag or failed inspection) of work, work not ready at the time specified in the application for inspection or for failure to call for final or other inspection $35.00 • Section 6. Severability. If any provision of this Ordinance or the application thereof is held invalid, such invalidity shall not affect the other provisions or applications of this Ordinance, which can be given effect without the invalid provisions or applications, and to this end,the provisions of this Ordinance are hereby declared severable. • Section 7. Repeal of Ordinances in conflict. All other ordinances of the Village of Tequesta, Florida, or parts thereof which conflict with this or any other part of this Ordinance are hereby repealed. Section 8. Codification. This Ordinance shall be codified and made a part of the official Code of Ordinances of the Village of Tequesta. Section 9. Effective Date. This Ordinance shall take effect immediately upon its passage and approval, as provided by law. THE FOREGOING ORDINANCE WAS OFFERED BY Councilmember , who moved its adoption.
