Date: September 18, 1997 Subject: Request to Exempt Sterling House Parcel from Zoning-In-Progress Declaration; Agenda Item As you may know, on July 25, 1996, the Village Council declared zoning-in-progress for the adult congregate living facility (ACLF) and extended care facility (ECF) uses within the Mixed-Use Zoning District. The zoning-in-progress declaration made the referenced land uses temporarily prohibited while the Village Attorney drafts a Zoning Ordinance Amendment modifying the applicable land use. The new State Regulations pertaining to ACLF' s and ECF ' s are quite complicated. It was the Council ' s desire to modify the Zoning Ordinance so that only the traditional ACLF use would be allowed. There is still validity in maintaining the zoning-in-progress declaration for the Mixed-Use Zoning District. However, the land that is being proposed for an expansion of the existing use at Sterling House, due to its location, lends itself only to a, use that is compatible with the parcel directly abutting Village Boulevard. Therefore, an expansion of the existing ECF at Sterling House could be acceptable for this parcel since it is compatible. If the Village Council desires to accommodate the Sterling House request, staff believes that you can do so and continue with the zoning-in-progress declaration for the remainder of the Mixed-Use Zoning District, with the following conditions : • That the exemption only apply to the parcel identified as being immediately due north of the existing Sterling House property off of Village Boulevard. • That Sterling House provide staff with sufficient proof of Unity of Title indicating that the two (2 ) parcels are under the same unified Sterling House ownership. These conditions would grant Sterling House their request, while maintaining the prohibition for ACLF/ECF in the remainder of the Mixed-Use Zoning District while the Zoning Ordinance Amendment is being drafted. Tom, attached are 18 copies of a letter from Mr. Capra requesting that the Village Council amend the Zoning-in-Progress status that currently is in effect within the village and that affects the existing property that his client, Sterling House of Tequesta, desires to utilize by adding another 42 units to their already existing 42 unit facility at 205 Village Blvd. The proposed additional 42 unit facility would be located on a parcel of vacant land that lies adjacent to and north of the existing Sterling House site and that abutts the Villages water plant site and is adjacent to and immediately west of the rear of the K-Mart loading area. I have attached a general location map indicating with an arrow where the new 42 unit facility is proposed to be located. An examination of this site indicates that the best use for this parcel,which does not front upon or have direct access to a public right-of-way, is to allow an extention to the existing 42 unit assisted living facility. As the existing Sterling House facility is allowed within the Village as a Special Exception Use, the addition of another similar 42 unit building would be considered an extention to a previously approved Special Exception Use. Also, the Village will require, as a condition of approval,that the two parcels,the one containing Sterling House I and the one that would contain the proposed Sterling House II,become one parcel under Unity of Title. Box 3273 Tequesta, Florida 33469 RE: Sterling House of Tequesta II Request for"Zoning in Progress" Restriction Amendment Dear Mr. Ladd: • Concerning the referenced project, we hereby request the approval of a 42-unit extended care facility on the property behind the existing Sterling House facility. The proposed building will be similar to the existing Sterling House building in type, size and style It is our understanding that the Mixed-Use category has a restriction of a "Zoning in Progress", which may limit the development of a Sterling House of Tequesta II building. We hereby request that this restriction be amended to allow the construction of an extended care facility (Sterling House) in the Mixed Use category. It is also our understanding that the• Council placed this type of zoning d esignation after the - completion of the Sterling House of Tequesta I facility. It is our opinion that the Sterling House Extended Care Facility provides the best use of • this property, which is consistent with the surrounding uses and facilities. It is a very good transitional use and probably the only use available between the K-Mart site to the east, the future multi-family uses planned to the west of this property, the water plant to the north, and the existing Sterling House facility to the south. It s the Sterling House Corporation's preference that the Council remove this "Zoning in Progress" restriction and allow the Special Exception, and Site Plan approval of the Sterling House of • Tequesta II at its earliest convenience.
