VILLAGE OF TEQUESTA SPECIAL MASTER CODE ENFORCEMENT HEARING MINUTES AUGUST 28, 1997 PRESENT: Special Master Paulette Torcivia; Code Enforcement Officer Police Sgt. John Irovando; Police Lieutenant Robert Garlo; Recording Secretary Betty Laur. Meeting was called to order at 10:04 A.M. Violation Hearing: Case No. 97-06-180 Hudson, David B. & Pamela M. 28 Hickory Hill Rd., Tequesta, FL 33469 Legal Description: Tequesta Pines, Lot 216 Nature of Violation: Leash Law ORD 178-4, Sec 4-17, page 260 Respondent Pamela M. Hudson was present at the hearing and testified to the various means used to keep her dogs within her yard. Code Enforcement Officer Irovando testified to the violation. Conclusion of law was that Respondents are in violation of the Code of Ordinances of the Village of Tequesta, Ord. No. 178-4, Sec 4-17, leash law. Special Master Torcivia ordered that Respondents, David B. And Pamela M. Hudson, shall comply with Ord. No. 178-4, Sec. 4-17, leash law, of the Village SPECIAL MASTER CODE ENFORCEMENT HEARING MINUTES August 28, 1997 Page 2 of Tequesta by the 29th day of August, 1997. If Respondent's dogs are found outside the yard, a fine of one hundred dollars ($100.00) shall be assessed. Upon complying, it is the responsibility of the Respondent's to notify the Village of Tequesta Code Enforcement Officer at (561) 575-6218 to request a reinspection of the property. Violation Hearing: Case No. 97-07-092 Saratin, Dennis G. & Sherry L. 322 Country Club Drive Tequesta, Florida 33469 Legal Description: Tequesta Lot 148 Nature of Violation: Ord. No. 464, Sec. (3), Parking Restrictions, Zone R1A, page 1185 Respondent Dennis G. Sartain was present at the hearing and testified to the difficulties he was having with his recreational vehicle. Code Enforcement Officer Irovando testified to and introduced a photograph of the violation. Conclusion of law was that Respondents were in violation of the Code of Ordinances of the Village of Tequesta, Ord. No. 464, Sec. (3), parking restrictions. Special Master Torcivia ordered that Respondents Dennis G. Arid Sherry L. Sartain shall continue to comply with Ord. No. 464, Sec (3), parking restrictions, of the Village of Tequesta. If Respondents do not comply, a fine of up to two hundred fifty dollars ($250.00) per day; five hundred dollars ($500.00) per day for repeat violators, may be assessed for each day the violation continues to exist. Steen do Toyota, Tequesta Motor Cars, located at U.S. Highway #1, No. 746, Tequesta, Florida. Legal Description: 30-40-43, N 150 ft of S 800 of GOV Lt 1 W of SR5 & addl R/W (Less TR in OR950P192) Respondents Robert A. Walsh and Thomas Steen were not present at the hearing, however, Mr. Bill Burckart was present to represent their interests. Code Enforcement Officer Irovando testified to, and produced photographs depicting the ongoing violation. Conclusion of Law was that Respondents are in violation of the Code of Ordinances of the Village of Tequesta, Ord. No. 377. Special Master Torcivia ordered that Respondents, Robert A. Walsh and Thomas Steen shall be assessed a fine of eight thousand seven hundred dollars ($8,700.00). A certified copy of the Order of the Special Master shall be recorded in the Public Records of Palm Beach County, Florida, and once recorded, shall constitute a lien against the real or personal property owned by the Respondent, pursuant to Chapter 163, Florida Statutes, for the original amount. Violation Hearing: Case No. 97-07-097 Pond, Matthew A. 84 Yacht Club Place, Tequesta, Florida 33469 Legal Description: Tequesta LT 504 - Nature of Violation: Prd/ Mp/ 464, Sec (3), Parking Restrictions, Zone R1A, SPECIAL MASTER CODE ENFORCEMENT HEARING MINUTES August 28, 1997 Page 4 page 1185 Respondent Matthew A. Pond was not present at the hearing, however, there was a finding of proper notice. Code Enforcement Officer Irovando testified to and introduced a photograph of the violation. Conclusion of law was that Respondent is in violation of the Code of Ordinances of the Village of Tequesta, Ordinance No. 464, Sec (3), parking restrictions. It is the Order of the Code Enforcement Special Master that the fine assessed against Respondent Matthew A. Pond shall comply with Ordinance No. 464, Sec (3), parking restrictions, of the Village of Tequesta by the 29th day of August, 1997. If Respondent does not comply within the time specified, a fine of fifty dollars ($50.00) will be assessed for each day the violation continues to exist. If Respondent does not comply within the time specified, an additional Fine Assessment Hearing will be held before the Special Master on the 25th day of September, 1997, at 10:00 A.M., at the Tequesta Village Council Chambers, 357 Tequesta Drive, Tequesta, Florida 33469. Should a dispute arise concerning compliance, either party may request a hearing before the Special Master on the issue of compliance only. Upon complying, it is the responsibility of the Respondents to notify the Tequesta Code Enforcement Officer at(561) 575-6218 to request a reinspection of the property. Status Hearing: Case No. 90-08-214 Little, Thomas J. 486 Dover Road Tequesta, Florida 33469 Legal Description: Jupiter in the Pines, Sec. B, Block 15 Nature of Violation: Ord. No. 355, Appendix A-Zoning, Sec. (X), (L)(2), Restricted Parking, page 1184.1 Respondent Thomas J. Little was not present at the hearing. Code Enforcement SPECIAL MASTER CODE ENFORCEMENT HEARING MINUTES August 28, 1997 Page 5 Officer Irovando testified that Mr. Little had complied with the Special Master's previous Order; however, he needed to view the recreational vehicle in the arranged area before there could be a finding of compliance. It is the Order of the Code Enforcement Special Master that Respondent Thomas J. Little shall contact the Code Enforcement Officer to complete the review for compliance. Violation Hearing Case No. 97-08-002 Esplen, Robert K. 188 River Drive Tequesta, Florida 33469 Legal Description: Tequesta LT 408 Nature of Violation: Ord. No. 464, Sec (3), Parking Restrictions, Zone R1A, page 1185 Code Enforcement Officer Irovando requested dismissal of this case, stating that Mr. Esplen was a new resident. Code Enforcement Special Master Torcivia dismissed this case. Violation Hearing: Case No. 97-06-177 Hoste, Anthony L. 412 Cypress Drive, Unit#15 Tequesta, Florida 33469 Legal Description: Georgetown Place PH II, Unit#15, North Bldg. Nature of Violation: Leash Law ORD 178-4, Sec 4-17, page 260 • SPECIAL MASTER CODE ENFORCEMENT HEARING MINUTES August 28, 1997 Page 6 Respondent Anthony L. Hoste was not present at the hearing, however, there was a finding of proper notice. Officer Irovando testified to the violation. Conclusion of Law was that Respondent is in violation of the Code of Ordinances of the Village of Tequesta, Ordinance No. 178-4, Sec 4-17, leash law. Special Master Torcivia ordered that Respondent, Anthony L. Hoste, shall comply with Ordinance No. 178-4, Sec 4-17, leash law, of the Village of Tequesta by the 29th day of August, 1997.
