SDL/jmb Attch. i VILLAGE OF TEQUESTA VILLAGE COUNCIL September 16, 1997 Staff Report and Recommendation Reverse Osmosis Water Treatment Facility: Village of Tequesta, owner of property located at 951 Old Dixie Hwy. North. Request for Special Exception, Site Plan, and Landscape waiver approval. The project contact person is Thomas C. Hall, Water System Manager and the Engineering firm is Reese,Macon &As'sociates,Inc. Background: This proposed project is to be located at the Villages existing water treatment plant site on Old Dixie Highway, north of Village Blvd. and west of County Line Plaza. The project is being proposed in order to provide increased capacity to the Villages water delivery system. Water treatment facilities are considered Special Exception Uses by the Villages zoning code and any extention, alteration or enlargement to an existing special exception use requires a special exception public hearing in order to consider the proposed extention for the R.O. facility. Development Review Committee/Staff Review: After review by the DRC on September 9, 1997,the comments and/or areas of concern expressed by the DRC are as follows: o Provide list of chemicals to be stored on site with size of containers and site location, and provide MSDS sheets. Chemical containment areas must be able to contain 110% capacity. o Provide chemical containment vessel markings per NFPA 704'. o Locate fire hydrants on the site per direction of Fire Chief. o Provide items required to meet ISO requirements, i.e., building square foot area, construction type, roof type, exposure distances to other structures, % of openings in the building, i.e.;windows, doors, louvres, etc. o Provide one(1) electrically activated swing gate for access. o Provide a "Knox Box" for fire dept. use. o Try to use flush header curbs in lieu of valley curbs. o Provide stop bars at both entrances. DRC review page 2 o When using elliptical pipe,wrap joints with paper and rock. o Sod all swale and road edge areas. o Eliminate the proposed 4' wide shoulders on each side of the service road and use 4 to 1 slope from edge of pavement to existing grade. Staff Recommendation: The applicant has addressed the comments from the DRC review ( see letter from Reese, Macon & Associates ). The expantion of the Tequesta Water System is needed in order to increase capacity. The Village of Tequesta Level of Service for water must be increased in order for the Village to insure that there will be available capacity to provide the appropriate level of service for any proposed new development prior to the issuance of certificates of occupancy for such new development. WTP Dear Scott: As discussed at the DRC meeting held September 9, 1997 for the above referenced project, the following addresses those comments made by Village staff Tequesta Fire Rescue (James Weinand) 1. The following chemicals will be used and stored at the RO WTP. 6400 Gal. Sulfuric Acid 66° Be, 93% 2100 Gal. Hydrogen Peroxide 50% 6400 Gal. Sodium Hydroxide 50% 2. The material safety data sheets(MSDS) for each chemical shall be provided prior to delivery. 3. Emergency containment of each chemical storage vessel shall be provided which equates to 110% (minimum) of the storage capacity. Each containment area shall be coated to provide for an impervious membrane. The site grading around the storage vessels shall be maintained flat to avoid excessive run-off/containment if a spill should occur. 4. Each chemical storage vessel shall be labeled in accordance with NFPA 704 markings. 5. As requested by Chief Weinand, the following information is provided for his use in calculating the ISO fire flow requirements; Building Square Footage 8500 sf % Openings, North side 13% South side 27% East side 18% West side 14% Distance to nearest structure 65 ft to ground storage tank/200 ft to existing WTP building. Construction materials Concrete block walls with precast concrete roof members with standing seam metal roof. Wood trusses are used in building the hip ends of roof. 7. The gate on the north entrance to the RO facility shall have an automatic opener. All other gates shall be manually opened. 8. A flush mounted Knox box shall be provided for on the plans, located adjacent to the front doors, for emergency access/key retrieval. Public Works (Gary Preston)- No comments Police Department(Stephen Allison) -No comments Stormwater Utilities (Allan Osland) 1. Mr. Osland requested that if the two (2) driveway cuts onto Old Dixie Hwy. have valley gutters that they be eliminated. The attached revised plans show the typical cross sections of these drives as requested by P.B. County Engineering which make use of valley gutters. This construction is typical of other driveway cuts along Old Dixie and is required by the County. 2. Each driveway access onto Old Dixie Hwy. now has stop bars and stop signs. A grassing plan has been developed (attached)to address limit of grassing (sod/seeding/mulching). 5. Mr. Osland requested that the access road to the rear of the plant property have the 4 ft. shoulder eliminated. We realize that this road will have minimal use, but the type of vehicles that will make use of it(drill rigs, support vehicles, etc.)will need the 4 ft. shoulder. From this perspective and as a safety precaution, we have left in the 4 ft. shoulder. INTRODUCTION The proposed Reverse Osmosis Facility is located immediately adjacent and just south of the existing Village of Tequesta Water Treatment Facility in the northwest 1/4 section of Section 30, Township 40 South, Range 43 East in Palm Beach County, Florida (see Figure 1). The site is presently undeveloped land within the property boundaries and ranges from disturbed (ruderal) land to nearly undisturbed sand pine and sand live oak scrub. To comply with the Village of Tequesta Ordinance No. 399 dealing with protection of environmentally sensitive lands within the village, Environmental Management Systems (EMS) scientists conducted an Environmental Assessment of the property. To fulfill this obligation, EMS conducted a habitat survey within the proposed construction areas to find out if any listed species or their "critical habitat" were present. The investigations were conducted according to interagency coordination requirements of the U.S. Fish and Wildlife Service (USFWS) and the Florida Game and Fresh Water Fish Commission (FGFWFC). The study was performed to identify and determine what, if any, impacts the proposed project would have on any plant and animal species that are listed by either the USFWS or the FGFWFC as Endangered and/or Threatened species. The specific study area for the proposed project.included the sand pine scrub habitat consisting of approximately 2.75 +/-acres, which extends south from the present facility along the western side of the property. It includes a narrow corridor of approximately 0.35 +/- acres of sand scrub oak habitat which is to be impacted as a result of the re-alignment of the unpaved trail which traverses the property in a northeast direction. This trail will provide access to proposed well 2R at the northeastern corner of the site. During the permitting phase of the project, coordination with appropriate federal and state agencies will be required to obtain necessary development permits. II. PROPERTY DESCRIPTION The study property consists of natural lands which range from disturbed lands (ruderal) to undisturbed relic "back dune" coastal scrub habitat. Small trails have also been cut through the scrub in an east-west direction to provide access to a new well. Soils in the study area were consistently confirmed to be St. Lucie sand, 0 to 8 percent slopes (ScB) according to the Soils Survey of Palm Beach County Area. Florida, produced by the U.S. Department of Agriculture, Soil Conservation Service in cooperation with the University of Florida (see Figure 2). III. DETERMINATION OF POTENTIAL SPECIES INVOLVEMENT Prior to the initiation of field work, a background literature search was conducted to determine the legally protected species that have the potential to occur within the area of northern Palm Beach County, Florida encompassed by this project. Plant and animal species lists were compiled by using computer databases maintained by EMS, which contain species occurrence by county and habitat type. These databases were developed by consulting the most current observation and distribution records maintained by the Florida Natural Areas Inventory (FNAI), and by reviewing current scientific literature. Additional distribution and habitat information was obtained from the Florida Committee on Rare and Endangered Plants and Animals (FCREPA) publications, the FGFWFC, and the USFWS. Tables 1 and 2 of this report contain copies of the database information. IV. HABITAT SURVEY A. Methods An EMS biologist visited the project site on August 22, 1996, to conduct a survey of the natural habitat within the study area. This survey consisted of pedestrian and vehicular transects which meandered through representative natural areas within the proposed construction zones of the new R.O. facility and the planned trail which will follow a parallel alignment similar to the existing alignment of the present trail. 3 I 'ii 2 L. Observations were made along each transect for any listed plant species that have been determined to have the potential to occur within the project boundaries. The habitats were also evaluated for their degree of disturbance as a measure of the potential for listed species occurrences. The occurrence of wildlife species was documented through direct visual or aural observation of individual animals, or through observations of distinctive signs, such as tracks, scat, burrows, nests or food remains. A list of observed wildlife species was compiled. No attempts were made to estimate population sizes of any observed species. The present survey was conducted solely to determine the potential of listed species usage of the area based upon the on-site habitat conditions. B. Results Most of the site was undisturbed, scrub habitat with only patches of open land present on .the trails which bisected the property mainly in an east-west direction. The western portion of the property consisted of primarily sand pine habitat with saw palmetto in the understory. The eastern portion (2/3) of the property was primarily sand live oak with scattered Brazilian Pepper Trees along the fringes and in the previously disturbed areas. Native uplands have been impacted somewhat through urbanization, the lack of natural fires in the area, and the indirect impacts resulting from the storage of water treatment plant materials associated with the adjacent facility. The edges of the forested systems are overgrown with shrubby vegetation. Much of it contains exotic, nuisance species, and some of the areas are littered with scattered trash and debris. The majority of the western area (1/3) is composed of sand pine forest (FLUCFCS code 413 on Figure 3). This area was historically composed of a mixture of sand pines and coastal sand live oaks, but the preclusion of natural fire, in the area immediately adjacent to Old Dixie Highway, probably enabled the establishment of a more exclusive community of sand pines with an understory of saw palmetto. The area immediately to the east has more open sand and a well established sand live oak habitat (FLUCFCS code 432). Presently, this habitat is considered a healthy scrub community containing wax myrtle (Myrica cerifera), lantana (Lantana depressa), muscadine (Vitis rotundifolia), rosemary (Ceratiola eriocoides), pineland three-awn (Aristida stricta), dwarf huckleberry (Gaylussacia dumosa), prickly-pear cactus, (Opuntia hum jusa), Sun- rose (Helianthemum corymbosum), and blackberry (Rebus betulifolius)present in the understory. A few exotic and nuisance species occur along the more impacted areas of the property. These species include: Brazilian Pepper Trees (Schinus terebinthifolius); winged sumac (Rhus copallina); and caesarweed (Urena lobata). However, the site did reveal at least 1 federally listed wildlife species. Four (4) previously banded Florida scrub jays responded to the territorial call tapes which were played during the field inspection of the site. All the scrub jays are believed to be part of the same community which either live in or utilize the habitat for foraging on a regular basis. All individuals were adult birds. No young birds were observed, and no nests were found. The property was also surveyed for the presence of gopher tortoises (Gopherus polyphemus), a state listed Species of Special Concern (SSC), which is common in this kind of habitat. Only two (2) gopher tortoise burrows were found. Both of the gopher tortoise burrows were identified as Inactive indicating that there were no recent signs that the burrow was occupied by the tortoise. However, the burrows also provide a dwelling for several other listed species which commonly live as commensals. These species include: the Eastern indigo snake (Drymarchon corals couperi); the Florida pine snake (Pituophis melanoleucus mugitus); and the the Florida mouse (Podomys floridanus). V. IMPACT EVALUATION Based upon the observations in the field, the literature search of listed species' natural histories, consultation with agency personnel, and the habitat conditions on-site, lists of protected species that have the potential of occurring within the project area were generated. Table 1 presents listed USFWS and FGFWFC wildlife species with their associated legal status, and Table 2 presents listed USFWS and FDA plant species with their associated legal status. Species that are listed by the FDA as Commercially Exploited were also included in Table 2. These lists of protected species were confirmed through consultations with USFWS and FGFWFC biologists. Wildlife Table 1 presents a list of all protected wildlife species that have the potential to occur within the project boundaries. A total of one (1) species Federally listed as Endangered (E), and three (3) species Federally listed as Threatened (T) were considered. Individual species accounts are presented below with their associated habitat requirements. 7 i Table 1. It only breeds in approximately 500 mil of the open jack pine (Pinus banksiana) plains of central Michigan. The bird overwinters in the Bahamas, so it only passes through Florida during the spring and fall migrations. While in this state, it will utilize a variety of upland and wetland habitats as stopover locations during migration, so none of the on-site habitat is considered significant for the warbler. The likelihood of occurrence for this species is low. Threatened Species Bald eagle (Haliaeetus leucocephalus) The bald eagle is a species of primary concern in this state, due to its status as a national symbol, and its sensitivity to environmental disturbances. Eagles can be seen flying over many habitat types, but they require water bodies for feeding, and large trees near feeding areas for nesting. Some portions of this site have suitable nesting habitat, however no nests were observed during the field visits. According to the USFWS, there are 3 nests in the vicinity of the project. As confirmed by the USFWS and FGFWFC, the project lies outside the 1500 foot secondary zone. In light of the forgoing, the project should have no significant affect on this species. Eastern indigo snake (Drymarchon corals couperi) The indigo snake is a habitat generalist, using a variety of habitats from mangrove swamps to xeric uplands. During winter months, however, it can typically be found in uplands utilizing the burrows of gopher tortoises (Gopherus polyphemus) as shelter. These snakes require large tracts of natural, undisturbed habitat, so it is not likely that they will be found in this project. Consequently, it has been given a low likelihood of occurrence for the project. 10 Candidate Species (C2) or Species of Special Concern (SSC) Arctic peregrine falcon (Falco peregrinus tundriusl Florida is an important wintering spot for this subspecies of peregrine, and it can be found here from September through May. These falcons feed primarily on wetland birds along the coastal regions of the state, and near inland lakes and herbaceous wetlands. They have been known to utilize agricultural areas to a minor degree, as well. Due to the lack of waterbodies on-site, this bird is given a low likelihood of occurrence. Impact to this species will be low due the seasonal presence and limited amount of habitat on the project site. Florida mouse (Podomys floridanus) This mouse is one of the two mammal species that are endemic to Florida. It typically lives within gopher tortoise burrows in fire-maintained, xeric uplands. Because fire is rare, if not nonexistent, within the project area, as are xeric communities, habitat is not present on-site. Due to the natural flexibility of habitat requirements of most animal species, this one in particular, however, this mouse still has the possibility of occurring on the site, albeit low. Gopher tortoise (Gopherus polyphemus) This species is a key component in the determination of habitat suitability for endangered species because of the large number of other animals that will use tortoise burrows for one or more of their life requisites. While it is common to find tortoise burrows in most types of upland communities, the preferred habitats of the gopher tortoise are xeric uplands and disturbed, ruderal areas. Unusually, no tortoise burrows were observed within the project boundaries during the field evaluations for this site, but suitable habitat does exist, so the tortoise has a moderate likelihood of occurrence. Sherman's fox squirrel (Sciurus niger shermani) The Sherman's is the largest of the three fox squirrel subspecies that occur in Florida. Optimum habitat for this subspecies is composed of longleaf pine-turkey oak sandhills, although they will also be found in more mesic forested areas, as well. The longleaf pine-live oak stand in the center of the property represents marginal habitat. While its population is declining, this squirrel is still fairly common, so it has been assigned a moderate,likelihood of occurrence within this project site. 11 Southeastern American kestrel (Falco sparverius paulus) This is the resident subspecies of the kestrel, to be distinguished from its larger cousin, Falco s. sparverius, which is a winter visitor to Florida. The. Southeastern kestrel requires three components for optimal habitat: large, open fields for foraging, snags for nesting, and snags, fencelines or telephone poles as perching sites from which to hunt. These areas are present on-site, except for nesting sites. Thus, the kestrel has a moderate likelihood of occurrence on this project. Plants There were no plant species included in the database that are protected by the USFWS for this project site (Table 2). Thirty-three (33) FDA species were listed in the database for the general. region and habitats on or surrounding the site, however none of these species were observed during the field evaluations of this site. Many of these species have very low probabilities of occurring on the site due to their habitat requirements. As stated previously, the only listed species observed on-site was the Florida scrub jay. The scrub jays require scrubby sand live oak habitat with a percentage of open ground in which to forage. This kind of habitat was present on the eastern 2/3 of the property. Impacts to the scrub jays from construction activities could be minimized by seasonal timing and construction alternatives selected within the habitat area. The proposed plan could actually benefit the forage area of the scrub jays using the site by creating additional open ground for foraging. It is likely that the four scrub jays found on the site represent only one family. Preservation of the most of the existing sand live oak scrub will probably enable the species to prevail within the area, as long as the construction impacts do not alter nest trees or active nesting areas. Serious consideration should be given to the incorporation of FGFWFC habitat protection guidelines as well as Palm Beach County guidelines prior to initiating any work in the immediate area which the scrub jays are present. Additional surveys may be required prior to commencing construction. Based upon the above descriptions of on-site habitat, and the habitat requirements of potentially occurring federally listed species, it has been determined that no federally listed species will be significantly affected by this proposed project. The impact and removal of natural habitat from construction activity will be minimal, and the habitat that will be disturbed is already fairly small and not representative of a major habitat. The closest major habitat is situated less than 1/2 mile to the north at Jonathan Dickinson State Park which is the probable area supporting the family of scrub jays. The subject property lies within the normal flight range of Jonathan Dickinson 12 State Park and it is likely that the family that was observed on the property uses the site for foraging only. Since the birds were banded and obviously studied extensively, we can only assume that this kind of tracking may have been initiated in an area where stable populations have been monitored, like the State Park. VI. CONCLUSIONS The Tequesta Water Treatment R.O. facility is intended to provide much needed additional potable water to the growing population in the community. The expansion of the facility will require clearing of the western 1/3 of the property and clearing of the new, but parallel alignment of a small unpaved trail which will bisect the property to allow access to the well in the northeast corner of the site. Impacts to the suitable scrub jay habitat will be minimal, and if done properly, should not result in any significant impacts to the Florida scrub jays utilizing the area. There are two (2) inactive gopher tortoise burrows situated on the site. These burrows, though determined to be inactive, should be more closely evaluated to rule out the presence of any commensals using the burrows prior to construction. If gopher tortoises or any of the commensals are found to be using the burrows, these species may be permitted for on-site relocation to areas which are not planned for development. On-site plant communities were surveyed and a literature search was conducted to determine the likelihood of occurrence of federally protected species on the project site. Additional evaluations were made for the potential impact upon state-listed species, as well. No federally protected species were observed on-site during the habitat survey. This study has determined that this project will have no significant impacts to federally listed plant or animal species. The State of Florida Division of Historical Resources - Master Site File staff was contacted with regard to identifying any archaeological or historically significant features that may be present in the area.
