HomeMy WebLinkAboutMinutes_Local Planning Agency_10/19/2023 t MINUTES LOCAL PLANNING AGENCY MEETING VILLAGE OF TEQUESTA, FL OCTOBER 19, 2023 5:30 PM COUNCIL CHAMBERS CALL TO ORDER AND ROLL CALL The meeting was called to order by Board Chair, Janet Strand at 5:30 p.m. A roll call was taken by Community Development Planner, Catherine Wagner. Present were: Janet Strand, Elizabeth Schauer, Leslee Dasher, Theresa Maggio, Sherry Ambrose, Alternate Jeanne McEldowney, Marie Sapirie and Marco Valdez. Also present were Community Development Director Jay Hubsch, Planner Catherine Wagner, Attorney Dylan Brandenburg, Building Official Wayne Cameron, and Lynne Britt. Approval of previous meeting minutes from September 21, 2023 AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA, AMENDING THE VILLAGE CODE OF ORDINANCES AT CHAPTER 14. BUILDINGS AND BUILDING REGULATIONS, BY CREATING A NEW ARTICLE IX. STRUCTURAL MILESTONE INSPECTIONS. TO IMPLEMENT THE STATUTORY REQUIREMENTS FOR CERTAIN MULTI-STORY MULTI-FAMILY RESIDENTIAL BUILDINGS PROVIDED IN SEC. 553.899, FLORIDA STATUTES; PROVIDING DEFINITIONS; STATING INTENT AND AUTHORITY, PROVIDING APPLICABILITY AND AREAS OF ENFORCEMENT, PROVIDING NOTICE REQUIREMENTS; IDENTIFYING THE TYPES OF REQUIRED INSPECTIONS; DEFINING THE MINIMUM CONTENTS OF INSPECTION REPORTS; DESIGNATING POSTING AND PUBLISHING REQUIREMENTS FOR INSPECTION REPORTS; ESTABLISHING TIMELINES FOR REPAIRS; PROVIDING FOR ENFORCEMENT, AUTHORIZING EXTENSIONS; DESIGNATING PROCESS FOR IDENTIFYING AND REPORTING UNSAFE STRUCTURES AND FOR CONDEMNATION PROCEDURES; PROVIDING THAT EACH AND EVERY OTHER SECTION AND SUBSECTION OF CHAPTER 14. BUILDINGS AND BUILDING REGULATIONS SHALL REMAIN IN FULL FORCE AND EFFECT AS PREVIOUSLY ADOPTED; PROVIDING A CONFLICTS CLAUSE, SEVERABILITY CLAUSE AND AUTHORITY TO CODIFY, PROVIDING AN EFFECTIVE DATE; AND FOR OTHER PURPOSES. CONSTRUCTION SITE MAINTENANCE. BY CREATING AN ENTIRELY NEW SECTION 78-183. TEMPORARY SHELTER REGULATIONS. TO PROVIDE REGULATIONS FOR THE PLACEMENT AND USE OF TEMPORARY SHELTER STRUCTURES ON RESIDENTIAL LOTS UNDER LIMITED CIRCUMSTANCES FOLLOWING NATURAL EMERGENCIES; PROVIDING THAT EACH AND EVERY OTHER SECTION AND SUBSECTION OF CHAPTER 14. BUILDINGS AND BUILDING REGULATIONS. SHALL REMAIN IN FULL FORCE AND EFFECT AS PREVIOUSLY ADOPTED; PROVIDING A CONFLICTS CLAUSE, A SEVERABILITY CLAUSE AND AUTHORITY TO CODIFY, PROVIDING AN EFFECTIVE DATE, AND FOR OTHER PURPOSES. AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA, AMENDING THE VILLAGE CODE OF ORDINANCES AT CHAPTER 78. ZONING. ARTICLE IX SUPPLEMENTAL REGULATIONS, DIVISION 11. MOBILE FOOD VENDORS. TO CONFORM THIS SECTION TO RECENT CHANGES IN STATE LAW REGARDING PERMITTING AND OPERATION OF MOBILE FOOD VENDORS; PROVIDING THAT EACH AND EVERY OTHER SECTION AND SUBSECTION OF CHAPTER 78. ZONING. SHALL REMAIN IN FULL FORCE AND EFFECT AS PREVIOUSLY ADOPTED; PROVIDING A CONFLICTS CLAUSE, A SEVERABILITY CLAUSE AND AUTHORITY TO CODIFY, PROVIDING AN EFFECTIVE DATE, AND FOR OTHER PURPOSES. APPROVAL OF AGENDA MOTION: Member Leslee Dasher made a motion to approve the agenda. Member Elizabeth Shauer seconded this motion. Carried unanimously 5-0. APPROVAL OF MINUTES 1. Approval of previous meeting minutes from September 21, 2023 Chair Janet Strand made a spelling correction to September 21 , 2023 meeting minutes ORDINACE 11-23, fifth line subsection missing "C." MOTION: Elizabeth Shauer made a motion to approve with the correction. Seconded by Leslee Dasher. Carried unanimously 5-0. AGENDA ITEMS 2. AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA, AMENDING THE VILLAGE CODE OF ORDINANCES AT CHAPTER 14. BUILDINGS AND BUILDING REGULATIONS, BY CREATING A NEW ARTICLE W. STRUCTURAL MILESTONE INSPECTIONS. Village attorney Dylan introduced the ordinance with introduction of Lynn Britt from the Building Department. Attorney Dylan also gave background knowledge of the state legislative Senate Bill 154, companion 4D bill. Lynn Britt gave a brief explanation on the new restrictions and introduced the new building director, Wayne Cameron The board asked questions to Lynn, Wayne and the attorney regarding notifying apartment/ condominiums about the new legislative, registering buildings with the state of Florida, timelines, making the code stricter, pricing of inspections, who will be accompanied with the inspector, and concerns on obligations of the Village. Alternate Jeanne McEldowney made a comment on the pricing of inspections, training and raised concerns on the subject matter. Alternate Marie Sapirie made comments regarding including a backup memo, cross references and model ordinance. Sapirie also made comments on the language of the ordinance, scale of urgency, and the submittal of repair plans. Motion: Member Leslee Dasher made a motion to approve, Member Elizabeth Schauer seconded this motion. Carried unanimously 5-0. 3. AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA, AMENDING THE VILLAGE CODE OF ORDINANCES AT CHAPTER 14. BUILDINGS AND BUILDING REGULATIONS. ARTICLE Vlll. CONSTRUCTION SITE MAINTENANCE. BY CREATING AN ENTIRELY NEW SECTION 78-183. TEMPORARY SHELTER REGULATIONS. Village Attorney, Dylan introduced the ordinance with a brief explanation. Lynn Britt gave more information and background of the ordinance. The board gave positive comments on the ordinance, and questioned the building department on meeting with HOA's, and the criteria of the ordinance. Alt. Marie Sapirie made comments on the criteria of the ordinance. MOTION: Elizabeth Schauer made a motion to approve, member Theresa Maggio seconded this motion, carried unanimously 5-0. 4. AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA, AMENDING THE VILLAGE CODE OF ORDINANCES AT CHAPTER 78. ZONING. ARTICLE IX SUPPLEMENTAL REGULATIONS, DIVISION 11. MOBILE FOOD VENDORS. TO CONFORM THIS SECTION TO RECENT CHANGES IN STATE LAW REGARDING PERMITTING AND OPERATION OF MOBILE FOOD VENDORS; PROVIDING THAT EACH AND EVERY OTHER SECTION AND SUBSECTION OF CHAPTER 78. ZONING. SHALL REMAIN IN FULL FORCE AND EFFECT AS PREVIOUSLY ADOPTED; PROVIDING A CONFLICTS CLAUSE, A SEVERABILITY CLAUSE AND AUTHORITY TO CODIFY, PROVIDING AN EFFECTIVE DATE, AND FOR OTHER PURPOSES. Attorney Dylan introduced the ordinance with gave a brief background, then pointed out a spelling error section 78-642(i) "any" supposed to be an "and." Member Dasher questioned the timeline and requirements of temporary commercial kitchens. Alternate Marie Sapirie made comments concerning how customers are notified, requirements by state law, ensuring aesthetics regulations, and parking requirements. Jay Hubsch and the Village attorney, Dylan made comments on aesthetics and parking requirements. MOTION: The motion to approve Elizabeth Shauer, seconded by Leslee Dasher and carried unanimously 5-0. STAFF COMMENTS Jay Hubsch introduced the new planner on staff, Catherine Wagner. Catherine shared her excitement to be apart of the Village of Tequesta. PUBLIC COMMENTS BOARD COMMENTS Board nominated Vice Chair Leslee Dasher. Carried uniamiously 5-0. Reschedule December LPA meeting to December 19th.
