Bradford, Village Manager EOLif2 TA Date: 03/15/96 (51 FNAN QT. ti Subject: Response to Memo of29 Items �� J sP �95 Z 1'R\O- This is in response to your memo handed to me.on Wednesday, March 13th containing 29 suggestions or inquiries for Staff and/or Village Council consideration. My responses are in the same order as yours, as follows: 1) This is a policy decision of the Village Council. In my opinion, there is no need for a separate Communications Committee of Village Council since the same can be adequately dealt with under Finance and Administration. 2) The 25% surcharge on water went in effect on 10/01/95. Therefore, a full year has not yet passed. Proceeds through February are $ 96,942 . Surcharge amounts of a lessor percentage existed prior to 10/01/95. Proceeds are on track (97%) with that anticipated ($240,000). 3) This is a policy decision of the Village Council. It wouldn't hurt to clean up and organize the presentation of agendas in the front office. 4) The library will allow placement of a Code book in the Reference section so long as Tequesta guarantees it is always current and enters into a Hold Harmless Agreement with the Library relative to the same . This is not as simple as we would all like it to be. People take action and spend money based upon what they think the Code says. The most accurate and up to date source is always to go to city hall for the info. If someone removes a portion of the Code from the book for whatever reason, under the Library's policy, Tequesta would be liable for damages from the person who relied upon the same. 5) The library will accept limited copies in legal size or smaller of maps for placement in their "vertical file”. I would suggest we give them a copy of our zoning, address and property maps. 6) This is a policy decision of the Village Council. 7) This is a policy decision of the Village Council. 8) This is a policy decision of the Village Council. In the end, the priorities will be those adopted by the Village Council. 9) There are a total of 6 repairs scheduled due to the October flood. This list will be placed in your mail. The five-year capital improvement program lists all other roadway repairs and is indicated on page 38 of the 1996 Annual Budget and Financial Report which I believe you have a copy of Except for the actual fiscal year adopted,these capital projects are dynamic, and as such, are subject to change due to a variety of factors, not the least of which has to due with funding capabilities at a given time in the future. A road pavement schedule is being prepared for inclusion with the Budget proposal for FY 1997. All roads in the Village are to be addressed. Since all roads are to be addressed and all plans are subject to change, in my opinion, a map would be superfluous because people can look at the capital plan to see the anticipated plans for their street. This would be a decision of the Village Council and, at any rate, could not be done until after the budget is adopted, which makes the plan "final", at that point in time, assuming you want to include the pavement schedule on such a map. 10) This is a policy decision of the Village Council. 11) The Police Department maintains such a map on an office wall for internal purposes. This is not necessarily something to made public since it also reveals where the law enforcement focus is and, consequently, where it is not. Please contact the Chief of Police in order to review the same. Tequesta FDLE statistics will be provided to you. These are periodically reviewed by the Public Safety Committee members for effectiveness and this would be the venue for presenting the same if so requested by the Committee members. Benchmarking, in order to provide meaningful data to decisionmakers, should entail comparisons to comparable cities using comparable indices. You will need to tell us what areas you wish to compare, however, the FDLE data we give you could include adjacent agencies for you to compare with. It takes approximately 60 days to receive this information from Tallahassee on other agencies. Depending on the extent of the benchmarking you have in mind, funding may have to provided by the Village Council in order to undertake such..Total traffic tickets written will be given to you. Computer records are not kept relative to speed over posted limit. Computer records on contested tickets are not available and to secure such would require a manual review of our records which are only kept for 3-6 months. The Violations Bureau at the North County Courthouse advises that a manual search of other agencies would have to be conducted by Tequesta to get records on contested tickets. This would not be a cost effective undertaking. Also, many traffic citations require a mandatory court appearance. Lastly, the Village Council will need to tell us specifically which agencies to compare with before we undertake any efforts. 12) The Fire Department will provide you with a map of their reporting zones and statistics for each. You may have to draw your own conclusions about effectiveness since reporting is not as standardized in fire as it is in police. This data is periodically reviewed by the Public Safety • Committee members . Benchmarking, in order to provide meaningful data to decisionmakers, must entail comparisons to comparable cities using comparable indices. Depending on the extent of the benchmarking you have in mind, funding may have to be provided by the Village Council in order to undertake such. 13) This is a policy decision of the Village Council. Any proposed school would require a special exception public hearing to be held,which is a quasi-judicial hearing. The Village Council should refrain from predetermining the merits of any such proposal or application in order to maintain legally required impartiality in such a quasi-judicial hearing. The Church of the Good Sheperd is • moving forward with such at this time. Typically, schools take property off the tax role which Tequesta can ill-afford at this time. Preferably, Tequesta needs development of new residences, since this is the only market with potential, to build the tax base and provide new customers for • our existing businesses. The task force could be done, but the Village Council should not be involved with it for the reasons stated above. 14) This is a policy decision of the Village Council. This may be a task best left to the Chamber of Commerce since you seem to be interested in something more regional than the Village. This could be part of the Chamber's Economic Niini-Summits that are held periodically. Tequesta could participate in such . 15) This matter is scheduled for the next Public Works Committee meeting. A Comp Plan consistency review is required to occur prior to the adoption of the ordinance per the attorney's office. Limitations on the size of the districts cannot be imposed in the ordinance. 16) We can do this, but we have no plans to expand the presence. I am not familiar with what this entails. 17) This is a policy decision of the Village Council. This can be done. Placement of the table cannot block the entrance/exit so perhaps we could set this up outside , on the porch. 18) Chief of Police will review legality of same and, if allowed, will post at northwest corner of intersection of Cypress Drive and Pineview Road. 19) As required by State law, the occupational license schedule was reviewed and recommended by the Tequesta Equity Study Commission about two years ago. The Equity Study Commission consisted of three Chamber of Commerce members John Giba, Mac Goodner and Ed Nelson. You may review the same at Section 11-27 of the Code of Ordinances. 20) A copy of the occupational license application will be provided to you in your mail. It describes the procedures. These procedures are mandated by State law and cannot be altered. See adopted NFPA 1 Fire Prevention Code at Section 1-8.4 and adopted Standard Fire Prevention Code , Chapter 4, Permits and Certificates as a reference. 21) There are none. • 22) This is a decision for the Village Council. A synopsis of this ordinance is scheduled to be in the March issue of the monthly newsletter. 23) This is a policy decision of the Village Council. I will have to ask the Library if they would accept ordinances outside of being in the Code book, which is another problem unto itself. See item 4 above.. Based on my previous conversations with them, I doubt that they will. 24) This is a policy decision of the Village Council. Improvements could be made, but it's not cost effective to notify everyone in town by mail or phone when the Village is passing an ordinance which effects all. Notice should always be by mail to ensure continuity in the delivery of the notice. 25) This is a policy decision of the Village Council. Charter amendment requires voter approval and I believe there is a great deal of case law which indicates that wards and districts have to be based on equal population to ensure the " one man, one vote " or equal representation rule. This would preclude doing same based on precincts. With Tequesta being only 2 square miles in size, a very good argument can be made that this town is too small and homogeneous for districting. • 26) This will be provided to you as has been the case for all Councilmembers. I will send you the last report done by.the Department of Community Developement to bring you up to speed . The Village has not yet contacted those in the last category, but will be doing so shortly. 27) The Comprehensive Annual Financial Report (CAFR) for the fiscal year ended 09/30/95 is scheduled for Village Council acceptance at your April meeting. This would be your best source for Water Department financial status. The Department has a Moody's rating of Aaa and a Standard and Poor's rating of AAA, the highest possible for each organization. The plant is a Class B facility having a maximum capacity of 2.7 mgd with raw water from surficial aquifer wells. The status of water capital projects has been provided to the Village Council once per month. I will give the March report to you in your mail. The projected financial status of the Water Department is that bonds must be issued to complete Reverse Osmosis projects. This cannot be projected until all final decisions about bond requirements are concluded and financial integrity will be a factor effecting the amount of finds to be borrowed. This is an upcoming matter for the Finance and Administration Committee. In the future, it is anticipated that the plant will be a Class A facility producing a maximum of approximately 6.0 to 6.7 mgd blending surface well water with brackish water from the deep Floridan Aquifer. There are no projected expansions of our service areas. Growth in demand has and will come from the existing service areas not yet fully developed and , unfortunately, from per capita domestic consumption growth. 28) This proposal would be a violation of law. However, if all things are equal, including price, you may give purchasing preference to Tequesta merchants, which we do. I will send you backup information on this for your review. 29) Public Works has none. They are simply removing exotic and/or dead vegetation from the property as required by local law.
