Subject: Stormwater Utility; Billing Methodology; Agenda Item
In the past, the Village Council has indicated that if and when
the Village moves toward implementation of its stormwater
utility, that it would prefer to have the charges for the same to
appear upon the property tax bill . A review of the Ordinance
creating the stormwater utility indicates that this option was
not included within the enabling legislation. Therefore, we
would recommend that the Tequesta Stormwater Utility Ordinance be
amended to allow this option for the Village.
Meanwhile, the Village consultants are working on the stormwater
utility creation effective October 1, 1996, and in order to allow
for the charges to be applied to the property tax bill, the
Village Council needs to provide an indication to staff at your
January 11, 1996, Village Council Meeting of your desire to
proceed with such changes on the tax bill so that the
advertisements for the required Public Hearing to be held at the
February 8, 1996, Village Council Meeting can take place
according to law. This recommended action does not establish the
applicable fee for the stormwater utility, but rather begins the
process necessary to enable the same to appear on the property
bills to be mailed November 1, 1996 . The decisions relative to
the fees associated with the stormwater utility will be made by
the Village Council in May or June of 1996 in accordance with
State law.
It is recommended that the Village Council give staff direction
to proceed with the necessary advertisements to conduct a Public
Hearing on February 8, 1996, wherein the Village Council will
consider its intention to provide for stormwater utility charges
on the property tax bill as a non-ad valorem assessment.
