CALL TO ORDER AND ROLL CALL The Tequesta Community Appearance Board held a meeting at the Village Hall, 357 Tequesta Drive, Tequesta, Florida, on Wednesday, October 11, 1995. The meeting was called to order. at 9: 35 A.M. by Chair Leslie Cook. Boardmembers present were: Chair Leslie Cook, Vice Chair Vic Strahan, Paul Coben, Claudette Dalack and Alternate Molly McCormick. Also in attendance was Joanne McCabe, sitting in for Scott D. Ladd, Clerk of the Board. II . APPROVAL OF AGENDA The agenda was approved as submitted. III. APPROVAL OF PREVIOUS MEETING MINUTES Boardmember Coben requested that the word "understoried" be replaced with "underplanted". The minutes of the September 27, 1995 were approved as submitted. IV. NEW BUSINESS 1 . An application from Parker-Yanette Design Group, Inc. , for review of preliminary landscape plans for Ordinance #377 compliance for the property located at 351 Cypress Drive. Mr. Chuck Yanette, representing Parker-Yanette Design Group, Inc. , and Mr. Carmine Mannara, the owner, were present at the meeting. During discussion of the requested landscape waivers, Chair Leslie Cook questioned whether the three palms in the right-of-way referred to Recycled Paper COMMUNITY APPEARANCE BOARD MEETING MINUTES OCTOBER 11, 1995 PAGE 2 in waiver requests (2) and (4) were the same group of trees, to which Mr. Yanette responded that they were. Boardmember Coben commented that the there was no way to adjust the parking lot to adjust to current standards . Vice Chair Strahan suggested that a planting bed could be added at the southeast corner of the building. Suggestions made for the bed were a ligustrum tree or a Sabal palm with liriope planted underneath. Mr. Mannara explained there was an overhang from the building. Chair Leslie Cook expressed concern that the existing landscaping at the rear of the building was messy and was pleased that a hedge of Simpson Stopper had been proposed by the applicant, which would help screen the rear of the building from the adjacent residential area. Another concern expressed by Chair Cook was the lack of an irrigation system. Mr. Yanette explained that all of the plants which had been chosen were varieties which could be weaned off water after they had become established. Mr. Mannara stated that the tenants had volunteered to water the plants. Vice Chair Strahan pointed out that under the application that the applicant was obligated to keep the plants in the same condition as when they were originally planted. Joanne McCabe reminded the Board that an irrigation system was required by Village Code. Mr. Yanette explained that the asphalt would need to be cut all over to provide an irrigation system. Discussion ensued as to options for providing irrigation. Mr. Mannara explained there was a water line at the rear of the building from which water for automatic irrigation of the rear landscaping could be obtained. Chair Cook suggested that automatic irrigation at the rear could be extended by running a line on top of the ground around the side of the building to the front since it was a narrow space between two buildings and no one would ever see it. The Board decided not to require an automatic irrigation system for the proposed island bed in order to save the expense of cutting the asphalt, however, Boardmember Coben requested that since they were cutting the asphalt away to make the bed that they look at whether it would be feasible to run an irrigation line to the bed. COMMUNITY APPEARANCE BOARD FETING MINUTES OCTOBER 11 , 1995 PAGE 3 The Board discussed the types of plants for the proposed island bed at the southeast corner of the building. Mr. Yanette favored plants that would tie in with the other proposed landscaping. The Board decided upon a Sabal palm with Simpson Stopper planted around it which could be maintained at 3 to 4 feet . Requested landscape waivers were as follows: East Property Line (Cypress Drive) 1 . 10 ' landscape strip required, 0 ' provided. 2 . 3 trees required, 1 (3 palms) provided (plus 3 palms in right-of-way) . South Property Line (Pineview Drive) 3 . 10' landscape strip required, 0 ' provided. 4 . 4 trees required, 1/3 (1 palm) provided (plus 3 palms in right-of-way) . West Property Line (Alley) 5 . 5' -6" ht. solid opaque fence or wall required, 5' chain link fence provided. Parking Area 6. Row of 2 parking spaces on south side of building: 2 end islands and 2 trees required, 0 provided. 7 . Row of 6 parking spaces on east side of building: 2 end islands and 2 trees required, 1 provided. 8 . 4 ' landscape area required between building and parking area, 0' of landscape area provided. 9. 24 ' maximum accessway width from Cypress Drive, 83' provided. 10 . 24 ' maximum accessway width from Pineview Drive, 105' provided. Maximum 50% of trees provided to be palms, 66% palms provided. 13 . Automatic irrigation not provided, proposed plants to be irrigated by hand. Vice Chair Strahan made a motion to accept the application as submitted with the addition of an automatic sprinkler system on the west side of the building, which will also feed the planting on the northeast corner; plus the addition of a bed opposite the southeast corner of the building (minimum size 5' x 5') large enough to hold a Sabal palm and Simpson Stoppers, but small enough not to preclude the passage of traffic from the east to south side of the building. Boardmember Coben seconded the motion. Chair Leslie Cook stated that the Board would request a waiver to the code requirement that three palms must be planted to equal one tree since there was only room for one palm, and this would count as 1/3 tree. Joanne McCabe commented that Waiver 12 percentages would be changed by the addition of this palm. The motion carried by unanimous vote of 5-0. Chair Leslie Cook commented that the Simpson Stopper would be three gallon size. 2. An application from Parker-Yanette Design Group, Inc. For review of preliminary landscape plans for Ordinance 1377 compliance for the First Presbyterian Church of Tequesta, 482 Tequesta Drive. Mr. Steve Parker, Landscape Architect with Parker- Yanette Design Group, Inc. , and agent for First Presbyterian Church, was present. Dr. C. Patrick Shaffer and Jed Householder were present as representatives of the applicant. Mr. Parker summarized the additions which would be made to the landscaping: six live oaks in the parking area; COMMUNITY APPEARANCE BOARD MEETING MINUTES OCTOBER 11 , 1995 PAGE 5 six slash pines along the south property line to fill gaps between existing pine trees; 199 Simpson Stopper plants along the edge of the parking lot, in the back, and to help screen from the front along Tequesta Drive. Mr. Parker stated that any Brazilian Pepper would be removed. At the request of Chair Leslie Cook, Mr. Parker agreed to cut out asphalt next to the dumpster and to add a hedge in that space to screen the dumpster from the street. Vice Chair Strahan suggested beefing up landscaping at the entrances on Point Drive and on Tequesta Drive by installing Simpson Stopper larger than the 24" proposed in order to screen the large asphalt parking area from the roadways. Boardmember McCormick commented that her home was on adjacent property and that she walked her child to the bus on the sidewalk along the naturally preserved area. Boardmember McCormick expressed concern that the grass near the sidewalk was not well maintained, and commented that she had called the police numerous times because of youngsters congregating there, smoking, setting fires, etc. Discussion ensued regarding removal of the Brazilian Pepper in that area. Chair Leslie Cook expressed her disapproval that it would have to be removed according to the code, and stated the birds would just carry the seeds from private property and it would grow back. Landscape Architect Parker commented that removal of the Brazilian Pepper would improve visibility through the area which would help the problem of the young people congregating there. Dr. Shaffer commented that there was a basketball goal on the church property which belonged to the Village. Mr. Parker requested the following landscape waivers: PARKING AREA: 1 . Two 6' x 20' landscape islands with 1 shade tree each required, 0 proposed. 2 . One 6' x 20' landscape island with 1 shade tree required, 0 proposed. 3. Automatic irrigation required, irrigation provided only in building area, not around perimeter or parking lot. Vice Chair Strahan commented that the major problem was that there were no landscape islands in the parking lot . Joanne McCabe explained that this church property should be treated no differently than other commercial property such as a shopping center, and that the Board must be able to defend its actions. Vice Chair Strahan commented that Joanne was saying that if the Board made a decision to buffer this property from the outside and not to add islands inside, that would, in effect, be saying to a shopping center owner that he could do the same thing. Mr. Householder explained that the church needed all the parking spaces and also that they were having financial problems at the present. Boardmember McCormick commented that the parking lot was never full . Discussion ensued regarding landscape islands versus a landscape median. It was the consensus of the Board to add islands since there was not room for the median without reconfiguring the whole parking lot, which would be very expensive. The Board discussed the number of landscape islands they preferred and the location. After a suggestion was made to reduce the buffer materials and to use some of those plants ,in the islands, Chair Leslie Cook suggested eliminating pine trees along the south property line except for the corners so that pine needles would not be a problem for adjacent residents with pools . • COMMUNITY APPEARANCE BOARD MEETING MINUTES OCTOBER 11 , 1995 • PAGE 8 • Vice Chair Strahan made a motion to accept the application with the following modifications: In place of Waivers 11 and 12 requesting 0 landscape islands that two islands be provided, one per Waiver 11 and one , per Waiver 12; and that Waiver 14 be changed to give permission to omit the screening fence along the south and west sides of the property; and to delete Waiver 15; and that on the south side of the property where nine pine trees were proposed only three be planted; and that at the Point Drive entrance additional landscaping be provided along the east side of the existing dumpster to completely screen the dumpster enclosure from Point Drive; and at the Tequesta Drive entrance to the parking lot the proposed Simpson Stopper at MF27 on the landscape plan be increased in height from 24" to 48" with the number of plants reduced by 1/3, from 27 to 18. Boardmember Coben seconded the motion, which carried by unanimous vote. • Therefore the following waivers were changed to read as follows: 11 . Row of '28 parking spaces : 2 - 6' x 20' landscape islands with 1 canopy tree each required, 1 provided. 12. Row of 28 parking spaces: 2 - 6' x 20' landscape islands with ' 1 canopy tree each required, 1 provided. 14 . The 6' high screen fence required along the west and south shall be omitted. Waiver . 15 was omitted and the remaining waivers renumbered. 3. An application from Innocenti & Webel for review of preliminary landscape plans for Ordinance #377 compliance for the Hart Building, 169 Tequesta Drive. Landscape Architect Bert Krebs represented the COMMUNITY APPEARANCE BOARD MEETING MINUTES OCTOBER 11 , 1995 PAGE 9 petitioner. Also present was the owner, Jerry Brabon. Mr. Krebs explained that this property presented a difficult situation with its extensive paving and space constraints which could only provide minimal landscaping. The following waivers were requested, along with the Landscape Architect' s explanations and proposals: 1 . Perimeter Landscaping (A) A 5' landscaping strip is required on the north and east property lines. This building was designed and constructed at a time when landscaping was not considered an important improvement to off-street parking areas; thus there were no perimeter landscape strips installed, nor was there space to provide them in the future. We are trying to accommodate a landscape strip on the east property line by removing a 2 ' wide strip of the asphalt behind the wheel stops. This will provide a 2 ' landscape strip along the east property line which will be planted with Pineland Threeawn, a low groundcover, so the bumpers of cars can overhang the wheel stop. For several reasons we have left the site as it exists along the north property line. The adjacent building (the 112 Building) was constructed on the property line, which poses several constraints: first, the likelihood of a footer below the asphalt would prevent the possibility of planting; secondly, planting ground covers in front of the large wall will be ineffective (therefore, the plants slated for this area have been utilized in the parking islands for a greater effect) and, thirdly, removing asphalt for an area which may not be able to be planted is impractical. COMMUNITY APPEARANCE BOARD MEETING MINUTES OCTOBER 11 , 1995 PAGE 10 (B) The ordinance states only 50% of all trees planted shall be palms . Existing on site are two Queen Palms . We are proposing to plant four Live Oak trees and six Sabal Palms . Of the 12 trees total, 66% are palms. The proposed palms are specified because they are planted next to tall buildings which need a taller, narrow landscape element that a palm tree provides . The use of palms creates a more successful aesthetic result even though it is a greater financial investment. 2 . Interior Landscaping Commercial Parking Areas The ordinance requires 9 - 6' x 20 ' (1080 S . F. ) Landscaped islands at the end of each parking row. The site currently exists with no landscape islands. We are proposing to remove asphalt and create six landscape islands which vary in width from 10' - 17" x 20 ' long (1540 S. F. ) So even though we have three fewer islands than required, we do have 460 S. F. more, or nearly the area of four landscape islands. In addition, these islands are fully planted with shrubs and groundcover- -no sod. 3 . Landscaping Surrounding Principal Structures The ordinance requires parking to be separated from the structure with a 4 ' wide landscape strip. Currently the parking is adjacent to the building on the north and to a sidewalk on the east so there is not space to create a 4 ' wide landscape strip. We are attempting to comply by removing a 2-1/2' wide strip of asphalt behind wheel stops. This will create a 2-1/2' wide landscape strip which will then be planted with Pineland Threeawn or Liriope. Stepping stones have been provided at the intersection of the striping and the sidewalk so patrons will be inclined to step on the COMMUNITY APPEARANCE BOARD MEETING MINUTES . 00TOBER 11 , 1995 PAGE 11 stone and not the planting. 4 . Additional Requests The ordinance requires 15% minimum (2581 S.F. ) of the gross parking area (17, 208 S. F. ) To be landscaped. The site currently exists with 0% • (0 S.F. ). Of the gross parking area landscaped. However, we have managed to dedicate 14% (2414 S.F. ) of the gross parking area to landscaping • by cutting out and removing the asphalt and sub-base from surplus parking spaces . Chair Leslie Cook questioned an area parallel to Tequesta Drive at the corner of the building which had landscaping next to it and appeared to have been a landscaping bed which was now covered with asphalt, and was told that area would be landscaped, and that where plants had died in the existing landscaping that new plants would be used to fill in. The large wall of the adjacent building was discussed; however, since it was not the property of this landowner nothing could be done to the wall, and because of the building footer a landscape strip could possibly not be installed. Boardmember Dalack made a motion to approve the application as submitted with the exception that any dead landscaping on Tequesta Drive be replaced and filled in with the existing plants. Boardmember McCormick seconded the motion, which carried by unanimous vote. • • The Board agreed that the applicant had done a good job. Mr. Krebs described the plants he had chosen, and was complimented for choosing different types of plants which were native. Mr. Krebs suggested that the Village might. want to add White Indigo Berry to its preferred plant list, stating that it was very salt tolerant. V. UNFINISHED BUSINESS COMMUNITY APPEARANCE BOARD MEETING MINUTES OCTOBER 11 , 1995 PAGE 12 Chair Leslie Cook stated she had called and complained about the size of plants used at the library, and had met with Village Manager Bradford and reviewed the checklist of items which the contractor must complete. Chair Cook described things that had been done incorrectly at the site. Boardmember Dalack expressed concern that the drain field was so deep, and was told that it was an area for rainwater runoff from the parking lot and was not expected to fill with water. Chair Cook commented that the plans had been rather vague and as a result, slow-growing plants had been placed behind fast-growing plants and would soon be hidden. Village Manager Bradford had sent a letter to Gee and Jenson who had overseen the project, and there was a possibility the plants could be adjusted. Chair Cook also explained that since proper grading had not been done that irrigation water would just drain off. Boardmember McCormick left the meeting at 11 : 08 A.M. VI . COMMUNICATION FROM CITIZENS Wade Griest explained that at the next night' s Village Council meeting, second reading was scheduled for a change to Zoning Regulation 355 to require Village Council approval of a project before Community Appearance Board approval, and stated he did see how that would expedite matters. Mr. Griest questioned what would happen if the Village Council approved a plan and the Community Appearance Board disapproved. Boardmember Coben commented that he interpreted the change to mean the Village Council could approve a project without the Community Appearance, Board. VII . ANY OTHER MATTERS Vice Chair Strahan referred to a flyer which had been placed in his door the previous evening titled Warning, stated that it was unsigned and was very much opposed to proposals by the Village Council. Joanne McCabe explained it was a Code Enforcement matter, and dealt with residential properties to establish minimum upkeep standards. Chair Cook questioned when this matter had come up and stated that the Community Appearance Board had tried for years to get the Village Council to pass something to support the Board in providing a uniform look to the Village, i.e. , Mediterranean, Bermuda, COMMUNITY APPEARANCE BOARD MEETING MINUTES OCTOBER 11 , 1995 PAGE 13 or South Florida look. Discussion ensued, during which Chair Cook commented that the flyer was a scare tactic, and that she disagreed with the concept of only a principal building color and a trim color, since many homes used two trim colors, and stated that taste could not .be regulated.
