PROCEDURES FOR OPT-OUT 1) The opt-out member must decide what type of alternative plan they desire; 1) Defined Contribution Plan, or 2) Defined Benefit Plan. 2) If the new alternative plan will be a defined benefit plan - must have actuarial report prepared and certified by an enrolled actuary illustrating the cost to the municipality or independent special district and to its future employees. Defined contribution plans do not require actuarial certification. (The League can provide a hypothetical employee census for prospective new employees that will satisfy this requirement for each type plan.) 3) If the municipality or special district has a collective-bargaining unit, a copy of the proposed alternative plan and actuarial report must be given to each representative. (The approved alternative plan for Special Risk units (fire, police) that opt out of FRS must meet or exceed the benefits outlined in CH. 175 or 185 FI. Stat.) 4) Notice of public hearing regarding revocation from FRS must be published in general circulation newspaper 7 - 15 days before public hearing. The notice must state the time and place of the meeting and the intent of the hearing. Proof of publication must be submitted to the Division of Retirement. • 5) A Public hearing must be held on the proposed revocation and proposed alternative plan within 7 - 30 days prior to adoption of revocation. 6) Written notice of revocation must be provided to the Division of Retirement by mailing a copy of the resolution to the division postmarked no later than December 15, 1995 to be effective January 1, 1996. The new plan document does not have to be adopted until there are real employees.
