Tom, attached are 18 packets and plans for the above subject project which was
reviewed by the Community Appearance Board on July 26, 1995.
The Board discussed each of the requested waivers and expressed no major concerns
with this application and were generally in support of the proposed landscaping subject
to the items listed in the motion.
Motion to approve the proposed landscaping and waivers for the north and south
boundaries of the property with the rest of the proposal to be approved by the Village
Council, subject to the landscape architect providing the quantities of existing and
.\proposed plants and trees, the current and proposed percentage of native plants and
trees and the percentage of palms to canopy trees, and providing a phasing schedule.
Vote on the motion: 4-0 to approve.

JUSTIFICATION OF WAIVER: ( SUPPORTING DATA. WHY APPLICANT FEELS
WAIVE
SHOULD BE GRANTED) Waiver should be granted because the spaces
are a jacent to the property line and there is no green space available.Th
parking spaces are assigned to specific units and are used by elderly
residents. Other properties (Tequesta Shoppes) have installed trees
within the R.O.W. to satisfy this landscape requirement.

WAIVER APPLICATION
Dear Mr. Ladd:
Per your meeting and discussions with Ms. Leslie Darrigan, the President of Waterway Beach
Condominium Association, please find attached one copy each of the following documents:
• Waiver Application and check for $125.00
• CAB Application as per June 23rd mail received
• Master Landscape Plan @ 1"=20 scale with existing landscaping, proposed
covered parking structure and future planting
• Photographs of site for refereace of the existing planting
As briefly mentioned in the waiver application, the Association does not comply with the current
Landscape Ordinance within two areas: a) along the southern property line adjacent to the Waterway
Road R.O.W. and b) along the northern property line adjacent to the development Tequesta Cove.
The association is requesting that the 10' wide landscape buffer (at the southern property line), the 5'
wide landscape buffer (at the northern property line) and the terminal island planting requirements be
waived due to the following reasons:
1. The site plan and boundaries (+- 5 AC) were approved and developed 25 years ago. The
southern property line as it was developed is also the edge of pavement for the angled parking area. The
parking area adjacent to the southern property line consists of eleven spaces, six spaces assigned to
residents within E Building Annex and ten spaces of which are assigned to guests of both buildings for
that area. To comply with the 10' landscape buffer in this area would eliminate the angled parking spaces
and inconvenience the elderly residents. To include terminal islands at the end of the parking spaces
would also eliminate two parking spaces and increase the difficulty of departing the covered parking area.

2. The Waterway Road R.O.W. /utility easement area is 20' wide to the edge of pavement.
There is also an existing 4' Chalcas hedge along the entire property line which is in good condition; this
hedge provides a sufficient buffer to screen the vehicle use area. There are several existing trees within
this buffer which occur predominantly on the east and west ends of the parking area. The association is
proposing to add eight (8)trees within the R.O.W. at 30' on center adjacent to the existing hedge which
partially complies with the new ordinance. The attached plan indicates both existing and proposed trees
to satisfy the ordinance. The open green area adjacent to Waterway Road provides a sufficient separation
from this property.
3. It appears that the adjacent property to the west, Tequesta Shoppes, has satisfied the landscape
requirement by planting oak trees within the R.O.W. Our proposed oak tree planting will be consistent
with the existing trees and reinforce the planting concept along Waterway Road. If a smaller tree is
required due to the existing utility lines, the tree of choice would be one of the following: *Eriobotrya
japonica. (loguat); Conocarpus erectus (buttonwood), Magnolia grandiflora (magnolia), or Swietenia
mahogani (mahogany). *1st choice because of fast growth rate.
4. Along the northern property line as shown on the plan, there is an existing 6' wall located
4' from the ege of pavement (on the adjacent property) and within that 4' there has been planted large
oleander shrubs. To comply with the buffer requirement of 5' wide, the asphalt would have to be
removed and replaced with landscaping. This reduction in pavement length would again make it difficult
for elderly people exiting the covered parking areas.
The project has been developed with +-60% open space and at this time has no plans for additional
development other than the addition of a covered parking area as shown on the Master Plan. The existing
planting is +85% xeriscape and is gradually being renourised and/or replaced with plant selections from
the SFWMD Xeriscape Plant Guide. The existing planting exceeds the minimum percent required based
upon the vehicle use area (required 15% of VUA and provided 18%). Future areas of planting are also
indicated on the enclosed plan and occur at the eastern most entry along Waterway Road.
The Association therefore requests a waiver for the landscape based upon the reasons stated above. If you

Dear Mr. Ladd:
As a follow-up to the initial presentation to the CAB, please find enclosed 3 sets of proposed
planting plans (Scale 1"=10') for the following areas:
*Phase I & II - Oak trees along Waterway Road and South East Entry
•Phase III - North Entry
•Phase IV - Main Viewing Garden
*Phase V - Ongoing Restoration (NO DRAWINGS)
•Original Master Plan - Scale 1"=20' (As Previously submitted)
Also enclosed is an inventory of the existing plant material with the requested percentages of
native plants and percentages of palms to shade trees. (See attachment A). Also included is a
proposed plant list corresponding to the proposed plantings in Phases I-IV as shown on Sheet
L-2 (See attachment B).
The association is proposing that each Phase will be equivalent to one year so they can
appropriately budget for the planting modifications that have been proposed. Phase V will
include the following (No graphics shown):
1) Replacement of dead, dying, or diseased plants will occur on an as needed basis.
These plants will be replaced with the same plant, a native plant or a xeriscape plant. Please
recall from our presentation that 98% of all the existing plants are xeriscape.
2) It is at my suggestion that all existing Eucalyptus trees be replaced (over the five year
time frame) with a Live Oak tree. The majority of these trees occur along the access road
(western boundary) and the replacement trees will be planted at 30' o.c. as they will be done

along Waterway Road. This landscape treatment is not represented in plan form but it is included
in the proposed planting calculations (See Attachment B , QV-1). The Norfolk island pine and
some of the carrottwoods may also be replaced if they begin show signs of distress.

any additional information you may require and I look forward to hearing from you in a timely
manner. -

I. CALL TO ORDER AND ROLL CALL
The Tequesta Community Appearance Board held a meeting at -
the Village Hall, 357 Tequesta Drive, Tequesta, Florida, on
Wednesday, July 26, 1995 . The meeting was called to order
at 9 : 33 A.M. by Chair Leslie Cook. Boardmembers present
were: Chair Leslie Cook, Vice Chair Vic Strahan, Paul
Coben, and Claudette Dalack. Also in attendance was Scott
D. Ladd, Clerk of the Board.
II. APPROVAL OF AGENDA
The agenda was approved as submitted.
III. APPROVAL OF PREVIOUS MEETING MINUTES
Boardmember Coben requested a change from west to north on
page four of the July 12, 1995 minutes. The minutes were
then approved as amended.
IV. NEW BUSINESS
1. An application from Waterway Beach Condominium
Association for review of preliminary landscape plans for
Ordinance #377 compliance. Debra L. Northsea, Landscape
Architect.
Ms. Northsea introduced Leslie Darrigan, President of the
Waterway Beach Condominium Association, and a resident,
Howard Treu.

Ms. Northsea stated that a wavier was requested from the
10-foot wide landscape buffer at the southern property
line, the 5-foot wide landscape buffer at the northern
property line, and the terminal island planting
requirements .
Ms . Northsea explained that the southern property line
was also the edge of pavement for the angled 11-space
parking area and that compliance with the 10-foot
landscape buffer in that area would eliminate the parking
spaces and inconvenience the elderly residents. To
include terminal islands at the end of the parking spaces
would also eliminate two parking spaces and increase the
difficulty of exiting the covered parking area.
Ms. Northsea stated that the association proposed to add
8 trees within the Waterway Road right-of-way at 30 ' on
center adjacent to the existing 4' Chalcas hedge. The
oak trees would be consistent with the existing trees
planted by the adjacent western property; however, if a
smaller tree were necessary because of existing utility
lines the preference would be mahogany.
Ms. Northsea explained that along the northern property
line an existing 6' wall was located 4' from the pavement
on the adjacent property, and within that 4 ' there had
been planted two large oleander shrubs. In order to
comply with the required 5-foot buffer the asphalt would
have to be removed and replaced with landscaping, and the
reduction in pavement length would make it difficult for
the elderly residents to exit the covered parking area,
since they must negotiate a vertical column every two
spaces, and most of them had large cars.
Ms. Northsea commented that 60% native vegetation had not
been provided on the plan, but all of the plantings were
from the xeriscape plant guide; and proposed that 85%
native plants would _be installed in future plantings in

lieu of the whole property being at 60%. The required
15% of landscaping for the vehicle use area had been
exceeded, since it was at 18%, and there was in excess of
60% open space on the project. Ms. Northsea explained
that she was under contract to prepare a master planting
plan for the association, that an additional carport was
planned for construction this summer, and that the trees
at the southern boundary, the intersection, and the main
entry would be planted this summer.
Chair Leslie Cook stated she had gone to the property and
there was nothing that could be done along the north
border. Ms. Northsea requested permission to submit a
list of drought tolerant and salt tolerant native plants
to the Board for this property and suggested magnolia be
used in lieu of mahogany trees. Clerk of the Board Scott
D. Ladd provided further information in regard to actual
percentages, phasing, and the master plan, and clarified
that the carport construction would need to be a separate
application.
Boardmember Dalack made a motion to accept the waivers
for the north and south boundaries 'of the property, with
the rest of the proposal to be approved by the Village
Council subject to all of the items discussed at today's
meeting. Motion was seconded by Vice Chair Vic Strahan
and passed by unanimous vote.
