HomeMy WebLinkAboutDocumentation_Regular_Tab 10B_11/9/1995 RESOLUTION NO. 5 - 95/96 A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, APPROVING A PROFESSIONAL SERVICES AGREEMENT WITH GEE & JENSON FOR A STORMWATER UTILITY RATE ANALYSIS AND MASTER PLAN AND AUTHORIZING THE VILLAGE MANAGER TO EXECUTE THE SAME ON BEHALF OF THE VILLAGE. NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, AS FOLLOWS: Section 1. The Gee & Jenson Professional Services Agreement to prepare the Stormwater Utility Rate Analysis and Master Plan, attached hereto as Exhibit "A" and incorporated by reference as a part of this Resolution, is hereby approved and the Village Manager of the Village of Tequesta is authorized to execute the same on behalf of the Village of Tequesta. THE FOREGOING RESOLUTION WAS OFFERED by Councilmember , who moved its adoption. Bradford, Village Manager A pp FROM: Gary Preston, Director of Public Works DATE: November 1 , 1995 SUBJECT: Village Council Agenda Item for November 9, 1995 Engineering Services Proposal from Gee & Jenson For Stormwater Utility Rate, Study and Master Plan in the Amount of $38,000 Please find attached, the above referenced proposal from Gee & Jenson, to provide the Village with all necessary data in the area of capital improvement cost estimates, NPDES cost, repairs to existing drainage facilities and stormwater utility management program for the Village Stormwater Utility. This data will allow the Village to set an accurate rate for each property owner for stormwater drainage improvements. The Village Council allocated $38,000 in FY 96 budget for the creation of a stormwater utility. Mr. Richard Staudinger, P.E., Gee & Jenson Client Manager, will be in attendance at the November 9th Council Meeting to present and answer questions concerning this proposal. Bradford Village Manager Village of Tequesta 357 Tequesta Drive Tequesta, Florida 33469 Re: Professional Services for Stormwater Utility Rate Analysis Village of Tequesta Stormwater Utility Dear Tom: We are pleased to submit th6 following proposal for professional services in connection with the Rate Analysis for the Tequesta Stormwater Utility. Gee & Jenson. Engineers-Architects-Planners, Inc. hereinafter referred to as the Consultant, proposes to furnish professional services for the Village of Tequesta, hereinafter referred to as the Client, of the Scope outlined below for the fees stipulated herein. These services will be performed in accordance with Section 2.1 (General Consulting Services) of our Continuing Services Agreement between The Village of Tequesta and Gee & Jenson Engineers-Architects-Planners, Inc. dated October 31, 1989. Scope of Services The Consultant will perform the following: TASK A. Prepare Preliminary 5 Year Budget Plan for Stormwater Utility. 1. Prepare Scope and Costs Associated with developing a new Stormwater Master Plan for the Village of Tequesta. a. Inventory and assimilation of existing plans, system data, Level of Service (L.O.S.) and federal, state and local requirements. b. Outline schedule and costs of new plan with recommendations on L.O.S..for water quantity and quality. (Plan preparation is a later phase, and not included in this analysis) . . , , 2. Based on known needs and historical flooding, NPDES requirements, etc. - Prepare a preliminary capital needs budget for the next five years to include: a. NPDES implementation costs and schedule. b. Capital cost estimates and timing for Cypress Drive Improvements, County Club Lakes, Dover Ditch, Shay Place, Fairway East, etc. c. Repair of existing storm facilities. 3. Prepare a Preliminary Stormwater Utility Management program outline and budget for the next five years including: a. Personnel Services - office and field. b. Equipment - New and Maintenance. c. Repayments to general fund. d. Recommended maintenance L.O.S. e. Cost of implementation and annual billing to customers. f. NPDES water quality monitoring. TASK B. Define within the Village of Tequesta the actual square footage of the equivalent residential unit (ERU) for the Stormwater Utility. 1. Prepare a land parcel analysis using Palm Beach County Appraiser's Office Computer Data as a basis. The Village of Tequesta will obtain the necessary computer tape and software to utilize the County Appraiser's database. a. Supplement with field data collection. b. Obtain up to date aerial photographs 2. Create Stormwater Utility data base listing at least the following information on each parcel: a. Parcel Identification Number b. Owner Name &Address c. Property Address d. Land use Category e. Legal description f. Propose criteria for credits available to parcels by land use criteria. Credits to be consistent with Stormwater utility ordinance. TASK C. Propose a preliminary rate schedule for the Stormwater Utility based upon the results of tasks A & B above. Rate schedule will be for 5 years (1995-1999) and will include an estimate of ERU growth (new construction) for the 5 year period. Ten (10) copies of the Rate Schedule and Backup Report will be prepared. TASK D. Prepare a detailed implementation schedule for the Stormwater Utility from the time the draft ordinance is presented to the Village Council until the first billing is sent out to customers, including: 1. Stormwater Utility Rate Ordinance. 2. Permitting/Inspection/Enforcement Guidelines. 3. •Data Management. Task E. Prepare an outline of the public information and participation plan for implementing the Stormwater Utility including timing of public workshops and contents for newsletters or brochures prepared by the Village explaining the Stormwater Utility rates. TASK F. Assist the Village's attorney in preparing a draft ordinance defining the ERU and Stormwater Utility rate structure for the Village of Tequesta Stormwater Utility. TASK G. Provide additional services as mutually agreed upon. • Items to be Furnished by the Client Assist the Consultant by furnishing, at no cost to the Consultant, all available pertinent information, including previous reports; base stormwater system maps; comprehensive plan; Palm Beach County Appraisers Computer data tape and necessary software to utilize same; all permit application and governmental inspection fees; and any other data relative to performance of the above services for the project. It is agreed and understood that the accuracy and veracity of said information and data may be relied upon by Consultant without independent verification of the same. Based on a start date of November 15, 1995, the Consultant will complete the Scope of Services as follows: • Tasks A, B and C completed by March 01, 1996. • Present Results of Task C to Public Works Committee of Village on or about March 15, 1996. • Tasks D, E and F completed by April 11, 1996 Village Council meeting. • Task 6, if necessary, will be completed in a time frame mutually agreeable to Client and Consultant. The above schedule will be completed within the time frames specified, except for delays beyond the reasonable control of the Consultant. Said representation is not, however, a warranty or guarantee that said services will be completed within such time frame. Fees to be Paid For Tasks A through F of the Scope of Services, the Consultant shall be paid a lump sum fee of Thirty Eight Thousand Dollars ($38,000.00), including reimbursable expenses. Invoices will be on a percentage completion basis by Task. One signed copy of this proposal returned to the Consultant will serve as an Agreement between the two parties and as Notice To Proceed. This contract will be binding on the parties hereto and parties successors and assigns. Should this proposal not be accepted within a period of thirty (30) days from the above date, it shall become null and void.
