Tom, ,attached are 18 packets and plans for the above subject project which was
reviewed by the Community Appearance Board on July 26, 1995.
The Board expressed the following concerns regarding the requested waivers:
Chairwoman Cook objected to the proposed Ixora and red-tipped cocoplum since they
were not frost tolerant.
The Board questioned the per-centage of native plant material provided. Mr. Rutledge
of Rood Landscape explained that at the present time native plants consisted of 37%
trees and 2% shrubs, and that they proposed to replace any shrubs which died with
native plants. They also planed to remove the existing 33 Norfolk Island pines over a
5-year period and to replace them with native trees. With these changes the trees
would meet the 60% native requirement.
Motion to approve the proposed landscaping and waivers as submitted and with the
following clarifications:
Indicate the existing per-centages, provide a statement relative to full automatic
irrigation facilities being provided, expand the plant list to provide tolerances of plants for
proposed and existing species. The Board approved the proposed 5-year period to
accomplish the landscaping, with the work starting in late fall of 1995.
Vote on the motion: 4-0 to approve.

Page 2, Para. (1) and (2) - We request partial waiver. Installation of the required
hedges is just not possible, as all our peripheral (boundary) areas are asphalted to
the property line and installing the required hedges would subtract from the width
of the parking areas and access driveways, all of which are already too narrow as
per current codes, and any substantial reduction of width in these areas would clearly
create hazardous conditions. See attached communication from Fredrich Shaffer, P.E. *
to substantiate these hazardous conditions. Virtually all of the required six foot
opaque fences have been already constructed, except for the Southwest corner.
Page 3, Para. (3) - We request waiver. We have no room for any ground cover, see
Para. (1) and (2) above. As to the required trees (which we also have no room for),
overhead power and telephone lines approximately 18 feet above ground, some as low as
12 feet, occupy virtually all our periphery. Thus, any real canopy trees would be
totally impractical. Further, our fences on the North and West boundarys are already
overhung with existing trees from the other aide of the property line. Approximately
40% of reak (West) boundary is covered by a complete, virtually impenetrable screen
of trees. Any new small trees planted in these portions of our boundarys would be
"lost" in the existing trees. Further, the Village has assumed responsibility for
landscaping the substantial portion of our boundary that abuts Constitution Park
(as per the Park landscape plan just approved by the Community Appearance Board).
Page 4, Para. (6) - We request waiver. Inspection of our plan shows we have diagonal,
not head-in parking. And, due to the width of current parking areas (well below
current codes) it would be impossible to convert to head-in parking. Further, we
currently have only 1.4 parking spaces per apartment, well below the current code
(2 each), adding the required interior islands, etc. would subtract at least 3 or 4
spaces per building, reducing our available parking to roughly 1.2 per apartment, and
parking already is in short supply in our worst-case buildings, see attached communi-
cation to "G" Building Residents. Also, see report from Professional Engineer
referred to ie Page 2, Para. (1) and (2).
Page 6, Para (10) - We request partial waiver. Since each parking area is currently
bordered by a 4. ft.• landscaped strip, it follows that we have 4/43 of the average
parking area landscaped, about "_9.3%, and we have already established that we cannot
further landscape any parking areas. (see requested waiver for Page 2, Para. (1) and
(2)) Also, we already have over 43% of our total property area landscaped, far more
than the typical shopping centers, mallls, highrise condominiums, etc. that are
covered by the same Landscape requirements.

Page 6, Para. (13) - We request partial waiver. We will remove an Australian Pine
Hedge on the East side of the recreation area, and replace with an approved native
type hedge. This and a small remnant of a similar Australian Pine Hedge (South of
"L" Building) which will also be removed, are the only invasive species that Rood
Landscaping was able to find.
As to Ordinance #377 totally, Ex Post Facto laws (like #377) are specifically prohib-
ited by both the Florida and the U.S. Constitutions and have been generally held to
be illegal in the United States. More recently, as a result of pressure for things
like environmental reforms, the courts have allowed some laws which make illegal
some parts of things. that were perfectly legal when constructed (like Tequesta
Gardens) . Generally, for such a law to be upheld by the courts, it has been necessary
to show clear benefits to the general public, and allow a reasonable time for
compliance!
Ordinance #377 basically contains the following areas:
A requirement to replace invasive species of plants ( possibly in the public interest),
a requirement to use a preponderance of native species in any required landscaping
(possibly in the public interest), and a lot of requirements having to do largely
with increasing the amount of greenery in and around commercial parking areas, and to
prevent the more usual acres of asphalt otherwise found at shopping centers, malls,
etc. . Unfortunately, Tequesta Garden Condominium has been lumped into the landscape
category for shopping centers, malls, and other commercial property. Thus, we would
seem to be required by the Ordinance to dig up a lot of asphalt, plant a lot of green-
ery in parking areas and cut down on the number of existing parking places by putting
in "separators" every 10 spaces, etc. -
It is our position, stated above, that these landscaping requirements are impossible
for us, or totally impractical, and these are not in any way in the public interest.
Most of our parking areas are not even visible to the general public on the public
roadways. In fact, we have always had No Trespassing signs posted so that unless the
general public are invitees, they would clearly be trespassers. Thus, if we were to
comply, we would be forced to spend large amounts of money, create dangerously narrow
parking areas, etc. which only our residents would use and see. This 'is clearly not
in the Public Interest in any way whatsoever.
Secondly, we have already made reasonable efforts to comply with #377. Also, it
would appear that our frontage on Seabrook Road, our only really public exposure, is
presently in accordance with #377. Further, we have stated that we will also do our
best at our Southeast corner (at Seabrook) to do landscaping compatible with the
Village plans for the new JTJC parking area.
It is possibly also worth noting that our entire Western and part of our Northern
border fronts County land, not Tequesta.

Review of Preliminary Landscape Plans for Ord. 377 Compliance
Tequesta Garden Condominium Association.
This letter is to confirm the action of the Village of Tequesta Community Appearance Board at
the July 26, 1995 meeting approving your application, as submitted with the clarifications
requested by the Clerk of the Board.
The requested clarifications consist of the following:
•
o providing the existing and proposed percentages of native species, palms to
canopy trees.
o providing the percentage of green space within each parking area.
o providing list of existing and proposed plants and trees addressing the drought
tolerance, hardiness zone, salt tolerance, and wind resistance.
o indicate that there is now or will be upon completion of the approved work, full
automatic irrigation to all landscape areas.
This approval has no bearing or relationship to any other approvals or permits which may be
required. Please feel free to contact this office should you have any questions regarding this
matter.

Landscape Plan.
I)Tequesta Gardens is currently working on their Irrigation system and will provide 100%
coverage by an automatic irrigation system by 1-1-1996. All proposed new landscape will also be
100% irrigated.
2)Gross Parking Area Landscaped is only 7.5%due to the shortage of parking spaces not
allowing the addition of landscape islands. ,

Dear Mr. Ladd:
Tequesta Garden Condominium Association intends to proceed
with landscaping of the main entrance to Tequesta Garden at
Seabrook Road and Westwood Avenue as soon as the Village gives
us approval to do so. The other three entrances (Seabrook north,
Seabrook south, and the Garden Street entrance) are to be-land-
scaped within three to six months if at all possible.
The removal and replacement of the 33 Norfolk Island Pine
trees with Native trees is to be completed within the next five
years.
The remainder of the landscaping in the overall plans of
Tequesta Garden is to be completed as the plants and trees die
out and/or need to be replaced.
Tequesta Garden intends to beautify our grounds as per planned,
not only for our own benefit of beautification but to comply with
Ordinance #377 as much as possible. The waivers we are asking for .
are, of course, a necessity as explained in our plans.

Dear Mr. Cameron,
As stated in ordinance 377 by the VILLAGE COUNCIL, OF THE VILLAGE OF
• TEQUESTA, the parameter landscape requirements are as follows. Minimum of a 5'
Iandscape buffer to include one tree for every 30 lineal feet of property.line, continuous hedge
minimum of 24" tall at time of planting. In cases where your property abuts residential
property, a 5'=6' opaque wall/fence is also required.
In practically all perimeter ares on your property this requirement is going to be impossible to
comply with because of your existing conditions.
In many areas along the perimeter fences, there is only 12 to 18 inches of planting space
which is not even enough room for a hedge and certainly not enough space for trees. If more
, • asphalt was cut out to provide the required 5' of landscaping, I think your going to have some
serious problems with traffic maneuverability in the parking lots and access roads. Also
surrounding your perimeter are overhead wires ranging from 12' to 20' above the ground
making the possible tree selection very slim.
• This subject should be brought up with the Village of Tequesta to get their feedback and any
suggestions they may have.

Dear Mr. Cameron:
LWI ,
In accordance with your request, we have undertaken a review of your
parking lots in conjunction with our consultant Southern Design Group Inc..
This review has resulted in the following observations and conclusions.
1 . The current parking allotment, as originally permitted, is 1 .5
o spaces per unit which is less than. the current requirement of 2
spaces per unit.
2. In our observations, it appears that nearly all of the existing
parking spaces are currently in use and that open spaces were not
° abundant.
3. Based upon our field observation, we do not recommend that any
parking spaces be deleted or shifted to meet the current landscape
codes. This would result in a further depletion of available parking
which is minimally acceptable at this time.
4. Due to the angled parking configuration (and in some cases parallel
parking), which create one way access, and the limited width of
parking drive aisles, we do not recommend any dimensional reductions
•
of the spaces or drive aisles to meet the current landscape codes.
This would result in unacceptably narrow traffic aisles and parking
spaces.
If we may be of assistance on this, or any other matter, please do not

2. An application from Tequesta Garden Condominium
Association for review of preliminary landscape plans for
Ordinance #377 compliance. Rood Landscape Company,
Landscape Architects.
Mr. Richard J. Rutledge of Rood Landscape Co. introduced
Nancy. Hirst, President of the Association, and past
President Alec Cameron. Mr. Rutledge explained that
waivers for parking and other issues had been granted
previously by the Village Council, and the main issue at

this time was the 60% native requirement. Mr. Rutledge
explained that there was insufficient room to install
required hedges, ground covers, real canopy trees, and
additional landscaping in parking areas, and stated that
the Association proposed to beautify their entrances with
additional native plantings. Mr. Rutledge commented that
at the present time native plants consisted of 37% trees
and 2% shrubs, and proposed to replace any shrubs which
died with native plants, and to remove the existing 33
Norfolk Island pines over a 5-year period and to replace
them with native trees. With these changes the trees
would meet the 60% native requirement. Mr. Rutledge
explained that the existing shrubs had been planted so
many years ago that they were well established and
therefore only required minimum irrigation, and in order
to bring the shrubs up to 60% native a tremendous amount
of healthy, established plants would have to be removed.
It was the consensus of the Board to accept the proposal
on the 60% native issue.
Entranceway plans were reviewed, which the Association
proposed to proceed with during the next year, proposed
to be 60%- native in order to keep the theme of other
plantings in existence throughout the project. Chair
Leslie Cook objected to the proposed Ixora and red-tipped
cocoplum since they were not frost tolerant. Mr.
Rutledge explained that the landscaping would consist of
layered heights and that the Ixora was not proposed as a
front-line visible plant and was scattered, so that in
the event of' frost the plantings would still look nice
until they recovered. Clerk of the Board Scott D. Ladd
explained that the adjacent JTJC property had an approved
landscape plan which would go into effect when the
existing lawsuit was settled. There was some discussion
of the JTJC building and the trash around it. Ms. Hirst
explained that the adjacent corner was a pedestrian
hazard, which must be kept in mind when considering
plantings. Mr. Ladd advised the applicant that an

addendum would be necessary indicating existing
percentages, stating that full automatic irrigation
facilities were provided, and the plant list expanded to
provide tolerances of plants for proposed and existing
species. Ms. Hirst requested a 5-year period to
accomplish the landscaping, with the entries to be
started in late fall of 1995 .
Motion was made by Boardmember Coben to approve the
application from Tequesta Garden Condominium as submitted
with the addition of the clarifications by Mt. Ladd. The.
motion was seconded by Boardmember Dalack and passed by
unanimous vote.
